2.1 GENERAL INFORMATION

2.1.1 This firm fixed price Indefinite Delivery Indefinite Quantity (IDIQ) type contract with one (1) base year and two (2) option year period for the safe and secure transportation and delivery/pick-up of items between Vienna warehouse and US Embassy leased and owned properties in Bratislava, including loading, unloading and all direct and indirect costs, moving services within US Embassy leased and owned properties, furniture assembly and disassembly, and weekly disposal of regular and hazardous waste from US Embassy leased and owned properties.

2.1.2 The Contractor shall complete all work, including furnishing all labor, materials, equipment and services, unless otherwise specified herein, required under this contract for the firm fixed- price indicated below and within the time specified herein. This price shall include all labor, materials, insurance, and profit. Any costs not priced will be considered to be included in the overhead and other indirect costs.

2.1.3 No additional sums will be payable on account of any escalation in the cost of materials, equipment or labor, or because of the Contractor's failure to properly estimate or accurately predict the cost or difficulty of achieving the results required by this contract.

2.1.4 The contract will be for a one-year period from the date of the contract award, with two (2) one-year options.

2.1.5 Standard Services shall be ordered, Temporary additional services may be ordered if required and if funding is available. “Temporary Additional Services” include all services not identified in “Standard Services” of this section, including overtime, Saturday, Sunday and local public holiday. Quantities in this contract are estimates. The Government does not guarantee these estimated quantities and the contractor shall have no right to equitable adjustment if the estimated quantities are not ordered. If the quantities change, the price will remain the same. For the TAS, the contractor shall receive payment only as reimbursement, at the rates specified in “Pricing Summary”, for services actually ordered and performed.

2.2 VALUE ADDED TAX.

2.2.1 Value Added Tax (VAT) is not included in the CLIN rates. Instead, it will be priced as a separate Line Item in the contract and on Invoices. Local law dictates the portion of the contract price that is subject to VAT;

this percentage is multiplied only against that portion. It is reflected for each performance period.

2.3 DEFENSE BASE ACT INSURANCE (DBA)

2.3.1 DBA insurance is required for all United States citizens or residents and individuals hired in the United States, regardless of citizenship for any construction and services for U. S. overseas contracts over US $10,000.00. DBA insurance is also required for all Host Country Nationals (HCNs) and Third Country Nationals (TCNs) working overseas unless waved by the Department of Labor (DOL). Only the countries listed currently on the DOL’s Active DBA Waivers are not required to have DBA insurance for Host Country Nationals (HCNs) and Third Country Nationals (TCNs). See website for country waivers:

https://www.dol.gov/owcp/dlhwc/dbawaivers/dbawaivers.htm

2.3.2 The waiver is only valid if alternative worker’s compensation benefits are provided to the waived employees pursuant to applicable local law. If there are no local worker’s compensation laws, the waiver has no effect and HCN and TCN (if applicable by local law) working under a U. S. contract shall be included and covered under the DBA.

2.3.3 The DBA insurance may be obtained from any authorized DBA insurance broker, see FAR52.228-3 WORKER’S COMPENSATION INSURANCE (DEFENSE BASE ACT) (APR1984). New DBA insurances policies can be purchased directly from any DOL approved insurance carrier. A list of DOL approved carriers may be found athttp://www.dol.gov/owcp/dlhwc/lscarrier.htm.

2.3.4 The Contractor will be reimbursed for DBA only to the extent the contractor provides documentary proof that DBA has been paid and only to the extent quoted in the Pricing Schedule.

2.3.5 DBA insurance cost will be evaluated as part of the total evaluated fixed price and included in the fixed price of the contract. Where DBA is applicable, the Contractor will be required to provide evidence of insurance (certification of coverage and a paid invoice) within 15 calendar days from the date of award.

2.3.6 Due to the fact that Slovakia is on the DOL’s active waiver list, DBA insurance is not required for all personnel performing under this contract.

2.4 MINIMUM AND MAXIMUM AMOUNTS

During this contract period, the Government shall place orders totaling a minimum of EUR 20,000. This reflects the contract minimum for this period of performance. The amount of all orders shall not exceed EUR 170,000.

This reflects the contract maximum for this period of performance.

2.5. PRICE SCHEDULE

The full range of services and pricing for material handling and moving services is described in the Contract Line Item Numbers (CLIN’s) - Price Summary. The Offerer shall fill in all the prices for the Base Year as well as for all option years. Please note that these are estimates only, and are not binding on the Government. See also 52.216-22 - Indefinite Quantity (Oct 1995).
