PHMSA 2023 Pipeline Safety Standards

Statement of Work (SOW)

1. OBJECTIVE

The Pipeline and Hazardous Materials Safety Administration’s (PHMSA) regulations reference industry standards. This practice of referencing proprietary information is called Incorporated by

Reference (IBR). This procurement is aimed at providing PHMSA and NAPSR (National

Association of Pipeline Safety Representatives) inspectors with access to IBR standards. Other standards often are needed due to incident, accidents, training and history facilities.

Over the last decade, costs for furnishing standards and their usage has widely varied by year and month. In the past, PHMSA was in a forecasting mode. For this requirement, PHMSA will use a model from the manufacturing industry; Just-In-Time (JIT) is a model that is more reactive and furnishes the right item (in this case, book) at the right time or just in time. It strives for cost and availability efficiency.

PHMSA’s use of standards is mainly for internal purposes however, public requests may come in occasionally and result in a procurement of a permanent paper licensed copy of a standard.

Otherwise, the main subscription will utilize electronic copies of standards for a more global use of a standard as described in the Subscription Scope section of this Statement of Work. In every instance, PHMSA will determine when a request will be fulfilled by adding a standard to the main subscription or procuring a single or multiple paper copy license.

2. TASK/REQUIREMENT

PHMSA has a single requirement for Pipeline Safety Standards. The requirement is for a one-year (1-year) subscription to access pipeline standards. The contract resulting from this solicitation will require the capability to add standards to a subscription using the JIT model.

Any other standards may be included in this pre-bought list if it provides a best value to the government.

2.1 PHMSA, NAPSR and State Agencies under 60105 or 60106 Subscription

The following section describes the capability requirements with each type of standard fulfillment. PHMSA’s more reactionary approach to standards procurement will be handled either by a paper-based fulfillment or an electronic subscription fulfillment.

2.1.1 Cost Requirements

a) Award Costs:

The award cost shall include the infrastructure of the electronic subscription.

b) Estimate Costs for selection evaluation:

To understand the hypothetical costs of a full year (base year) of standard usage, PHMSA is requesting an estimate for the following. The use of the JIT model has its’ limitations particularly with some Standard Developing Organizations (SDO)s. We have run across two such collections that cover a majority of the IBRs which we incorporate. Therefore, we would like included in the quote a cost for the following in regard to the 2 concurrent seat configuration across 51 locations in an electronic subscription.

API – Refining Collection

API – Transportation Collection

Any other collections from any other SDO which we incorporate by reference is required.

Below is the format for quotation.

2.2 Paper Based Standard Requirements

PHMSA use of paper based standards will be used in one-off requests and rulemaking purposes.

The only requirement for these standard requests is that they are furnished within 5 business days to an address that PHMSA stipulates at the time of the request. PHMSA foresees that some paper requests will go directly to the end-user without an intervening trip to PHMSA HQ then to the end-user.

2.3 Electronic Subscription Requirements

Standards that are added to the electronic subscriptions shall have the following capabilities:

Subscription Content: PHMSA wishes to maximize flexibility on what we can obtain while providing ease to the end users in accessing it. For standards that must be available to our entire community we will use the subscription service. For rulemaking and Federal statutory requirements, we will need to obtain a single copy permanent license in either a paper format or a protected PDF using digital rights management. We expect to add standards both to the general subscription as well as purchase single PDF and/or paper copy as the requests come into

PHMSA from our divisions.

Subscription Scope: We have approximately 7 PHMSA, 55 NAPSR offices that will be accessing the electronic subscription. PHMSA, and NAPSR have approximately 450 inspectors across these sites that access standards for inspection, training and research purposes. PHMSA is requesting that the concurrent seats to the electronic system be set at 2 seats across 51 locations

(all 50 states and the Commonwealth of Puerto Rico).

Access to the Subscription: All users shall have the capability to access the subscription in the following ways. By anonymous IP verification access or using a username & password configuration.

Format: Each standard must be available through the vendor’s website. Each subscribed standard for a PHMSA employee and our State Partner agencies (state pipeline employee) shall have unrestricted access to the subscribed standards without any security that would require a separate program to be installed on the end user’s computer or server to be able to access the standard.

Additional redlined versions of standards are strongly encouraged for purposes of PHMSA rulemaking exercises.

Version: With the JIT model, PHMSA is not requiring that standards have all versioning forward and back to what is was applicable on 1/1/1970. PHMSA is requiring that when requested, a historical copy is requested it can be obtained and added to the subscription or procured in paper.

The term “applicable back to 1/1/1970” means that if a revision that was in effect in 1970 was dated prior to 1970 (e.g. 1969), then the prior revision (e.g. 1969) would be in effect and therefore available for retrieval as part of this requirement.

Revisions/Updates: All updates and revisions to the subscribed standards, during the period of performance must be available for procurement within 10 business days from the date the sponsoring standards organization makes the update/revision available.

Submission: All subscribed quoted as part of this contract must be available within 1 business day from the effective date of award.

Standards Usage: When a user accesses the subscribed standards, the user may be able to do the following:

• Print all PDF files (Note: printed copies will be treated as rental/lease property and will be destroyed upon the end of this contract.);

• Save all PDF files to a federal or state official computer/laptop to ensure that a standard can be viewed in the field without an internet connection (Note: saved electronic copies will be treated as rental/lease property and will be destroyed upon the end of this contract);

• Clip text and pictures from a standard to include on an official federal or state document for official purposes. (Note: each clip and/or picture will be referenced

(footnoted) as to the standard, its year, revision, if applicable, and page number.);

• View only copies of any subscribed standards will be made available to a non-registered user when accompanied by a PHMSA or State Pipeline safety agency employee who is an authorized user. No standard content may be released at any time to a non-registered user on a loan or permanent transfer basis.

Note: All efforts will be made to protect the copyright of each document.

Management of subscriptions: The vendor’s subscription portal for the subscription delivery shall also contain the following functionality:

1. Permanent License Purchasing: A means to leverage the cost savings of “one off” standards for emergency situations. The delivery for these standards could be a single paper copy or an addition to the PHMSA and NAPSR Internal Subscription.

2. A quick access list for the end users to be able to view the baseline standards down to the version level of the standard volume. This quick access list shall be global across all users that have access to the subscription and be hyperlink enabled for quick and easy redirection to the standard sought out.

3. Management User Roles: The subscription portal shall have elevated roles for certain users to manage other users (reset passwords, unlock accounts, etc.) and other roles that enable a higher level with the ability to assign a standard to a block.

4. User Requested Standard: A means for a named user to request a standard through the subscription portal for review and action by someone with the proper management role.

5. Usage Reports: A usage report of which standards were used shall made available to be queried monthly.

Training: The vendor shall provide training to the PHMSA administrators of the vendor’s portal.

This training can be accomplished either as a written manual or an online training session. A minimum of 4 hours of training shall be provided.

Telephone and Email Support: A point of contact shall be provided to administer assistance with the portal when needed during the period of performance.

Delivery Date: 1 business day from the effective date of award.

Delivery Location: 1200 New Jersey Avenue SE, Washington, DC 20590, Attn: Kate Rosenberg, PHP-7.
