Special Contract Requirements

Contract Clauses RFO Ombudsman

An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.

Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).

If resolution cannot be made by the contracting officer, the interested party may contact the ombudsman. The primary AFICC Ombudsman supporting AFSOC is the:

Director of Contracting, AFICC/KO (OL-SOC), 427 Cody Avenue (Bldg. 90333), Hurlburt Field, FL 32544,

(850) 884- 3990, DSN: 579-3990, Email: AFIMSC.AFICC_KO.Workflow@us.af.mil.

The alternate AFICC Ombudsman supporting AFSOC is the:

Technical Director, AFICC/KO (OL-SOC), 427 Cody Avenue (Bldg. 90333), Hurlburt Field, FL 32544,

(850) 884-2022, DSN: 579-2022, Email: AFIMSC.AFICC_KO.Workflow@us.af.mil.

As a matter of procedure, once the Ombudsman has been contacted, he/she will issue a notification to the contracting unit stating the Ombudsman has been contacted and the unit shall not take further action on the matter in question (i.e., acquisition) without coordination with the Ombudsman.

The ombudsman has no authority to render a decision that binds the agency.

Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the contracting officer.

Evaluation Factors for Award

1. Basis for Award

The Government intends to award a single Firm-fixed-price Blanket Purchase Agreement (BPA) resulting from this solicitation to the responsible offeror whose quote, conforming to the solicitation, will be most advantageous to the Government, in terms of price and technical acceptability. The resulting BPA will be for five (5) years, from the date of award. The maximum value of this BPA is $100,000.00, with a limit of $25,000.00 per individual order (call). If awarded a BPA, your firm will receive a list of authorized Government personnel, by position, who are permitted to place orders against the agreement. It is the firm's responsibility to verify the caller's authorization before fulfilling any order. The Government will only be obligated for orders placed by authorized personnel. In the case that a single call exceeds $25,000.00, the Contracting Officer reserves the right to place a task order for the service off of the anticipated BPA.

Only the Contracting Officer has this right.

The evaluation will be conducted using Lowest Price Technically Acceptable (LPTA) procedures. Award will be made to the lowest price offer that meets the acceptability standards for price and technical factors.

2. Evaluation Factors

The following factors shall be used to evaluate offers:

Price Technical Acceptability

Factor 1: Price

Price reasonableness will be determined by adequate price competition.

Factor 2: Technical Acceptability

The Government will evaluate the Technical Quote on a pass/fail basis. To be determined technically acceptable, the offeror must clearly demonstrate compliance with the SOW requirements.

Rating Methodology:

Acceptable: Quote clearly meets the minimum requirements of the solicitation and SOW.

Unacceptable: Quote does not clearly meet the minimum requirements of the solicitation and SOW.

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

[Insert evaluation factors in the relative order of importance. For requests for proposals, state: Evaluation factors other than price when combined are [significantly more important than price/approximately equal to price/significantly less important] than price. For invitations for bids, list only price and price-related factors.]

Technical Evaluation

Price

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
