BASIS FOR AWARD - Addendum to FAR Clause 52.212-2, Evaluation - Commercial Items
1. Award will be made in accordance with the basic contract ordering procedures, FAR Part 12, the procedures specified in the Request for Quote, and on the basis of the lowest priced proposal that is technically acceptable. A contract may be awarded to the contractor who is deemed responsible IAW FAR 9.1, as supplemented, whose proposal conforms to the Request for Quote requirements (to include all stated terms, conditions, representations, certifications, and all other information required by the RFQ instructions) and is judged to represent a technically acceptable proposal with the lowest complete and reasonable price.
2. First, the Government will rank the proposals which conform to the RFQ's requirements from lowest price to highest price.
3. Next, the Government will evaluate the lowest priced offeror for technical acceptability as follows:
Technically Acceptable - Proposal meets all requirements of this RFQ and attachments.
Technically Unacceptable - Proposal does not meet all requirements of this RFQ and its attachments.
4. If the proposal with the lowest price is determined to be technically acceptable, the Government will evaluate the offeror's total aggregate price for completeness, reasonableness, and unbalanced pricing. Any offeror whose price is determined to be incomplete, unreasonable, or unbalanced will not be considered for award.
5. Definitions for completeness and reasonableness are defined below.
a. If the lowest priced proposal is technically acceptable and the price is complete and reasonable, then that offeror's proposal represents the best value to the Government and award will be made to that offeror. If the lowest priced proposal is not technically acceptable, the Government will consider the correction potential and may enter into interchanges with that offeror. If, after interchanges with that offeror, their proposal is technically acceptable and remains the lowest priced, a contract will be awarded to that offeror. If the Government deems the proposal not easily correctable, or if at any time it becomes other than the lowest priced proposal, the next lowest priced proposal will be evaluated for technical acceptability, followed by an analysis of their price to verify reasonableness and completeness. Interchanges will take place as necessary or deemed appropriate by the Government. This evaluation process will be repeated until reaching the lowest price technically acceptable quotation or until all quotes are evaluated. In order to determine price fair and reasonable, the evaluation process may continue until reaching two technically acceptable quotes (to establish adequate price competition).
6. Failure to provide the requested information may deem the proposal unacceptable and may not be eligible for award.
