(NOV 2021)
The award basis will be based on the quote being determined Lowest Priced, Technically Acceptable. The Government intends to award a single fixed-price purchase order to satisfy this requirement. The Government reserves the right to award no agreement at all, depending on the quality of offers submitted.
The Government intends to evaluate the quote and award without discussions with the vendor. The vendor should expect requests for clarification or additional information from the Government, as needed. Award will be based on the initial evaluation of the quote received in response to the solicitation. Therefore, the vendor is cautioned that their initial quote should contain their best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions with the vendor if later determined by the Contracting Officer to be necessary. The Government may reject the quote if such action is in the public interest; and may waive informalities and minor irregularities in the quote received.
A written notice of award or acceptance of an offer mailed or otherwise furnished to the Quoter within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
