About this file
This document is a Sole Source Justification for a minor irrigation repair project at the Georgia National Cemetery. The Department of Veterans Affairs National Cemetery Administration Southeast District requires irrigation repair services for the Phase 1 section of the cemetery, including replacing approximately 4 controllers, 200 electric valves, and control wiring, at an estimated cost of $350,000. The VA is awarding a firm-fixed price contract with a 365-day period of performance on a sole source basis to Native Contractors, a Service-Disabled Veteran-Owned Small Business (SDVOSB) that is the incumbent grounds maintenance and irrigation contractor for the cemetery. The justification cites the need to coordinate with the ongoing cemetery expansion project, Native Contractors' familiarity with the existing irrigation system, and the lack of other identified responsible SDVOSB sources as the basis for the sole source award under the authority of 38 U.S.C. 8127(c).

DEPARTMENT OF VETERANS AFFAIRS
Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID PR 7884-000009, Project 788-MM24-0001: Georgia National Irrigation
1. Contracting Activity: Department of Veterans Affairs, National Cemetery Administration
Southeast District, Georgia National Cemetery
2. Nature and/or Description of the Action Being Approved:
Georgia National Cemetery is need of a minor project contract to perform irrigation repair to existing irrigation system within the phase 1 section of the cemetery. The cemetery is currently in middle of expansion project to cemetery that includes installation of new irrigation system. Firm fixed price contract type will be utilized for a Period of Performance of 365 days.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Irrigation repair services needed in the Phase 1 section of the Georgia National Cemetery.
Approximately 4 controllers, estimated 200 electric valves and control wiring will be needed to complete repairs. These repairs will run consecutively with the installation of new irrigation system in the Phase 2 expansion project that is currently ongoing. The estimated cost of this project is $350,000.00.
4. Statutory Authority Permitting Other than Full and Open Competition: The basis for limiting the sources for this acquisition is based on the following regulations: FAR 13.501(a), FAR 6.302-5, and VAAR 819.7008. 41 U.S.C. 3304(a)(5) provides authority to support the above-referenced regulations. 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR
819.7009 (DEVIATION) up to $5,000,000. Check the specific VAAR clause used below:
( x ) 819.7008 Sole source awards to a certified service-disabled veteran-owned small business;
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
It has been determined to be in the best interest of the Government to negotiate a sole source contract with Native Contractors, a SDVOSB firm that has vast experience in performing work relevant to the statement of work. Native is the current Grounds Maintenance Contractor for Georgia NC and Marietta NC. They currently handle all the irrigation repairs and maintenance under both contracts. They are very familiar with the irrigation system at Georgia NC and fully understand the irrigation system as whole and are best equipped to perform the valve replacement for Georgia NC. Contracting with a different contractor would delay work into winter or spring and potentially cause issues with the ongoing expansion project that this work must be tied into. Due to the overlapping nature, communication and coordination that occurs between the projects the government would be best served with a sole source award to Native Contractors The authority allows sole source awards to SDVOSB based on 38 U.S.C. 8127(c) and the SDVOSB concern has been determined to be a responsible source with respect to performance at the Georgia national cemetery and within the Southeast District of the NCA. Additionally, the business meets eligibility requirements in 819.7003(DEVIATION). No other responsible SDVOSB concern has been identified.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies:
No responsible SDVOSB concern has been identified. Overlapping work with the expansion project requires award to contractor onsite who can start immediately without delay.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
Award will be based off IGE providing the government a fair and reasonable price. Native Contractors has been deemed fair and reasonable based on current awards to multiple projects within the NCA southeast district (FAR 6.303-2(b)(7)).
8. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
In accordance with FAR 10.002, research into this area was performed by querying Government databases (VIP and SBA DSBS), and the Contracting Officer has determined it is in the best interest of the Government to set-aside this procurement for SDVOSB. See the attached Market Research document. Furthermore Native Contractors meets the eligibility criteria outlined in VAAR 819.7003(DEVIATION), they are certified in VetCert
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
None as this is being completed through the authority under 38 USC 8127(c).
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
None
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any
Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Acquisition planning will occur to ensure projects occurring near or within another project will not adversely impact an award timeline or utilize similar resources that must be completed concurrently.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
