Addendum to 52.212-1, Instructions to Offerors - Commercial Products and Commercial Services

1. QUOTE SUBMISSION REQUIREMENTS

To ensure timely delivery and mitigate trans-Pacific supply chain risks, the Government requires verifiable proof that the Quoter has immediate, guaranteed access to the requested equipment physically located on-island. Quotes shall be submitted in two distinct parts:

Part I: Price Quote Part II: Technical Conformance (Proof of On-Island Equipment Availability)

2. PROOF OF ON-ISLAND EQUIPMENT AVAILABILITY (MANDATORY)

The required forklift must physically reside on the island of Oahu at the time of quote submission. The Government will not accept quotes that rely on mainland-to-island transit post-award due to the critical nature of the delivery window.

Quoters must submit affirmative evidence of local equipment availability for the specific dates outlined in the Performance Work Statement and solicitation. Failure to provide this evidence will result in the quote being deemed non-conforming, and it will be excluded from further consideration.

Acceptable evidence is defined strictly as one of the following:

Option A (For Quoters utilizing Owned Local Inventory): A signed statement on company letterhead identifying the exact Make, Model, Year, and Serial Number/VIN of the forklift to be delivered from their existing owned fleet physically located on Oahu.

Option B (For Quoters utilizing a Local Subcontractor/Rental Supplier): A formal, binding document from a local, on-island third-party equipment supplier. This document must be a signed quote, confirmed reservation receipt, or Letter of Commitment explicitly stating the required forklift make/model is reserved for the Quoter for the exact Period of Performance. A general capability statement, mainland reservation, or a screenshot of a supplier's public catalog is NOT acceptable.

3. WARNING REGARDING DELAYS

Quoters are advised that reliance on a subcontractor or third-party rental agency does not relieve the Prime Contractor of their delivery obligations.

Furthermore, the Contractor is solely responsible for all local transport and delivery logistics to the Government facility. Delays resulting from subcontractor unavailability, port congestion, or inter-island barge schedules are not excusable delays under FAR 52.212-4(f). Failure to deliver on time may result in immediate Termination for Cause under FAR 52.212-4(m).

4. CYBERSECURITY MATURITY MODEL CERTIFICATION (CMMC) REQUIREMENT

DFARS clause 252.204-7021 and DFARS provision 252.204-7025 related to Cybersecurity Maturity Model Certification (CMMC) requirements are included in the solicitation involving Federal Contract Information (FCI) or Controlled Unclassified Information (CUI), on unclassified information systems, effective November 10, 2025. Offerors must possess a valid CMMC Level 1 (Self-Assessment) certification at the time of award and for the duration of any resulting contract. The Government will verify the Offeror's CMMC Level 1 (Self-Assessment) certification at the time of award.

Offerors failing to meet this requirement at the time of award will be deemed ineligible for award.

5. Offer delivery - Offerors shall deliver their Offer via email only to the Government Points of Contacts (POCs) jodie.l.tramuto.civ@us.navy.mil and lyndon.g.paloma.civ@us.navy.mil. No other means of delivery will be accepted. Offerors are hereby advised that the size limit, including attachments, is 35 MB per email. Emails that exceed this size limit will not be received by the Government. It is the Offeror's sole responsibility to ensure their Offer is received by the Government POCs no later than the specified closing date and time. When necessary to comply with this size limit, the Offeror may deliver their Offer through multiple emails, with each email clearly marked in the Subject Line indicating its sequence order within the total number of emails being transmitted (for example, email 1 of 3). Offers received after the due date may not be considered unless the Contracting Officer determines that the delay was caused solely by the Government and accepting the Offer is in the best interest of the Government.
