The contractor must provide all qualified personnel, transportation, maintenance, equipment, and materials necessary for complete performance. A single point of contact must be available 24 hours a day, seven days a week for scheduling services, and the contractor must be capable of providing required items within 24 hours of notification. Quality control procedures must assess compliance with temperature and power requirements at least weekly, with a performance standard of no more than three customer complaints during the event. The contractor shall obtain all required licenses and permits and comply with all applicable laws and regulations at no additional cost to the Government. The contractor is also responsible for coordinating with Andersen Airforce Base Military Personnel to obtain necessary base passes and Area Passes for drivers and vehicles. PERFORMANCE OF WORK STATEMENT

REFRIGERATED AND FREEZER CONTAINER UNITS

RENTAL/SERVICE REQUIREMENTS IN SUPPORT OF

FOOD SERVICE OPERATIONS AT SOUTH KOREA

1.0 SCOPE OF WORK. In accordance with the schedule of supplies and services, the contractor shall support users who require refrigerated and freezer container units to support expeditionary field feeding operations at Camp Mujuk and Rodriguez Live Fire Complex (RLFC), South Korea. The contractor shall provide refrigerated and freezer container rental/service support during the period 15 February – 1 April 2026 as requested on demand to support of US Forces as outlined in section 2.0 of this performance work statement.

2.0 DESCRIPTION OF SERVICES. The contractor shall provide refrigerated and freezer container unit rental/service support during the period 15 February – 1 April 2026:

General Requirements

3.0 REFRIGERATOR CONTAINER UNIT. The contractor shall provide a refrigeration container unit with a total capacity equivalent to a 40-foot unit. This can be achieved by providing either a single 40-foot refrigerator unit or two 20-foot units. The choice of configuration should be based on the efficiency of installation, operation, and maintenance, considering the space and logistics of the deployment site.

3.1 The refrigeration container unit shall provide all power generation requirements to operate

3.2 The contractor is responsible for the delivery, installation, and commissioning of the refrigerator units at the designated site. This includes ensuring that the units are properly secured, connected to the power supply, and fully operational before acceptance by the requiring activity.

3.3 The refrigeration unit shall maintain constant temperatures between 0 degrees C and 4 degrees C. The contractor shall respond within 4 hours of notification of non-compliance to remedy and or replace any components or units to be in compliance with the specification of this

PWS.

4.0 FREEZER CONTAINER UNIT. The contractor shall provide a freezer container unit with a total capacity equivalent to a 40-foot unit. This can be achieved by providing either a single 40-foot refrigerator unit or two 20-foot units. The choice of configuration should be based on the efficiency of installation, operation, and maintenance, considering the space and logistics of the deployment site.

4.1 The freezer container unit shall provide all power generation requirements to operate the refrigeration unit. There shall be sufficient power infrastructure to constantly supply un-interrupted power to the refrigeration unit such that refrigeration is continuous.

4.2 The contractor is responsible for the delivery, installation, and commissioning of the refrigerator units at the designated site. This includes ensuring that the units are properly secured, connected to the power supply, and fully operational before acceptance by the requiring activity.

4.3 The freezer unit shall maintain a constant temperature between -23 degrees C and -18 degrees C. The contractor shall respond within 4 hours of notification of non-compliance to remedy and or replace any components or units to be in compliance with the specification of this

PWS.

5.0 LOCAL CONTRACTOR COORDINATION. The Logistics Coordinator will be responsible for ensuring the selected contractors provide the requested services; overseeing initial installation; and reporting service interruptions to the CLR 37 Food Service Officer.

5.1 CONTRACTOR RESPONSIBILITIES. The contractor is required the following:

a. In accordance with the performance of this statement of work for the services outlined in Section 2.0, the contractor will provide all qualified personnel/drivers, supervision, transportation, maintenance, operating cost, equipment to unload, tools, materials, and any other necessary supply or service to accomplish the complete performance of the services requested herein.

b. The contractor shall provide the requested services as defined within the specified timeframes in the quantities specified.

c. The Contractor must be capable of providing the required items within a minimum time of 24 hours from time of notification and shall provide a single Point of Contact (POC) that may be reached at any time, 24-hours a day, 7-days a week, for the scheduling of any necessary services.

d. Immediately notify the Contracting Officer upon contractor determination of inability to perform.

e. The contractor will perform all tasks in accordance with Performance Work Statements within this Agreement.

f. Contractor personnel shall at all times be under the supervision of the contractor and not under the supervision of the U.S. Government or any of its officers or employees.

g. The Contracting Officer will bring discrepancies or noncompliance with the contract clauses, specifications, or Statement of work to the attention of the Contractor’s supervisor or foreman for necessary corrective action.

6.0 PERIOD OF PERFORMANCE.

7.0 POINTS OF CONTACTS AND AUTHORITIES. The contracting officer is the only person authorized to approve any changes to the requirements of this contract and not withstanding provisions contained elsewhere in this contract, the authority remains solely the contracting officer. In the event the contractor effects any change at the direction of any person other than the contracting officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price because of the change.

8.0 CONTRACTUAL RELATIONSHIPS. Contractor personnel shall always be under the supervision of the contractor and not under the supervision of the Government or any of its officers or employees. The contracting officer will bring discrepancies or noncompliance with the contract clauses, specifications, or Performance work statement to the attention of the contractors’ supervisor or foreman for necessary corrective action.

9.0 LIABILITY. The U.S. Government accepts no liability for the actions of the contractor or his employees and agents.

10.0 SAFETY & SECURITY.

The contractor and their hired employees shall be responsible for ensuring all safety driving requirements are adhered to and shall not at any time during the performance of the lease agreement place in any danger the Government passengers being transported within the leased vehicles. The Contractor is required to comply with force protection measures as directed by the US Government Representative. Driver will sign for responsibility/condition of the US Military cargo. Driver will drive directly to US Military identified destination without stopping. Upon arrival at destination, US Military Rep and contracted Driver will inspect the cargo to ensure no damage/loss. Upon confirmation, US Military Rep will sign for the cargo, relieving contractor from responsibility.

11.0 BASE PASSES.

The contractor is responsible for all required coordination with the Andersen Airforce Base Military Personnel, to obtain base passes or Area Passes that provide appropriate access for their drivers and vehicles to military facilities.

12.0 POINTS OF CONTACTS AND AUTHORITIES

The U.S. Government (Exercise Executive Agent) retains the right to make changes to this Performance Work Statement, prior to contract award, based on factors that are unknown at this time (e.g. funding is formally decreased, direction from U.S. Pacific Command due to changing political conditions, dates shift slightly, etc). The contracting officer is the only person authorized to approve any changes to the requirements of the contract and not withstanding provisions contained elsewhere in the contract, the authority remains solely with the contracting officer. In the event the contractor effects any change at the direction of any person other than the contracting officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price as a result of the change.

13.0 OTHER REQUIREMENTS

13.1 QUALIFICATIONS. All work is to be performed by a competent person, experienced and qualified to provide the required services.

13.2 CONFIDENTIALITY. All work discussed or carried-out of during the period of any performance shall remain strictly confidential. A statement of confidentiality will be signed by the supporting Contractor(s) prior to the start of the first Call.

13.3 CONTRACTING OFFICER AUTHORITY. Only the Contracting Officer has the authority to issue changes to this Performance Work Statement - and the corresponding contract -which affect price, quality, quantity, delivery, or any other aspect that will change the terms and conditions of the contract. The Contracting Officer is the only official who has the authority to modify or terminate the contract, or to obligate Government funds.

13.4 ANTI-TERRORISM AND OPERATIONAL SECURITY.

13.5 BASE ACCESS. Contractor will coordinate directly with local military bases to ensure their employees meet access requirements and are able to perform the contract on the host nation base. The US government cannot waive any requirements for access to military bases. The contractor is responsible for delivering items to the location specified in this PWS. Inability to access military or host nation locations is NOT a reasonable justification for failure to deliver.

Contractor and employees may be required to attend a security briefing prior to accessing the installation.

13.6 INFORMATION DISCLOSURE. Contractor will distribute to all employees the US government provided social media guidance prior to the start of the exercise. The US will monitor Social Media traffic during the exercise for violations of this guidance by contractor s and/or their employees. Violations of the Social Media Guidance may result in contract termination and/or a contractor being barred from future contracts with the US government.

13.7 INCREASES IN FORCE PROTECTION CONDITIONS. US military personnel may increase security measures at any time during the execution of the contract. Contractor will need to maintain communication with Thai military for access control and the Contracting Office or his/her designated representative to stay aware of possible changes.

13.9 LIABILITY: The U.S. Government accepts no liability for the actions of the Contractor or his employees and agents.

13.10 EMERGENCY. The contractor shall provide a point-of-contact (POC) available 24hours for all emergency requirements. The contractor shall be able to provide a response/support within six (6) hours for all emergency calls relative to this requirement.

13.11 The Contractor shall, at no additional cost to the Government, obtain all licenses and permits required for performance of work and for complying with all applicable local, state, and federal laws, rules, and regulations.

14.0 QUALITY CONTROL & ASSURANCE

14.1 The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with each individual call. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means to assure that the work complies with the requirements of the contract. At a minimum, the contractor shall develop quality control procedures that address the performance standards identified in each individual call. The contractor shall assess compliance with Para 3.1, 3.3, 4.1, and 4.3 at least weekly.

14.2 The performance standard is that the Government receives no more than three (3) customer complaints during the course of the event. The Contracting Officer will take appropriate action upon receipt of complaints to enforce the inspection clause (FAR 52.212.4, Contract Terms and Conditions-Commercial Items), if any of the services are not performed to standard. The contractor shall, if any of the services do not conform to the contract requirements, be required by the Government to re-perform the services in conformity with the contract requirements, at no additional expense to the Government.
