SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP) UNDER THE

SIMPLIFIED ACQUISITION THRESHOLD (SAT)

1. Contracting Activity:

This document is a justification for single source determination under Simplified Acquisition Procedures (SAP) under the Simplified Acquisition Threshold (SAT) for the Department of the Interior, Bureau of Indian Affairs, Flathead Indian Irrigation Project.

2. Description of supplies or services required to meet agency needs.

· This requirement includes the purchase and delivery of Cascade and Teton weed and algae control products.

· The Anticipated delivery is 60 Days ARO.

3. Identification of the single source to be solicited.

UPL NA, Inc 630 Freedom Business Ctr Dr Ste 402 King of Prussia, PA 19406-1331 561-301-8326

4. Reason for authority cited.

The contracting officer has determined the circumstances of the contract deem only one source reasonably available. There is only one known vendor capable of providing these products in the 250 Gallon Tote required by the customer.

5. Rationale:

Only one tote will fit in the agency’s vehicle at a time and using smaller totes would cause a significant increase in fuel cost and a higher demand of labor hours to the application of these products to the agency’s area of responsibility. This requirement has been publicly posted in the past with set-asides for ISBEE, IEE and for Small Business Vendors. None of these attempts yielded any responses and an award was eventually made to UPL NA, Inc.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

A notice will be posted publicly and will provide agency contact information allowing any interested vendors who may have the capability to provide these products the opportunity to contact the contact specialist.
