1.0 INTRODUCTION

1.1 The purpose of this project is to repair by replacement portions of the existing Airfield Security Fence, A.K.

A. "South Deer Fence" in the clear zone area of the airfield at Laughlin Air Force Base (LAFB). The existing fence is comprised of wooden and metal posts with areas having metal hog wire, chain link fencing fabric and barbed wire. The total length of the fence is approximately 8,440 linear feet (L.F.) with a swale feature, one (1) existing gate for vehicle access and one (1) existing gate for pedestrian access. The intention of this fence is to prohibit deer, rabbits, hogs, and other animals from accessing the airfield pavements. In its current state, the fence does not reduce the airfield incursions by terrestrial wildlife. The Contractor will replace the areas of fencing identified, retrofit existing gates, improve existing fencing areas, and improve the fencing at the swale as identified in this Statement of Work (SOW).

1.2 Within the below documents, the following shall be consistent. When "the Government" is mentioned, it is a representation of, but is not limited to, the following: the Project Manager (PM), and the Contracting Officer (CO). When "the Contractor" is mentioned, it is a representation of: the prime Contractor, all sub-Contractors, and all other parties working with/for the prime Contractor.

2.0 DESCRIPTION OF WORK

2.1 The work under this contract shall consist of furnishing all labor, materials, tools, equipment, transportation, and all other incidentals necessary to complete the work outlined within this SOW and drawings.

2.2 The work shall consist of, but is not limited to, demolition of fence as identified, removal of existing fence posts that are less than 8'-0" in height as identified in Attachment I, Drawings, provide a design for the new fence, and install the new fence no less than 9'-0" in height as outlined in Attachment I, Drawings. Contractor shall provide shop level drawings, product data, and other submittals as outlined in Attachment F, Schedule of Material Submittals for Government approval based on the description of work. Contractor is also responsible for the preparation of grounds and installation of speed bumps under the existing gates as identified in this SOW and Attachment I, Drawings. 2.3 The Contractor shall remove fence/gate posts and replace as identified in Attachment I, Drawings with new gate posts and twin line post with structural members.

2.4 During construction, openings in the fence cannot be left unattended. The Contractor shall leave the fence identified for demolition intact until the new fence has been installed and approved by the CO.

2.5 Temporary fencing shall be required for any openings in the fence while the Contractor is not actively working in the area and approved by the CO to have the capability to deter terrestrial wildlife.

2.6 The Contractor shall be responsible for temporary removal and replacement of existing concrete traffic barriers in order to complete the SOW, if present.

2.7 The Contractor shall repair or replace roadways that were damaged as a result of Contractor negligence.

2.8 The Contractor shall be responsible to contact LAFB United States Department of Agriculture (USDA) representative and Wing Safety to report terrestrial critters trespassing onto the airfield through sections of the fence under construction by the Contractor. USDA telephone number is (830)238-2362 and the Wing Safety telephone number is (830) 298-5975.

9.1 The Contractors are urged to attend a pre-proposal site visit to determine the actual quantities required for the work identified in the SOW and to determine in-place conditions that shall affect the quantities in the delivery order.

9.2 All personnel that will be driving to and from the project site during construction will need to attend an Airfield Driver Training Class. This training is approximately one (1) hour and shall consist of a PowerPoint presentation and a familiarization ride. The date and time of the training shall be coordinated through the Contracting Officer but shall occur during normal business hours. The Contractor shall make every effort have all drivers present at the same time as the number of trainings shall be kept to a minimum. If the Contractor intends to use heavy equipment when working within the airfield perimeter fence, they will have to file a Request For Airfield and Airspace Criteria Waiver through the CO.

9.3 The work may require the Contractor to be on Laughlin's airfield. If so, the Contractor shall submit Attachment C, FAA Form 7460-01. For information on the purpose of this form and instructions on how to fill it out, refer to Attachment D, Division 01 Specifications, Section 14.

9.4 There are various signs on the fence and gates. The Contractor shall be responsible for removing, properly storing to prevent damage, and re-installing the signs.

9.5 Controlled Area Signs: Spacing for 30-inches x 36-inches Controlled Area Signs along entire fence line shall not exceed 100-feet 0-inches between signs. Signs shall be mounted with wire ties as specified in Attachment H, UFGS 32 31 13.53 High Security Fences and Gate, November 2021, section 2.2.1.1 Wire Ties.

Contractor shall provide at this meeting to updated the current construction schedule, progress schedules, and provide weather delay information as it occurs. The Contractor is responsible for providing meeting minutes to the CO. The Contractor shall complete Environmental Management System Awareness training by reviewing Attachment B, Appendix B of the Environmental Construction Technical Specifications.

9.8 All work on this project shall be accomplished in accordance with the general Attachment D, Division 01 Specifications, Attachment B, Environmental Construction Technical Specifications, applicable Air Force, federal, state, and local regulations/codes referenced in cited sources.

9.9 Photos of existing conditions can be found in Attachment A, Existing photographs.

9.10 The Contractor shall remove and properly dispose of all project debris, wooden posts, and metal fence /accessories at an off-base location.

9.11 Remove all debris on a daily basis due to foreign object damage (FOD). Strictly monitor and control dust and debris due to its impact on aircraft safety. Failure to properly control dust and debris, or to respond to any requests to do so, will result in construction activities being stopped and an analysis and plan of action required of the Contractor to implement control of the FOD. Submit a FOD Control Plan prior to beginning work.

9.12 Areas touched by Contractor shall be left rock free (2 inches and larger) and disposed of off-base for project acceptance to ensure mowing and BASH requirements are followed.

9.13 The Contractor shall repair any damage to the property caused by the Contractor (including ruts) to match the surrounding area at no cost to the Government.

9.14 The Contractor may request a laydown yard from the CO. Laydown must be brought back to the original state.

9.15 Proper airfield fencing reduces airfield incursions by terrestrial wildlife. The best procedure for keeping large mammals off the airfield is an adequate fence. An 8-foot chain link fence with 3-strand barbed outriggers and secured at the ground will keep most mammals off the airfield. A 4-foot skirt of chain link fence material, attached to the bottom of the fence and buried at a 45 degree angle on the outside of the fence will prevent animals from digging underneath, while reducing washouts. Rebar offers a cost effective solution when patching gaps under a fence to prevent wildlife from entering the airfield. Heavy gravel may be used to armor fence bottoms. Repair fence breaches upon detection.

9.16 Remove vegetation on and along the fence line wherever noted. Maintain a buffer zone free from brushy and woody vegetation on both sides of the security fence where able. This practice will help maintain the integrity of the fence by allowing easier access for inspection and maintenance as well as discouraging the growth of woody vegetation on and through the fence. Contractor shall deliver the fence line with no vegetation along the fence line at final inspection.

9.17 Inspect all gates to ensure proper function. Replace or repair all damaged gates or gates that do not close as a result on Contractor damage per AFI 91-212 31 MAY 2018.

9.18 Re-install signs warning of wildlife hazards to flight operations to educate gate users if gates are routinely left unsecured.

9.19 Ensure fences do not violate the airfield clear zones and frangibility rules, in accordance with United Facilities Criteria 3-260-01, Airfield and Heliport Planning and Design.

9.20 The Contractor shall provide earthwork to clear new fence line. The area shall be 9-feet 0-inches wide and run the entire length of the new fence line which is approximately 8,440 L.F. Clearing shall not disturb existing gates and fence posts that shall remain. Finish grading of cleared fence line shall be void of rocks any larger than 2-inches and smooth.

9.21 Comply with the OSHA Public Law 91-596, Occupational Safety and Health Act of 1970 and the resulting standards (e.g., 29 CFR 1910, Occupational Safety and Health Standards, 29 CFR 1926, Safety and Health Regulations for Construction), national consensus standards of the United States (e.g., National Fire Protection Association and National Electrical Codes), and all applicable federal, state, local, and Department of Defense, environmental, safety, and occupational health statues, policies, and regulations). It is the Contractor's responsibility to make certain that all safety requirements, equipment, and training are met and provided to their employees. Additionally, the Contractor is responsible to ensure compliance with safety and health standards by all sub-contractor employees. AF Safety, Fire Protection, and Bioenvironmental Engineering officials may periodically enter a Contractor's workplace to verify working conditions of personnel or to make inspections for protection of Government facilities, personnel and equipment. If an improper procedure or unsafe condition exists, the Contractor shall notify the applicable Wing Representative/CO and immediately correct the unsafe condition within 24 hours after occurrence. Department of Labor OSHA inspectors are authorized right of entry to inspect any place of employment operated by an Air Force Contractor. They are, for the most part, "NO NOTICE" inspections. Notify the CO if an OSHA inspector visits the site unescorted by an LAFB representative.

9.22 Prior to beginning construction, the Contractor must complete the course for OpSec awareness for Contractors. The course provides information on the basic need to protect unclassified information about operations and personal information. The Contractor must provide proof of OPSEC, if completed, to CO.

9.23 Prior to beginning construction, the Contractor must complete the course for Information Protection awareness for Contractors per DODM 5200.01 and AFMAN 1614404 Attachment 3, enclosure 5. IP training may be provided to Contractor at Pre-construction meeting by the Information Protection representative.

"Ocean transportation" means any transportation aboard a ship, vessel, boat, barge, or ferry through international waters.

(ii) "Supplies" includes (but is not limited to) public works; buildings and facilities; ships; floating equipment and vessels of every character, type, and description, with parts, subassemblies, accessories, and equipment; machine tools; material; equipment; stores of all kinds; end items; construction materials; and components of the foregoing.

"U.S.-flag vessel" means a vessel of the United States or belonging to the United States, including any vessel registered or having national status under the laws of the United States.

(b)(1) The Contractor shall use U.S.-flag vessels when transporting any supplies by sea under this contract.

(i) This contract is a construction contract; or

(ii) The supplies being transported are-

(A) Noncommercial items; or

(1) The Contractor is reselling or distributing to the Government without adding value (generally, the Contractor does not add value to items that it subcontracts for f.o.b. destination shipment);

(2) Are shipped in direct support of U.S. military contingency operations, exercises, or forces deployed in humanitarian or peacekeeping operations; or

(3) Are commissary or exchange cargoes transported outside of the Defense Transportation System in accordance with 10 U.

S.C. 2643.

(2) The freight charges are inordinately excessive or unreasonable; or

(3) Freight charges are higher than charges to private persons for transportation of like goods.

(d) The Contractor must submit any request for use of foreign-flag vessels in writing to the Contracting Officer at least 45 days prior to the sailing date necessary to meet its delivery schedules. The Contracting Officer will process requests submitted after such date(s) as expeditiously as possible, but the Contracting Officer's failure to grant approvals to meet the shipper's sailing date will not of itself constitute a compensable delay under this or any other clause of this contract. Requests shall contain at a minimum-

(1) Type, weight, and cube of cargo;

(2) Required shipping date;

(3) Special handling and discharge requirements;

(4) Loading and discharge points;

(5) Name of shipper and consignee;

(6) Prime contract number; and

(e) The Contractor shall, within 30 days after each shipment covered by this clause, provide the Contracting Officer and the Maritime Administration, Office of Cargo Preference, U.S. Department of Transportation, 400 Seventh Street SW, Washington, DC 20590, one copy of the rated on board vessel operating carrier's ocean bill of lading, which shall contain the following information:

(1) Prime contract number;

(2) Name of vessel;

(3) Vessel flag of registry;

(4) Date of loading;

(5) Port of loading;

(6) Port of final discharge;

(7) Description of commodity;

(8) Gross weight in pounds and cubic feet if available;

(9) Total ocean freight in U.S. dollars; and

(10) Name of steamship company.

(f) If this contract exceeds the simplified acquisition threshold, the Contractor shall provide with its final invoice under this contract a representation that to the best of its knowledge and belief-

(1) No ocean transportation was used in the performance of this contract;

(2) Ocean transportation was used and only U.S.-flag vessels were used for all ocean shipments under the contract;

(3) Ocean transportation was used, and the Contractor had the written consent of the Contracting Officer for all foreign-flag ocean transportation; or

(4) Ocean transportation was used and some or all of the shipments were made on foreign-flag vessels without the written consent of the Contracting Officer. The Contractor shall describe these shipments in the following format:

ITEM DESCRIPTION CONTRACT LINE ITEMS

QUANTITY

TOTAL ____ ____ ____

(g) If this contract exceeds the simplified acquisition threshold and the final invoice does not include the required representation, the Government will reject and return it to the Contractor as an improper invoice for the purposes of the Prompt Payment clause of this contract. In the event there has been unauthorized use of foreign-flag vessels in the performance of this contract, the Contracting Officer is entitled to equitably adjust the contract, based on the unauthorized use.

(h) If the Contractor indicated in response to the solicitation provision, Representation of Extent of Transportation by Sea, that it did not anticipate transporting by sea any supplies; however, after the award of this contract, the Contractor learns that supplies will be transported by sea, the Contractor shall-

(1) Notify the Contracting Officer of that fact; and

(2) Comply with all the terms and conditions of this clause.

(i) In the award of subcontracts, for the types of supplies described in paragraph (b)(2) of this clause, including subcontracts for commercial items, the Contractor shall flow down the requirements of this clause as follows:

(1) The Contractor shall insert the substance of this clause, including this paragraph (i), in subcontracts that exceed the simplified acquisition threshold in part 2 of the Federal Acquisition Regulation.

(2) The Contractor shall insert the substance of paragraphs (a) through (e) of this clause, and this paragraph (i), in subcontracts that are at or below the simplified acquisition threshold in part 2 of the Federal Acquisition Regulation.
