Evaluation Factors for Award

52.212-2 Evaluation - Commercial Items (Deviation Date) (Addendum)

(a) The Government will award a purchase order resulting from this solicitation to the responsible vendor whose offer/quote conforming to the solicitation will be most advantageous to the Government; price and other factors considered. The following factors shall be used to evaluate offers/quotes:

1. Basis for Award:

The Award will be conducted and evaluated under the provisions of FAR Part 12, Commercial Items. This acquisition will utilize price as the only evaluated factor. Technical tradeoffs will not be made, and no additional credit will be given for exceeding the requirements of the solicitation. Award will be made to the acceptable vendor with the lowest evaluated cost or price, which is deemed responsible in accordance with the Federal Acquisition Regulation and whose offer/quote meets all of the solicitation requirements. The solicitation requirements include all stated terms, conditions, representations, certifications, and Equipment List and all other information required by

FAR 52.212-1 of this solicitation. Vendor must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The

Government reserves the right to determine any such exceptions unacceptable, and the quotation, therefore, ineligible for award. The Government intends to make the award without interchanges. However, the Government reserves the right to conduct interchanges with the vendors if determined necessary by the Contracting Officer.

The vendor must be registered in the System for Award Management (SAM) database (available at:https://www.sam.gov/portal/public/SAM/) and submit a completed copy of the Offeror Representations and Certifications - Commercial Items with their response. Lack of active registration in SAM will disqualify the vendor and result in them being ineligible for award.

The Oklahoma City Air Logistics Center (AFSC/PZIMB) at Tinker Air Force Base Oklahoma intends to issue a commercial firm fixed-priced contract for this acquisition.

2. Number of Contracts to be awarded:

The Government intends to select one vendor for contract award. However, the Government reserves the right to award no contract at all; depending on the quality of the offers/quotes, prices submitted, the availability of funds, or other factors identified by the Contracting Officer.

3. Rejection of Unreasonable Offers/Quotes:

The Government may reject any offer/quote that is determined to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low in cost/price when compared to Government estimates; such that the offer/quote is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program, item, or service.

4. Correction Potential of Offers/Quotes:

The Government will consider, throughout the evaluation, the "correction potential" of any offer/quote uncertainty. The judgment of such "correction potential" is within the sole discretion of the Government. If any aspect of a vendor's offer/quote not meeting the Government's requirements is considered not correctable, the vendor may be eliminated from the competition.

5. Evaluation Factors

a. Factor 1 -- Price

The Government will evaluate the quote against the requirements stated in the solicitation and the Performance Work Statement/Equipment List. Price of all CLINs and total contract price must include all shipping and transportation costs FOB Destination: Tinker AFB. Offerors are required to present all the information as stated in the

Instructions to Offerors, FAR 52.212-1 and in this solicitation. Should all three (3) of the lowest priced offers/quotes be found incomplete/nonresponsive, the next one (1) lowest priced offer/quote will be evaluated until an acceptable offer/quote is determined. Once offers/quotes are determined complete/responsive, then price will be evaluated and the lowest priced offer/quote will be selected for award, either initially or as a result of interchanges.

i) Price Reasonableness - The proposed prices will be evaluated for reasonableness. Reasonableness must represent a price to the Government a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through adequate price competition, but may also be determined through price analysis techniques as described in FAR 13.106-3(a)(2).

ii) Price Realism - The Government intends to determine price realism based on adequate price competition. In the event the Government cannot determine price realism based on adequate price competition, the Government reserves the right to conduct a more detailed price realism evaluation using one or more of the price analysis techniques described in FAR 13.106-3(a)(2). The Government may also use other evaluation techniques, as needed. To be realistic, the proposed price must demonstrate an adequate understanding of the requirement. Quoted prices that are determined to be unrealistically low due to an inadequate understanding of the requirement will make the quotation ineligible for award.

iii) Unbalanced Pricing - Vendors' quotation will be reviewed for unbalanced pricing. The Government will evaluate any supporting information provided by the vendor explaining variances that appear unbalanced. Evaluated quotes that are determined to be unbalanced may be deemed ineligible for award by the https://www.sam.gov/portal/public/SAM/)

Contracting Officer if a determination is made that lack of balance poses an unacceptable risk to the Government. Unbalanced pricing exists when, despite an acceptable total price, the price of one or more line items(including sub line items) is significantly over or understated as demonstrated by application of price analysis techniques, such that:

a) There is reasonable doubt the quote would result in the lowest overall cost to the Government, even though it is the lowest priced quote; or

b) The quote is so grossly unbalanced; its acceptance would be tantamount to allowing an advanced payment.

iv) Total Evaluated Price (TEP) - The TEP will be calculated as the sum of the total proposed prices for all separately priced line items (including sub line items). The total proposed price for each separately priced line item shall be calculated as the proposed unit price multiplied by the corresponding quantity.

The TEP will be used for evaluation purposes only.

The TEP will be calculated as the sum of the vendor's proposed prices for the base period.

6. Determination of Contractor Responsibility

To be eligible for award, a vendor must be determined responsible. A Determination of Contractor Responsibility will be conducted in accordance with FAR 9.1 (SAM and

FAPIIS). A vendor who receives a determination of non-responsible will not be eligible to receive the award.

7. Interchanges:

It is the Government's intent to award without interchanges; therefore, it is imperative that the vendor submit their best terms initially. However, if during the evaluation period; itis determined to be in the best interest of the Government to hold interchanges, those interchanges will be considered in making the award decision. The

Government my conduct interchanges with the vendors. The determination to conduct interchanges and with whom to conduct interchanges is at the sole discretion of the

Government.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

[Insert evaluation factors in the relative order of importance. For requests for proposals, state: Evaluation factors other than price when combined are [significantly more important than price/approximately equal to price/significantly less important] than price. For invitations for bids, list only price and price-related factors.] price technical acceptability

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The

Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
