Contract Performance During Changes in NIST Operating Status
PAGE 13 OF 20 1333ND26QNB190502
All contractors performing work on active contracts at the U.S. Department of Commerce (DOC), National Institute of Standards and Technology (NIST) campuses and/or working in NIST workspaces should go to the www.nist.gov website and under the "About NIST" tab click on "Visit". This site includes information about campus access and security information; identification requirements; parking information and more.
Contractor personnel are required to check the appropriate campus operating status and personnel requirements at https://www.nist.gov/campus-status daily prior to arriving on site. All personnel must adhere to the requirements set forth in the operating status.
Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of NIST that will impact normal days of business operation such as inclement weather, power outages, etc. In circumstances such as these, the Contractor must call the appropriate NIST campus status line to verify the operating status:
Gaithersburg Campus Operating Status Line:
(301) 975-8000
(800) 437-4385 x8000 (toll free)
Boulder Campus Operating Status Line:
(303) 497-4000
(303) 497-3000 option 2
In the event of a lapse in appropriation, access to Government facilities and resources, including equipment and systems will be limited to excepted personnel for both Federal employees and contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless the contractor has been, or is notified that it is required to work under an excepted status, the contractor must stop work. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at www.nist.gov (banner on front page) and/or the NIST operating status line(s). Additionally, contractors are encouraged to monitor public broadcasts or the Office of Personnel Management's website at www.opm.gov for the Federal Government operating status.
NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer's Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.
Contractors with active supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would not cause the Government to incur additional obligations during the lapse in appropriation may continue performance.
Please note that in all circumstances that impact operations on the NIST campuses, contractors are expected to follow all direction and guidance provided by NIST authorities.

This Request for Quote (RFQ) action is to be executed in accordance with the procedures of Revolutionary FAR Overhaul (RFO) FAR 12, Acquisition of Commercial Products and Commercial Services.
The Government intends to make a lowest price, technically acceptable determination from the quote offering the lowest price, technical acceptable solution to meeting the requirement.
Offeror submittals shall include a technical volume separate from the pricing, as detailed below.
The technical quote shall consist of Offerors addressing each of the non-price evaluation subfactors described below and providing a detailed process for addressing the solicitation requirements. Offerors should indicate the company's capabilities and the means to be used to satisfy the requirements of the solicitation.
The pricing quote shall consist of the Offeror’s best and final price to satisfy the requirement.
In accordance with FAR Clause 52.212-1(d), The Government intends to evaluate quotes and award a contract without discussions with Offerors. Therefore, the Offeror’s initial quote should contain the Offeror’s best terms.
However, the Government reserves the right to conduct discussions, if necessary. The Government may reject any or all quotes if such action is in the public interest, accept other than the lowest quote, and waive informalities and minor irregularities in quotes received.
Quote Volume Requirements:
NIST requires two (2) separate volumes for this requirement:
• Volume 1, Price Quote – SF 1449 and all amendments completed, priced as necessary, and signed
• Volume 2, Technical Quote – Non-Price Evaluation Factor
Each quote shall clearly demonstrate the Offeror’s understanding of both the general and specific technical requirements of the solicitation.
Clarity and completeness of quotes are of the utmost importance. Therefore, quotes must be written in a practical, clear, and concise manner. Quotes which merely restate the requirement or state that the requirement will be met without providing supporting rationale are not sufficient and will result in an unfavorable evaluation rating.
Failure to provide a reasonable and complete response to the solicitation may reflect a lack of understanding of the requirements and may result in a determination that the quote is technically unacceptable.
Failure to submit any of the information requested by this solicitation may result in a quote being found non-responsive and not evaluated or result in an unfavorable evaluation rating.
An Offeror may be eliminated from consideration without further exchanges if their quote is not among those considered most advantageous to the Government based on the solicitation criteria.
Offeror may be asked to clarify certain aspects of their quote to resolve minor or clerical errors.
Upon receipt, all Quotes become Government property.
Offerors should note that taking exceptions to the Government's requirements may indicate an unwillingness or inability to fulfil the contract and may be considered ineligible for award.

2. Solicitation Response Requirements
The Government will assess quotes based on how well the quotes meet the factors and requirements outlined in this RFP using the evaluation criteria and instructions therein.
Any quote that does not meet the stated solicitation requirements or performance objectives may be considered ineligible for award.
2.1 Quote Requirements
Quotes shall conform to the solicitation provisions and be prepared in accordance with this section.
To aid in evaluation, the quotes shall be clearly and concisely written, neatly presented, indexed (cross-indexed as appropriate), and assembled as required by this instruction to offerors. All pages of each part shall be appropriately numbered and identified with the name of the Offerors, the date, and the solicitation number.
Page Limitations. Volume II shall be no more than 10-pages.
Format. Text shall be single-spaced and fit on 8½” x 11” paper, with a minimum one-inch margin all around (should the Government need to print). Each page with content shall count as a single page. Pages shall be numbered consecutively. Text shall be no smaller than 11-point font. Bolding, underlining, and italics may be used to identify topic demarcations or points of emphasis. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have spacing and text that is easily readable.
Restriction of Disclosure/Proprietary Information. If the Offeror wishes to restrict the disclosure or use of its quote, individual subcontractor/vendor proprietary information may be submitted via separate volumes. The information contained in these volumes must be referenced (by volume title, page, and section number as appropriate) within the main quote where the information would have been included if it were not subcontractor/vendor proprietary. The information in these separate volumes is subject to all other requirements of the RFP, will be included in the page count for the appropriate volume, and must be well-marked to clearly indicate any special handling instructions.
Submission Due Dates. Quotes must be received prior the date and time in block 8 of the SF 1449. Quotes received after this date and time are considered late and may not be accepted.
Pricing. Offeror agrees to hold their pricing firm for 120 calendar days from the date specified in block 8 of the SF 1449, unless another time period is specified in an addendum to the solicitation. Any quote providing less than the specified acceptance period may not be considered acceptable and may not be considered for award.

5. Confidential Information
The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of offeror’s qualifications and Quotes submitted to Federal agencies.
If a offeror's submissions contain information that they believe should be withheld from such requesters under FOIA on the grounds that they contain "trade secrets and commercial or financial information" [5 USC§552(b) (4)], the offeror should mark its submissions in the following manner "Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act.”

ADDENDUM TO 52.212-2, EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES
Basis of Award – The Government intends to issue a firm-fixed-price purchase order using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the lowest-priced quote that meets all technical acceptability standards and otherwise conforms to the solicitation
Except for communications conducted for the purpose of minor clarification, the Government intends to evaluate offers and award without discussions. Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary.
The Government will arrange the quotes from lowest to highest total evaluated price. The Government will evaluate technical acceptability beginning with the lowest-priced quotation and will continue in ascending order of price until a technically acceptable quotation is identified. Once a technically acceptable quotation is identified, the Government may cease evaluating higher-priced quotations. A technically unacceptable quote will not be considered further for award. USING THIS PROCEDURE, THE
GOVERNMENT MAY NOT EVALUATE ALL QUOTES.
The following factors will be used to evaluate quotes:
• Volume 1 – Price
• Volume 2 – Technical o Technical Capability/Qualifications o Warranty Capability o Schedule
VOLUME 1 – PRICE
Price will be evaluated separately from the Technical Factor. The Government will evaluate the total proposed price for completeness and reasonableness. The proposed price must be determined to be fair and reasonable.
The Government may use one or more price analysis techniques, including comparison of proposed prices received in response to the solicitation and comparison with the Independent Government Estimate.
VOLUME 2 – TECHNICAL
Technical Evaluation: Acceptable/Unacceptable
The Technical Factor is a pass/fail threshold requirement and will be evaluated as Acceptable or Unacceptable.
The Government will evaluate the Offeror’s technical quote against the requirements and salient characteristics contained in the solicitation and Requirements Document.
Each technical subfactor will be assigned one of the following ratings:
Acceptable: The quote meets all solicitation requirements applicable to the subfactor and provides the information and supporting documentation required by the solicitation.
Unacceptable: The quote fails to meet one or more solicitation requirements applicable to the subfactor, fails to provide required information or supporting documentation, or takes exception to a material solicitation requirement.
PAGE 19 OF 20 1333ND26QNB190502
To receive an overall Technical rating of Acceptable, the quotation must receive an Acceptable rating under each technical subfactor. A rating of Unacceptable under any technical subfactor will result in an overall Technical rating of Unacceptable.
1. Technical Capability/Qualifications
The Government will evaluate whether the quote satisfies the following acceptability standards:
(i) Demonstrates that the Quoter is manufacturer-certified or otherwise authorized/qualified, as applicable, to perform the required repairs and has the capability to successfully perform the requirements of the SOW.
(ii) Proposed repair facility is located within 30 miles of the NIST Gaithersburg campus.
2. Warranty Capability
The Government will evaluate the Offeror’s quote to determine whether it demonstrates that the warranty applicable to the proposed parts or components satisfies the warranty requirements of the SOW and that the Offeror has the capability to provide or support the associated warranty service.
3. Schedule
The Government will evaluate the Offeror’s quote to determine whether it demonstrates a reasonable and feasible approach for completing the required repairs within 14 calendar days after receipt of the vehicle.
