Description/specifications/work statement
Statement of Work
Consultancy to Evaluate CORAH Special Project’s Transition to Official Government Institution
Background
On September 26, 1981, Peru and the United States signed the "Cooperative Project Agreement for the Control and Reduction of Coca Cultivation in the Upper Huallaga," which led to the establishment of the "Control and Reduction of Coca Cultivation in the Upper Huallaga" project
(Special Project CORAH) on April 22, 1982. CORAH's primary objective is to reduce illegal coca cultivation across the country. It operates under a unique legal framework based on the 1981
Agreement and the "Operational agreement between the governments of Peru and the United States for the Drug Control Project." CORAH currently reports to the General Directorate Against
Organized Crime (DGCO) within the Ministry of the Interior.
Funding and Cooperation Mechanism
Initially, CORAH was fully funded by the United States government through the Office of
International Narcotics and Law Enforcement (INL). In 2013, the National Commission for
Development and Life without Drugs (DEVIDA) started funding CORAH. INL’s contributions were reduced to cover only administrative expenses, personnel salaries, and others when DEVIDA funds are insufficient.
DEVIDA funds CORAH via diplomatic notes produced by the U.S. Embassy in Peru (via INL) per the Annual Plan for the Reduction of Illegal Coca Cultivation, approved by the Minister of the
Interior. INL transfers those funds to CORAH.
The objective of the Contract
INL seeks to hire a specialized consultancy firm to support the transition of CORAH to an official
Peruvian government, adhering to all regulations, particularly as related to administration and financing.
Scope of Consultancy
The selected consultant(s) must work closely with the government entities in the multisectoral team overseeing this transition, including the Ministry of the Interior (DGCO), DEVIDA, the Ministry of
Economy and Finance, and the Ministry of Defense.
Key Consultancy Areas
1. Development of a Detailed Transition Plan to State Administration:
• Develop a comprehensive strategic plan covering the most appropriate administrative framework for managing an eradication process. The plan should address all aspects of the transition, including regulatory compliance, adaptation to the Peruvian state's administrative systems, human resource management, procurement processes, and the implementation of execution monitoring systems.
2. Regulatory Compliance and Legal Analysis:
• Conduct an exhaustive analysis of the legal and regulatory framework(s) governing the operation and functions of the most appropriate administrative framework for managing the eradication process. Identify areas of non-compliance with the systems regulated by Law
No. 29158, Organic Law of the Executive Power, in its article 46 on Administrative Systems of Modernization of Public Management within CORAH and propose necessary measures for bringing them into alignment with current legislation.
Solicitation 19PE5024Q0080 Page 4 of 57
3. Adaptation to the Administrative Systems of the Peruvian state:
• Evaluate CORAH's current administrative systems and identify areas that need to be improved to align with the standards and management models established for the most appropriate administrative framework for managing the eradication process. Design the necessary modifications to ensure efficiency, transparency, and internal control.
4. Identification of Challenges and Transition Strategies:
• Perform a thorough analysis of potential challenges and obstacles that could arise during the transition process, including resistance to change, regulatory complexity, and resource limitations. Develop strategies and action plans to mitigate these risks and ensure a successful transfer to the Peruvian state's institutional framework.
5. Identification of Unaddressed Administrative Processes:
• Identify and document administrative processes currently managed by CORAH that are not covered by Peruvian State's management systems. Analyze these processes to determine their compatibility with governmental standards and propose strategies for integration or adaptation.
6. Adaptation to the Execution Monitoring Systems:
• Evaluate the feasibility of integrating CORAH into the Peruvian state's execution monitoring systems, State Management Information System (SIGA) and Integrated Financial
Administration System (SIAF), considering CORAH's current administrative processes.
Analyze alternatives to ensure efficiency, transparency, and proper management of public resources.
7. Development of Provisional Staffing Allocation (CAP) and Job Classification Manual (MCC):
• Review and formulate staffing allocation tables and the Job Classification Manual based on the regulations and guidelines of the National Civil Service Authority (SERVIR) to optimize human resource management and ensure legal compliance.
8. Evaluation of Staffing and Human Resources:
• Analyze CORAH staffing, including seniority, social benefits, and acquired rights. Evaluate the economic and legal impact of the transition to the new labor regime (SERVIR) and identify potential points of conflict with the Single Union of CORAH Workers
(SUTCORAH), developing strategies to address them effectively.
9. Identification of Requirements and Procurement Processes:
• Review and analyze the requirements for goods and services, as well as CORAH's current procurement processes, considering the regulations established by the Peruvian State for the acquisition of goods and services through the State Procurement Electronic System
(SEACE) and the Public Procurement Center (PERU COMPRAS). Evaluate the possibility of adapting procurement processes to SEACE and PERU COMPRAS, proposing alternatives within the framework of Peruvian legislation.
Reports
The reports must be issued in electronic format (word and PDF) in both Spanish and English.

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2) (i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
