Evaluation Factors for Award
FAR Clauses Incorporated by Full Text
52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation) (Feb 2026)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
(i) Price
(ii) Technical Acceptability
Award will be made on a lowest-priced, technically acceptable basis. There will be no trade-offs between price and non-price factors.
: Basis for Contract Award
The Government intends to award a firm-fixed-price contract to the responsible offeror who submits the lowest-priced, technically acceptable offer. The evaluation process will proceed as follows:
(i) Price Evaluation: Initial Ranking by Price. All offers will first be ranked in order of price, from the lowest evaluated price to the highest.
(ii) Technical Evaluation: The Government will then evaluate the lowest-priced offer to determine if it is technically acceptable. An offer is technically acceptable if it clearly demonstrates the ability to meet the minimum requirements of the solicitation and conforms to the solicited statement of work. The Government will assign one of the following ratings:
Rating Description
Acceptable The proposal clearly meets the minimum requirements of the solicitation and demonstrates the ability to conform to the solicited statement of work.
Unacceptable The proposal does not clearly meet the minimum requirements of the solicitation and fails to demonstrate the ability to conform to the solicited statement of work.
If the lowest-priced offer is determined to be technically acceptable, it will be considered the best value to the Government, and the evaluation will proceed no further. The award will be made to that offeror without evaluating other offers. If the lowest-priced offer is determined to be technically unacceptable, it will be rejected. The Government will then evaluate the next-lowest priced offer for technical acceptability. This process will continue until a technically acceptable offer is identified for award. An offer must be rated "Acceptable" to be eligible for award.
(b) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
