Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. (f) If the Offeror selects "is" in paragraph (d)(1) and "partial or no exemption" in paragraph (d)(2) of this provision, the Offeror will be subject to withholding in accordance with the clause at FAR 52.229-12, Tax on Certain Foreign Procurements, in any resulting contract.

(g) A taxpayer may, for a fee, seek advice from the IRS as to the proper tax treatment of a transaction. This is called a private letter ruling. Also, the IRS may publish a revenue ruling, which is an official interpretation by the IRS of the Internal Revenue Code, related statutes, tax treaties, and regulations. A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. Evaluation Factors for Award 52.212-2 ADDENDUM - EVALUATION - COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

Basis for Contract Award:

(a) Addendum to Paragraph (a). Paragraph (a) is changed to read as follows:

The Government will evaluate each quote and award to the Offeror with the Lowest Priced Technically Acceptable offer using procedures in RFO FAR Part 12.203 and 12.204. The Government anticipates awarding one (1) Firm-Fixed Price (FFP), purchase order contract to the Offeror whose quote, conforming to all the requirements of the solicitation, is the lowest priced quote and technically acceptable.

The Government reserves the right to not consider for award, quotes that do not adhere to the administrative requirements outlined in Addendum FAR 52.212-1 (Instruction to Offerors). Additionally, the potential awardee must be determined responsible in accordance with FAR Subpart 9.104-1. By submission of its quote, the Offeror agrees to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in a quote being determined unacceptable for award. The Government may, in its discretion, conduct exchanges and clarifications with Offerors if exchanges are determined to be in the Government's best interest.

Award Decision: The award decision will be made based on the following procedure:

Step One: The Government will start with the lowest-priced offeror that has submitted a complete offer and complied with the quote submission requirements of the solicitation.

Step Two: The Government shall then evaluate the technical volume of the quote received by the required date/time.

The technical capability factor will receive an overall rating of acceptable, or unacceptable. If any non-priced factor is rated "unacceptable," the entire quote is rendered technically unacceptable, and the quote will be removed from further consideration. Technical acceptability for the award is determined by an Offeror obtaining a rating of" Acceptable" for Factor I, Technical Capability.

Based on the preceding, the Government reserves the right to proceed to award once it identifies the lowest priced offer that is "acceptable" for the non-price factors and otherwise meets the requirements of the solicitation without evaluating higher priced offers. In short, not all offers will be evaluated if the Government has identified the lowest-priced offer that has an overall rating of acceptable for the technical capability factor.

The overall evaluation criteria for this solicitation are as follows:

1. Factor 1-Price

2. Factor 2-Technical Capability

Subfactor 1- Kitchen Oven Equipment Specifications Subfactor 2- Delivery Date: in accordance with the RFQ required date.

Factor 1: Price-This factor will not be assigned a rating. However, the Offeror's quote will be evaluated to determine if the price offered is the Lowest Priced Technically Acceptable.

Factor 2: Technical Capability.

Subfactor 1- Equipment: The Government will evaluate the Offeror's response to factor 1 (Technical Capability), as identified in FAR 52.212-1 Addendum and detailed in Attachment 1- Specifications, to determine whether the Offeror's quote clearly demonstrates its capability to meet or exceed the requirement.

Subfactor 2- Delivery Date: The Government will evaluate the Offeror's response to the required delivery date for the kitchen equipment.

For a quote to be determined technically acceptable, all proposed items shall meet or exceed the minimum specifications and requirements set forth in the solicitation. The technical submissions will be rated as either "Acceptable" or "Unacceptable" as defined in the Adjectival Rating below. If an Offeror's technical submission is determined to be "Unacceptable," the technical quote will no longer be evaluated or considered for award.

Factor 2 will be rated in accordance with the following Adjectival Rating:

Overall Requirement for Technical Capability Rating-

Description: Acceptable- Offeror's quote clearly meets the requirements of the solicitation.

Unacceptable- Offeror's quote does not meet the requirements of the solicitation.
