Evaluation Factors for Award

FAR Clauses Incorporated by Full Text

52.212-2 Evaluation-Commercial Products and Commercial Services. (Feb 2026)

Evaluation-Commercial Products and Commercial Services (Feb 2026)

(a) Evaluation factors.

Basis for Award: Award of this requirement will be made on a competitive best value basis, using "best value tradeoff" among price and non- price factors. A best value tradeoff process will be used; thus, the Government may elect to award to other than the lowest priced Offeror, or other than the Offeror with the highest rated non- price proposal. Past performance will be evaluated independently from the other non- price evaluation factors using different standards identified herein.

The evaluation factors are:

FACTOR 1: Technical Approach FACTOR 2: Past Performance FACTOR 3: Price

Factors 1-3 are listed in descending order of importance. The non-price factors (Factors 1-2) when combined, are more important than the Price quote (Factor 3).

As the collective non-price factors begin to reach equality in the technical evaluation, price becomes a more important factor in the tradeoff analysis.

Evaluation Factor's I and II will be evaluated on an individual basis. Evaluation Factor III: Price, is not rated or scored.

Offerors shall receive a minimum rating of Acceptable for Evaluation Factor I and Evaluation Factor II and Evaluation Factor III shall be determined to be complete / fair and reasonable, in order for an offeror to be eligible for award.

If after evaluating any individual factor, the offeror's proposal does not achieve the minimum required rating to be eligible for award, the Government may cease evaluation of the proposal all together.

Relative Importance of Factors: The factors are listed above in descending order of importance. As the range of technical merit narrows, price becomes a more important factor.

The Government intends to evaluate the proposal and award a contract without exchanges with the Offeror. The Government reserves the right to conduct exchanges, if the Contracting Officer later determines them to be necessary.

All Offerors initial quote should contain the Offeror's best terms from a technical and price standpoint. Government evaluators will not assume that the Offeror possesses any capability or knowledge unless it is specified in the quote.

Evaluation Factor I: Technical Approach

Offeror will be evaluated on its ability to demonstrate understanding of and capability to meet all of the requirements of the solicitation and PWS. The offeror's performance approach will be evaluated on its feasibility, its comprehensiveness, and the degree to which the offeror demonstrates how the requirements identified in the PWS will be successfully accomplished.

The Offeror's quote will also be evaluated for completeness to determine that the offeror has completed and provided the required provisions and provided a statement confirming that they are registered in SAM, the SAM registration is current and that the offeror is listed under the applicable NAICS code.

Ratings for Evaluation Factor I: Technical Approach

Rating Description

Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

Evaluation Factor II: Past Performance: The Past Performance evaluation will result in an assessment of the offeror's probability of meeting the solicitation requirements.

The Government reserves the right to utilize other information not provided by the vendor and will evaluate information readily available. It is the responsibility of the offeror to ensure names and phone numbers of points of contact are verified and accurate.

The Government will evaluate past performance for:

-Recency-Contracts cited have not ended more than three years prior to the closing date of the solicitation.

-Relevancy- Present/past performance effort involved a similar scope, magnitude of effort and complexity as this solicitation requires. Relevancy determinations will be made solely off the offeror's proposal. The Government will not call POCs or access databases to determine relevancy. The Offeror is responsible to ensure that a relevancy determination can be made from the information in the offerors proposal.

If a reference contract is determined to be "not recent and relevant" (after review of the offeror's proposal), then the reference contract will not be evaluated further.

Past performance will be evaluated on an Acceptable / Unacceptable (Pass / Fail)basis, unless the offeror possess no relevant past performance.

In the case of an offeror without a record of relevant past performance or for whom information on past performance.

is not available, the offeror will not be evaluated favorably or unfavorably on past performance. The offeror will receive a neutral rating. In the context of acceptability /unacceptability "unknown" shall be considered "acceptable".

Evaluation Factor III - Price.

Price will be evaluated on completeness and reasonableness. Price is not rated or scored.

Completeness- The offeror shall include pricing for all line items, as stated in the RFQ.

Reasonableness- The degree to which the offeror's total proposed price represents a fair and reasonable price. The offeror's total proposed price will be used to evaluate price reasonableness.

Offeror's total proposed price shall be determined to be complete and reasonable in order for the offeror to be eligible for award.

(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Options Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall Notice of award result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
