THIS IS A 100% SMALL BUSINESS SET ASIDE
1. On behalf of the 99th Readiness Division (RD) the U.S. Army Contracting Command - New Jersey has one (1) new Construction Requirement:
CSS# 98480 - Vault Door Replacement Trenton, NJ (NJ016)
Description of Services: The Contractor shall provide all plant, labor, equipment, tools, materials, supervision, and transportation to accomplish the following work which consist of but is not limited to vault door replacement. All removal and installation requirements outlined within each SOW shall be performed. The North American Industry Classification System (NAICS) code that apply to the principal nature of these acquisitions: 236220 - Maintenance and Construction of Office Buildings - Size Standard of $45,000,000.
2. Period of Performance: If the required Period of Performance is not sufficient to complete all the required work and/or receive the proper materials, please propose the delivery schedule your company will be able to meet and provide a detailed explanation.
The current delivery schedule is mandatory, unless a proposed revision to the Delivery Schedule is accepted otherwise: CSS# 98480 - 240 Calendar Days after Notice to Proceed.

3. Disclosure of the Magnitude of Construction Projects (FAR 36.204): Advance notices and solicitations shall state the magnitude of the requirement in terms of physical characteristics and estimated price range. The estimated price is to be described in the terms of the following price range:

Site Visits: Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. 7. Technical Proposal: A brief narrative (technical) explaining how the job is going to be accomplished, is required. If subcontractors are being utilized, the subcontractor(s) name and information must be included in the proposal and the percentage of total subcontracting. The subcontractor tasks should be identified on the Contractor Cost Breakdown Form. Failure to provide this information could result in your proposal being considered non-responsive and ineligible for award. You must submit your bid guarantee with your proposal, or you will be considered non-responsive.
8. Price Proposal: The Contractor Cost Breakdown Form shall be completed and submitted.
9. A DETAILED PRICE PROPOSAL AND BRIEF TECHNICAL PROPOSAL FOR THE REQUIREMENT ARE TO BE SUBMITTED IN ACCORDANCE WITH THE SOLICITATION. Please submit your proposal via PIEE. Local Time is Eastern Standard Time. No other forms of delivery of proposal will be accepted or reviewed by the United States Government (USG) other than those delivered by the means expressed in the Request for Proposal (email delivery). Facsimile and mailed in proposals shall not be accepted.
The Procurement Integrated Enterprise Environment (PIEE) (https://piee.eb.mil) is the Department's core tool for facilitating full utilization of electronic processing of data and documents in the Procure-to-Pay environment. Within that environment, we developed the Solicitation Module to provide a capability for secure timestamped submission of contractor proposals for DOD contracting offices. The Solicitation Module enables posting of solicitations to a widespread or restricted audience. This includes the ability to post a draft or final solicitations, amendments, and attachments. Government users can designate either the entire solicitation or specific attachments as limited to use by specific companies. Contractors must submit their proposals via the portal and contracting personnel are then able to use the portal to distribute proposals to reviewers. 10. Basis of Award/Evaluation Criteria: Award will be made to the Offeror(s) who is deemed responsible and responsive in accordance with Federal Acquisition Regulation (FAR), whose proposal conforms to the solicitation requirements, and whose proposed price is considered lowest. The Government intends to award a contract without discussions (except for clarifications) but reserves the right to hold discussions if it is in the best interest of the Government.
Minimum Acceptability: If an Offeror takes exception to any of the terms and conditions of the solicitation, the offer may not be considered for award. All Offerors are urged to ensure that their initial proposals are submitted with the most favorable terms in order to reflect their best possible potential.
Each offeror must submit a technical capability proposal which addresses how the offeror will meet the requirements of the
Statement of Work to include meeting the proposed schedule outlined in the solicitation. Failure to provide this information will render your proposal unacceptable. If subcontractors are being utilized, the subcontractor(s) name and information must be included in the proposal and the percentage of total subcontracting. The subcontractor tasks should be identified on the Contractor Cost Breakdown Form. Failure to provide this information could result in your proposal being considered nonresponsive and ineligible for award.
Price: Price is lowest priced offer. Award may not be made to the lowest offeror if the capability statement is considered unacceptable.
The Government will award a single contract resulting from this Solicitation to the responsible, responsive offeror, whose proposal meets the specifications and requirements defined by the Specification of Work, and whose price is lowest. The Government intends to award without discussions but reserves the right to have discussions if in the best interest of the Government.

WILL BE EVALUATED BY THE GOVERNMENT. FAILURE TO IDENTIFY UNREALISTIC SCHEDULES IN YOUR PROPOSAL (DUE TO PRODUCT DELAYS, ETC) WILL NOT BE GROUNDS FOR A DELVIERY EXTENSION AFTER AWARD, WITHOUT CONSIDERATION OF AT LEAST $350.00 DEPENDING ON THE LENGTH OF DELAY**
11. REQUIRED BONDS
Alternative Payment Protection in the form of: A payment bond and, or an irrevocable letter of credit is required if the resultant Task Order(s) total value is over $35,000, Payment and Performance bonds are required if the resultant Task Order(s) total value is over $150,000. FAR 52.228-15 Performance and Payment Bonds-Construction (Jun 2020).
(a) Definitions. As used in this clause, original contract price means the award price of the contract; or, for requirements contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.
(b) Amount of required bonds. Unless the resulting contract price is valued at or below the threshold specified in Federal Acquisition Regulation 28.102-1(a) on the date of award of this contract, the successful offeror shall furnish performance and payment bonds to the Contracting Officer as follows:
(1) Performance bonds (Standard Form 25). The penal amount of performance bonds at the time of contract award shall be 100 percent of the original contract price.
(2) Payment Bonds (Standard Form 25A). The penal amount of payment bonds at the time of contract award shall be 100 percent of the original contract price.
(3) Additional bond protection.
(i) The Government may require additional performance and payment bond protection if the contract price is increased. The increase in protection generally will equal 100 percent of the increase in contract price.
(ii) The Government may secure the additional protection by directing the Contractor to increase the penal amount of the existing bond or to obtain an additional bond.
(c) Furnishing executed bonds. The Contractor shall furnish all executed bonds, including any necessary reinsurance agreements, to the Contracting Officer, within the time period specified in the Bid Guarantee provision of the solicitation, or otherwise specified by the Contracting Officer, but in any event, before starting work.
(d) Surety or other security for bonds. The bonds shall be in the form of firm commitment, supported by corporate sureties whose names appear on the list contained in Treasury Department Circular 570, individual sureties, or by other acceptable security such as postal money order, certified check, cashier's check, irrevocable letter of credit, or, in accordance with Treasury Department regulations, certain bonds or notes of the United States. Treasury Circular 570 is published in the Federal Register or may be obtained from the:

(e) Notice of subcontractor waiver of protection (40 U.S.C. 3133(c)). Any waiver of the right to sue on the payment bond is void unless it is in writing, signed by the person whose right is waived, and executed after such person has first furnished labor or material for use in the performance of the contract.
12. FAR 52.228-4000 REQUIRED INSURANCE (OCT 2010)
The Contractor shall provide, at time of proposal, the Certificate of Insurance (COI) via PIEE to the Contracting Officer and the Contract Specialist. The COI shall be updated and sent to the Contracting Officer and Specialist on an annual basis.

Contractor shall require the insurance company to specify contract number in the Description of Operation block of the Certificate of Insurance (COI) and the below statement.
"The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective - (1) For such a period as the laws of the State in which this contract is to be performed prescribe; or (2) Until 30 days after the Insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer." The primes insurance certificate must be provided with proposal to be considered for award.
13. FAR 52.232-18 Availability of Funds (APR 1984)
Funds are not presently available for this contract. The Government's obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.
14. FAR 52.211-13 - Time Extensions (SEPT 2000)
Time extensions for contract changes will depend upon the extent, if any, by which the changes cause delay in the completion of the various elements of construction. The change order granting the time extension may provide that the contract completion date will be extended only for those specific elements related to the changed work and that the remaining contract completion dates for all other portions of the work will not be altered. The change order also may provide an equitable readjustment of liquidated damages under the new completion schedule.

52.000-4002 LEVEL 1 ANTI TERRORIST AWARENESS TRAINING REQUIREMENTS FOR CONTRACTOR
EMPLOYEES (OCT 2010)
1. All contractor employees requiring access to any Federally controlled facility and logical access to Federally controlled information systems except for "national security systems" as defined by 44 U.S.C. 3542(b)(2), should be certified in Level 1 Anti-Terrorism Training. The training is accessible from any computer with access to the World Wide Web and is available at https:/atlevel1.dtic.mil/at. The contractor is responsible for ensuring that the training has been satisfactorily completed and that valid certificates of completion have been submitted to the Contracting Officers Representative (COR) with a copy furnished to the Contracting Officer. The Certificates are valid for one year; therefore, training shall be completed every year for the duration of the contract.
2. The term Federally controlled facility is defined as: Federally owned buildings or leased space, whether for single or multi-tenant occupancy, and approaches, all or any portion of which is under the jurisdiction, custody or control of a department or agency; Federally controlled commercial space shared with non-government tenants. For example, if a department or agency leased the 10th floor of a commercial building, the Directive applies to the 10th floor only; Government- owned, contractor-operated facilities, including laboratories engaged in national defense research and production activities; and Facilities under a management and operating contract, such as for the operation, maintenance, or support of a Government-owned or Government-controlled research, development, special production, or testing establishment.
3. The term "Federally controlled information system" means an information system (44 U.S.C.3502(8)) used or operated by a federal agency, or a contractor or other organization on behalf of the agency (44 U.S.C. 3544(a)).

"The policies evidencing required insurance shall contain an endorsement to the effect that any cancellation or any material change adversely affecting the Government's interest shall not be effective - (1) For such a period as the laws of the State in which this contract is to be performed prescribe; or (2) Until 30 days after the Insurer or the Contractor gives written notice to the Contracting Officer, whichever period is longer."

(a) Payment of price. The Government shall pay the Contractor the contract price as provided in this contract.
(b) Progress payments. The Government shall make progress payments monthly as the work proceeds, or at more frequent intervals as determined by the Contracting Officer, on estimates of work accomplished which meets the standards of quality established under the contract, as approved by the Contracting Officer.
(1) The Contractor's request for progress payments shall include the following substantiation:
(i) An itemization of the amounts requested, related to the various elements of work required by the contract covered by the payment requested.
(ii) A listing of the amount included for work performed by each subcontractor under the contract.
(iii) A listing of the total amount of each subcontract under the contract.
(iv) A listing of the amounts previously paid to each such subcontractor under the contract.
(v) Additional supporting data in a form and detail required by the Contracting Officer.
(2) In the preparation of estimates, the Contracting Officer may authorize material delivered on the site and preparatory work done to be taken into consideration. Material delivered to the Contractor at locations other than the site also may be taken into consideration if-
(i) Consideration is specifically authorized by this contract; and
(ii) The Contractor furnishes satisfactory evidence that it has acquired title to such material and that the material will be used to perform this contract.
(c) Contractor certification. Along with each request for progress payments, the Contractor shall furnish the following certification, or payment shall not be made: (However, if the Contractor elects to delete paragraph (c)(4) from the certification, the certification is still acceptable.)
