About this file

This is a Sole-Source Determination and Justification document prepared by the Oregon Department of Fish and Wildlife (ODFW) for the procurement of 15,000 Biomark APT 12 pre-loaded pit tags for the Round Butte Hatchery. The pit tags will be used to gather vital data for the Deschutes River Stock hatchery spring Chinook program, specifically to evaluate the effectiveness of increasing adult returns of hatchery spring Chinook to the Deschutes River. The purchase is categorized as a single procurement with an estimated total value of $43,650.00. No specific response dates, due dates, site visits, or bidder meetings are identified in the document. The determination was prepared on October 27, 2025, and approved on November 25, 2025, by April Brenden-Locke, Contract Services Manager at ODFW.

The Biomark APT-12 pit tags are justified as a sole-source procurement based on compatibility requirements with existing Biomark detection infrastructure currently in use at Round Butte Hatchery and at in-stream detection equipment located on all main stem Columbia River dams. Market research confirmed that no alternative products meet the specific performance standards required, including the 134.2 kHz interrogation frequency, ISO standards 11784 and 11785 compliance, and immersion capability for accurate detection of fish movements. The tags measure 12.5 mm in length and 2.03 mm in diameter and are designed for subcutaneous or intramuscular implantation. The sole-source determination was made pursuant to OAR 125-247-0275(2)(a) based on the compatibility requirement to efficiently utilize existing goods and services from only one source. No alternative vendors were identified during market research.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION FOR

SUPPLIES AND SERVICES

Date: 10/27/2025 To: April Brenden-Locke, Designated Procurement Officer, Contract Services, Administrative Services Division

From: Ryan Moon Jazmine Deckard, RE: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and

Oregon Administrative Rule (OAR) 125-247-0275

CSR: CSR # 454-25 Round Butte Hatchery 15,000 Pit Tag Purchase

Part A

1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)

2. Estimated Total Value of the Procurement: $43,650.00

3. Single or Multiple Purchases: Single

4. Proposed Contractor: Bio Mark

5. Brief Description of Goods or Services to be procured: 15,000 Biomark APT 12 pre-loaded pit tags.

Biomark item# BIO 12.B04V2PLT.

6. Background: Pit tags will be used to gather vital data for the Deschutes River Stock hatchery spring Chinook program.

This data is especially vital considering the extremely low adult returns observed in recent years for Deschutes Stock spring Chinook. ODFW uses this data to determine in-stream adult return run estimates by year, which guides us in making sound management decisions.

This study focuses on hatchery spring Chinook smolts raised and released at Round Butte Hatchery. It will evaluate the effectiveness at increasing the number of adult returns of hatchery spring Chinook to the Deschutes River.

Biomark APT-12 pit tags are the sole and standard pit tags used for this purpose. They provide accurate and timely data to meet our program’s needs. These PIT tags are the only ones compatible with the PIT tag detection equipment currently in use at the hatchery (also manufactured by Biomark), as well as the in-stream PIT tag detection equipment located on all the main stem Columbia River

Dams. No other known options are available that would allow us to accurately gather this vital data using our existing equipment.

5. Findings:

A. Market Research Overall Finding.

Market research was conducted to identify potential vendors capable of meeting the technical and compatibility requirements for PIT tags used in the Round Butte Hatchery study (size, ISO standards, immersion capability, frequency, speed and distance detection for fish etc.). See attachment for specifications of Biomark APT-12 tags designed specifically to meet the needs for accurately detecting instream fish movements. No alternative products were identified that meet the specific performance standards and compatibility needs of the existing Biomark detection infrastructure. Based on this research, Biomark remains the only known source for the required PIT tags.

And

B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:

1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.

This purchase will support an ongoing PIT tag monitoring study that utilizes Biomark PIT tags, readers, and receivers. To ensure compatibility with existing equipment, the radio tags must be able to be detectable by the existing radio telemetry receiver network and must operate at an interrogation frequency of 134.2 kHz +/-1.

2. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.

3. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.

4. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:

unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.

Part B - Conditions of Approval will be inserted by ODFW-DPO.
