1. Solicitation is in accordance with FAR Part 12, Acquisition of Commercial Items and FAR Part 13.5, Simplified Procedures for Certain Commercial Items, as applicable. This requirement is 100% small business set-aside.
2. A Site Visit will be conducted, Tuesday, March 10, 2020, @ 1000. Attendance is recommended for offerors. The meeting location will be the Visitor Control Center at the Scranton Gate. Attendees are encouraged to arrive 15 minutes before scheduled time to allow for processing. If visitors do not possess a TYAD issued Contractor badge, they will be required to present a valid, Government issued photo ID in order to gain access to the base (vehicle registration and insurance may also be required). Information provided, as well as answers to any general questions, shall not affect the terms and conditions of the solicitation and/or specifications. Terms remain unchanged unless the solicitation is amended in writing.
3. Proposals shall be submitted no later than the response date to the Contract Specialist, jacqueline.d.ramsey.civ@mail.mil.
4. The minimum acceptable acceptance period for offers is sixty (60) days from the date specified in Block 8 on Page 2 of the (SF) 1449.
5. Any resultant award will be a combination of a Firm Fixed Price.
6. BASIS OF AWARD: Award will be Best Value to the Government using a Trade-off process for Technical, Past Performance and Price in accordance with (IAW) FAR 52.212-2, Evaluation
- Commercial Items. Offerors are cautioned that any award may not necessarily be made to the lowest offered price or the highest technical rated.
7. CONTRACTOR SUBMITTED QUESTIONS: Offerors are advised to submit any questions regarding this solicitation in writing as soon as practical but no later than seven (7) calendar days prior to solicitation response date to jacqueline.d.ramsey.civ@mail.mil. This includes any departure from the specifications or drawings deemed necessary, details of such departure and reason. Answers will be consolidated and posted to FBO.gov ONLY in the form of Questions and Answers or, if required, an amendment to the solicitation. PERFORMANCE WORK STATEMENT (PWS)
LANDSCAPING AND TREE TRIMMING MAINTENANCE
PART 1
GENERAL INFORMATION
1. GENERAL: This is a non-personnel services contract to provide grounds landscaping maintenance services, Tree and brush cutting of the perimeter fence line and on-call services depot wide at the request of the government. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1. Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform grounds landscaping maintenance services and tree/brush cutting as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.
1.2. Objectives:
1.2.1. Maintain landscaped areas and perimeter tree/brush cutting along perimeter fence line.
1.3. Scope:
1.3.1. Maintain approximately 110,000 square feet of landscaped ground area to include mulched/planting beds, shrubs, flowers, decorative trees, etc. throughout Tobyhanna Army Depot.
Included in this contract will be tree and brush cutting along the perimeter fence line to maintain physical security requirements. This contract will be to ensure Tobyhanna Army Depot remains aesthetically pleasing and physical security requirements are met at all times.
1.3.1.1. Perform grounds landscaping maintenance throughout the depot as shown on Depot Map 1, provided during site visit upon request. Maintenance shall include mulching, weeding, pruning and sucker removal during the months of March/April through October as weather permits. Contract shall include the maintenance of a softball field and employee park. See PWS PART 5 for additional information.
1.3.2. Tree and brush cutting shall include approximately 31,000 linear feet by an average of approximately 5 feet wide of perimeter fence line to maintain physical security requirements. Contract will include approximately 170 decorative trees within the depot grounds to be pruned and shaped for an even balance.
1.3.2.1. Tree and brush cutting shall include an annual instance of approximately 31,000 linear feet of perimeter fence line trimming.
1.4. Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four (4) 12-month option years. The Period of Performance reads as follows:

1.5. General Information
1.5.1. Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.5.2. Recognized Holidays: The contractor is not required to perform services on holidays.

1.5.3. Hours of Operation: The contractor is responsible for conducting business, between the hours of 0730 and 1530, Monday thru Friday unless stated otherwise except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.5.4. Place of Performance: The work to be performed under this contract will be performed throughout Tobyhanna Army Depot.
1.5.5. Type of Contract: The government will award a Firm Fixed Price contract.
1.5.6. Security Requirements: See Part 6 for additional information.
1.5.6.1. PHYSICAL Security: The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.
1.5.7. Special Qualifications: See Part 6 for additional information.
1.5.8. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.
These meetings shall be at no additional cost to the government.
1.5.9. Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance:
maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.5.10. Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
1.5.11. Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.
Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS.
When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. SUBCONTRACTOR. One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.
2.1.13. WORK WEEK. Monday through Friday, unless specified otherwise.

PART 3
GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:
3.1. Facilities: The Government will provide access to facilities as specified/needed contingent on the security requirements listed in Part 6.
3.2. Utilities: The Government will provide water and waste water utilities as specified/needed when available.
The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount to accomplish cleaning vehicles and equipment.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1. General. The Contractor shall furnish all supplies, equipment and services required to perform work under this contract that are not listed under Section 3 of this PWS.
4.2. Materials. All cutting, debris and trash resulting from the contractors work must be removed from the site and disposed of per IAW Pa. Act 101 and the Monroe Country Solid Waste Management Plan. This material cannot be placed in the dumpster or a landfill.
4.2.1. Removal of trees must have prior approval and coordinated with the TYAD COR.
4.3. Equipment. Contractor shall perform all work by a certified service person using industry standard equipment for this type of work.
4.3.1. Contractor shall furnish all necessary equipment to perform pruning, brush and tree cutting, landscaping/weeding and softball field grooming as described under the PWS listed in PART 5.
4.4. Materials. Contractor shall furnish mulch and plants as needed and requested by the government.
PART 5
SPECIFIC TASKS
5. Specific Tasks:
5.1. Basic Services. The period of performance shall be for one (1) Base Year of 12 months and four (4) 12-month option years.
5.2. The Contractor shall schedule a minimum of two (2) visits annually with the COR to discuss any areas that may need immediate attention and the course of action required.
MAINTENANCE of LANDSCAPED AREAS:
5.3. Suggested visits as weather permits will begin Mar/Apr 2021, as Base Period of Performance begins 1 June 2020, to prep all areas. Subsequent visits will be scheduled through the COR at the beginning of each season, approximately May, June, July, August, September and October, or as needed by nature, or the government.
5.4. First visit in the spring will be to characteristically prune, prep and repair all landscaped areas.
5.4.1. The contractor shall rake, till and spread the existing mulched beds, turning over the surface to determine if additional mulch is required.
5.4.2. The contractor shall maintain a maximum of 3 inches of evenly spread mulch in all landscaped beds and around all ornamental/border trees with circular bases when requested and approved by the government.
5.5. Each subsequent visit will be used to maintain and keep all areas pruned, weed and sucker free as needed by the government and nature.
5.6. Last visit in the fall will be used to characteristically prune and prep all areas in preparation for winter.
5.7. All work will be scheduled through the COR.
5.8. Payments will be made upon successful completion of scheduled maintenance at the end of each month after comprehensive daily reports are approved by the COR.
5.8.1. The daily reports shall state, at a minimum, locations maintained in detail, number of personnel, number of hours per personnel and amount of material used (if any).
5.8.2. Daily reports shall be rendered to the COR at the end of each service month.
WEED CONTROL
5.9. The Contractor shall prevent the encroachment of weeds into established plant beds and around trees, shrubs, and all graveled areas.
5.10. All landscaped areas will receive weed control to eliminate unsightly and/or noxious weeds.
5.11. Before any herbicide or pesticide is applied, the contractor must first submit, to the COR, a submittal of the proposed product. This will be forwarded to the Pesticide/Herbicide Management Coordinator for approval/disapproval.
5.11.1. The contractor shall report to COR any herbicide/pesticide to be used on DD Form 1532. All usage must include the EPA Registration number of the product used, to be forwarded to the Pesticide/Herbicide Management Coordinator.
5.12. In the event chemical herbicides are used, the contractor must be licensed by the Commonwealth of Pennsylvania to provide pest/weed control services in the categories required for this work.
5.12.1. All work will be performed under the supervision of an individual certified by the Commonwealth of Pennsylvania and IAW all applicable federal, state, and local laws, regulations and requirements.
5.13. All employees of the contractor applying herbicides shall be certified and licensed by the Commonwealth of Pennsylvania for each category required or be working under direct-in-line-of–sight supervision of a certified pest control operator licensed by Pennsylvania for each category required. Proof of certification shall be provided to the COR upon request.
5.13.1. Uncertified personnel that apply herbicides under the supervision of a licensed pest control operator shall have been employed in pest control for a minimum of 30 days, be trained in integrated pest management practices and be registered with the Pennsylvania Department of Agriculture.
TREES/SHRUBS/PLANTS
5.14. The approximate number of herbaceous ornamentals requiring attention are 120 deciduous, 50 evergreens and hundreds of plants and flowers.
5.15. All dead trees, dead tree branches, dead shrubs, dead plants shall be removed including roots and all holes filled and covered to match surrounding areas.
5.16. The contractor shall provide a proposal (within 3 days) with suggested replacements including cost and the guaranteed installation.
PRUNING
5.17. All plant material is to be characteristically pruned or trimmed back to maintain established shape and appearance, in preparation for spring and throughout the summer and fall, as needed.
5.18. All shrubs, bushes, hedges, trees, flowers, and all other herbaceous items are to be pruned according to their natural growth habits for proper health, attractive appearance and to prevent interference with pedestrian and vehicular traffic.
5.19. Prevent growth in front of windows, over entranceways, and sidewalks that can obstruct vision or as required by the government.
5.20. Remove dead, damaged, or diseased wood or structurally weak limbs for safety reason.
5.21. Remove all branches that extend over buildings and endanger roofs, eves, and windows or hanging within 6 feet of sidewalks, parking lots, and driveways.
5.22. At all times, provide clearance for all vehicles along the street, parking lots, sidewalks, and as needed.
5.23. Remove all suckers.
5.24. Characteristically prune by evenly forming and balancing the shrubs, bushes, or plants as needed.
REMEDIAL MULCHING (as needed)
5.25. Maintain all landscaped areas: trees (ornamental deciduous and evergreen), shrubs, flowers, planting beds with recycled wood mulch (or government approved equal) as needed.
5.26. The government will make the final determination if new mulch is required in the landscaped areas, after the area has been tilled, raked and cleaned.
5.27. If mulch is required the government will approve the mulch and the color.
5.28. The contractor shall provide the cost per cubic yard of recycled and cedar mulch delivered and spread.
SOFTBALL FIELD (Building 11A)
5.29. The contractor shall keep all dirt areas on the softball field weed free either by hand picking or spraying weed killer as needed.
5.29.1. Every two weeks during the months of May through October, (approximately 10 occurrences) the contractor will maintain a well-groomed infield and warning track (all dirt areas) by weeding and power raking the entire area using a rock rake.
5.29.2. After power raking is completed the contractor will hand rake over the entire area to maintain a smooth and even surface. Remove all loose rocks and fill in any depression with matching surface material.
5.29.3. In the event surface material is required to fill in any depressions or valleys the contractor will provide the cost per ton to deliver and spread. Soil characteristics shall be a fine coarse granular brownish-red solid. Soil shall include approximately 65% sand, 24% silt and 11% Clay.
5.30. The contractor shall furnish a per occurrence price for the work on the Softball Field/Employee Park.
TREE/BRUSH CUTTING (Perimeter Fence)
5.31. Contractor shall supply an overall cost, including an operator or driver of special equipment that may be utilized in the execution of this contract to trim approximately 31,000 linear feet of perimeter fence line at an average of approximately five - ten feet wide. Fence line will include vegetation,brush cutting and tree trimming and/or removal along the fence line.
5.31.1. In the event that the contractor requests the use of, or need of, special equipment, it must first be approved by the COR.
UNPRICED BUT IN SCOPE REQUIREMENTS:
5.32 The following services are considered within scope of this requirement and, although not immediately anticipated, they might be deemed by the COR to be necessary during performance of this contract. If deemed necessary during performance, the Government will request a firm-fixed price quote for these services and negotiate accordingly. The Contractor shall not proceed with performance on the following unpriced, but within scope requirements unless authorized by the Contracting Officer through a bi-lateral modification to the contract.
5.33. Tree trimming as a result of a storm.
5.34. Tree trimming prior to special events at the depot.
5.35. All work will be performed during normal working hours, 0730 to 1600 hours (7:30 am to 4:00 pm), Monday through Friday, excluding Federal holidays.
COORDINATION:
5.36. No work will commence without authorization from the contracting officer, POC or COR.
5.37. The POC will verify all materials/equipment required.
5.38. The contractor must report to POC upon arrival and upon completion of work. Written daily log of time, areas and locations of work will be rendered to POC on a monthly basis.
5.39. The contractor is responsible to make all repairs due to damage caused by his/her employees.
CLEAN UP:
5.40. All cuttings, debris and trash resulting from the contractor’s work must be removed from the site and disposed of IAW Pa. Act 101 and the Monroe Country Solid Waste Management Plan. This material cannot be placed in a dumpster or a landfill.
5.41. The contractor is responsible to make all repairs due to damage caused by his/her employees.
WORKMANSHIP:
5.42. The workmanship will be IAW with the best standard practice for this type of work.
5.43. The contractor will commence work as weather permits after receipt of award
QUALITY CONTROL:
5.44. Quality control will be the responsibility of the selected contractor.
5.45. The contractor must meet all Federal Safety Standards (OSHA).
5.46. The contractor must meet all U.S. Army and all Federal quality and workmanship standards.
5.47. COR Appointment Letter for this contract will be provided at time of contract award.
CONTRACTOR MANPOWER REPORTING REQUIREMENTS:
ACCOUNTING FOR CONTRACT SERVICES REQUIREMENT (Oct 2012) The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the Textile Repair Service via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address:
http://www.ecmra.mil/, and then click on “Department of the Army CMRA” or the icon of the DoD organization that is receiving or benefitting from the contracted services.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2013. Contractors may direct questions to the help desk by clicking on “Send an email” which is located under the Help Resources ribbon on the right side of the login page of the applicable Service/Component’s Contractor Manpower Reporting website.

Standard Specifications for Projects Under the National Environmental Policy Act in Accordance with 32 CFR 651 Proponent ELTY-ISR-E
1. Air Pollution Control The contractor must control fugitive emissions, including dust, during the course of their contract. The contractor must obtain approval from the Environmental Branch (EB) prior to exhausting equipment to the outside. The contractor must not allow any pollutant or particulate matter to be released to the atmosphere at levels that are visible from outside of Tobyhanna Army Depot (TYAD). The contractor must not perform work that will release pollutants or particulate matter to the atmosphere when the wind speed exceeds ten miles per hour and will result in adverse effects to the surrounding areas. TYAD will monitor the wind speed; it is the contractor’s responsibility to obtain wind speed information through the Contracting Officer Representative
(COR).
2. Asbestos The contractor must ensure that all materials used in the performance of this contract are asbestos-free.
Unless specified in the contract, the contractor must not disturb any existing Asbestos- Containing Material (ACM) in the performance of this contract. If ACM, or suspect ACM might be disturbed in performance of this contract, the contractor must avoid coming in contact with the material and immediately notify the COR and the Contract Administrator in writing. The COR must coordinate with EB to have the material tested to determine if there is ACM. If the material is determined to be ACM and the contractor cannot avoid disturbing the material, the COR will notify the Contracting Officer. The Contracting Officer will direct a change pursuant to the contract clauses entitled “Changes” and “Differing Site Conditions.” If ACM, or suspect ACM has been disturbed, the contractor must immediately notify the COR and call the EB. The contractor will evacuate all non-contaminated contractor personnel from the immediate vicinity. Any contractor personnel thought to be contaminated with asbestos must remain in the area until the EB responds. If the damaged material is determined to be ACM and there is potential for further damage, the Contracting Officer will direct a change pursuant to the clauses of the contract clauses entitled “Changes” and “Differing Site Conditions.”
Asbestos abatement required under the contract as originally awarded must be in accordance with United Facilities Guide Specification 02 83 14 00 10 and as otherwise required in the contract. Asbestos abatement not required under the contract as originally awarded, can be incorporated into the existing contract via contract modification, or by the Government taking responsibility for the asbestos abatement. The method of acquiring the abatement is at the discretion of the Government. The contractor must have an asbestos abatement work plan that has been approved by EB prior to beginning any asbestos abatement work.
3. Backflow The contractor shall have a backflow prevention device installed on all contractor equipment that is connected to Tobyhanna Army Depot’s (TYAD) water distribution system. The contractor shall have a water meter installed to monitor water consumption during all phases of the contract. Water use will be reported monthly to the Environmental Branch.
4. Burning The contractor must not burn refuse and debris anywhere on TYAD.
5. Buy Recycled-Content Materials The Contractor must comply with Resource Conservation and Recovery Act (RCRA) Section 6002 (42 U.S.C.
6962, Federal Procurement) in the acquisition of materials with recycled content to meet the standards of Executive Order 13693, Planning for Federal Sustainability in the Next Decade; March 19, 2015. Specific designated items in this contract for which recycled content standards have been established have been set forth in the specification (e.g., insulation, roofing materials, carpet, carpet pad, paint, floor tiles, shower and restroom dividers). Recovered Material Certification: As required by the RCRA, the contractor must certify that the percentage of recovered materials to be used in the performance of the contract will be at least the amount required by the applicable contract specifications (see Federal Acquisition Regulation (FAR) Provision 52.223-4, Recovered Material Certification). Prior to application for final payment, the contractor must provide a report in accordance with FAR Clause 52.223-9, Estimate of Percentage of Recovered Material Content for Environmental Protection Agency (EPA) Designated Items, to the Contracting Office. Compliance with this program does not relieve the contractor from meeting all other specification requirements.
6. Cultural Resources The contractor must not adversely affect any property listed on the National Register of Historic Places (NRHP) or properties eligible for inclusion on the NRHP without consultation and approval from the EB through the COR. If there is a discovery of any historic properties, including archeological sites and graveyards, work will cease immediately until requirements of National Historic Preservation Act, as amended, have been met. All archaeological artifacts found at TYAD or TYAD-controlled properties are U. S. Government property until a determination is made otherwise.
7. Demolition Notification If a project involves the demolition of any load-bearing structural members, whether or not asbestos is present, 25 days prior to the demolition, the Commonwealth of Pennsylvania Asbestos Abatement and Demolition/Renovation Notification Form 2700-FM-BAQ0021 must be submitted to EB as specified in the Unified Facilities Guide Specification 02 82 13.00 10. The contractor may obtain a copy of the form from the EB.
8. Drinking Water The contractor must not perform any work on the TYAD potable water system prior to obtaining approval from the EB and the Installation Planning and Maintenance Division certified operator through the COR. If a permit is required due to construction or proposed chemical feed changes, it will be the responsibility of the contractor to obtain all permits associated with the project.
Permit applications will first be reviewed and approved by the Environmental Branch before being submitted to regulatory authorities. Any piping or additions added to the TYAD water system must be disinfected following American Water Works Association circular C651-14 "Disinfecting Water Mains." Construction will be kept outside of drinking water wellhead protection zones when feasible. All new buildings and remodeled buildings will be equipped with a water meter that can easily be read from the exterior of the building.
9. Endangered Species The contractor is responsible for meeting requirements of the Endangered Species Act of 1973. The contractor must not disturb any endangered species, their habitat or offspring during the implementation of this contract.
10. Emergency/Spills All emergencies and spills must be reported to the TYAD Fire Department by calling 911 from a TYAD phone or (570) 615-7300. If a 911 call is placed on a cell phone, the call will go to the Monroe County Emergency Office. Notify the Monroe County Emergency Office that you are at TYAD and the call will be forwarded to TYADs Fire Department. The contractor must ensure all personnel working on site are trained in the proper procedure according to 29 CFR 1910.120 (if applicable) to initiate a spill response to handle the hazardous substances they are working with. The contractor will take the necessary actions to prevent and contain spills of hazardous materials.
11. Energy Efficiency The Energy Policy Act of 2005 section 109 and the Energy Independence and Security Act of 2007 require all new construction at federal facilities to be 30% better than ASHRAE 90.1.
Energy Policy Act of 2005 section 104 and the Energy Independence and Security Act of 2007 require all new equipment to be Energy Star qualified when available. This is applicable to heating, ventilation and air conditioning equipment, plumbing, building materials, lighting, commercial food service equipment and appliances.
12. Environmental Automation and Control Systems The contractor will not alter, modify, remove or tamper with any environmental automation or control system unless previous arrangement have been made with EB. This includes sensors, programmable logic controllers, equipment housing, power supplies, meters or other hardware/sensor technology.
13. Erosion and Sedimentation Control The contractor shall protect streams, lakes and wetlands from sediment discharges caused by the contractor's activities. The contractor shall also provide (where applicable) an erosion and sedimentation control plan in compliance with state and local laws and regulations, to the COR for approval prior to executing any soil-disturbing activities. The contractor must submit a National Pollutant Discharge Elimination System Permit to the Pennsylvania Department of Environmental Protection (PADEP) prior to any construction activity that encompasses more than one acre. All permits must be reviewed and approved by the EB prior to being sent to any regulatory authority. The contractor shall not disturb any wetlands. Contractor will remove all silt fencing and other temporary control measures once the site is stabilized. Contractor will remove all spoils from TYAD unless a previously approved disposal site has been established.
The contract COR will be responsible for management and control of the spoils disposal site.
14. Fluorescent and Mercury-Bearing Lamps The contractor is to collect, containerize, manage and recycle fluorescent and mercury-bearing lamps in accordance with 40 CFR 273, Standards for Universal Waste Management. A copy of the manifest/Bill of Lading must be given to the EB through the COR five days in advance of shipment by the contractor so that it can be reviewed for accuracy and completeness.
