About this file

This document is a Justification and Approval (J&A) for a sole-source contract for a 3-year warranty extension for a previously purchased MGA 1100 respiratory mass spectrometer. The Naval Medical Research Command (NMRC) intends to award a multi-year, firm fixed-price contract to MA Tech Services for $63,000, covering comprehensive maintenance and warranty services. MA Tech Services is the exclusive rights holder for the MGA 1100, which was originally purchased in November 2018 through contract N32398-19-P-207 for $136,000.

The warranty extension will provide full maintenance coverage including travel, parts, 6 hours of labor per service call, software updates, alignments, system tests, calibrations for specified gases (oxygen, carbon dioxide, nitrogen, and argon), and oil changes. Two site calls per year are included, with additional calls available at a discounted rate. The contract is being procured under statutory exceptions for sole-source acquisitions, specifically 10 U.S.C. 2304(c)(1) and FAR 6.302-1, as MA Tech Services is the only provider capable of servicing this specialized scientific equipment for a project focused on physiologic, gas, and chemical sensors in cockpit environments.

Text version

The requirement is for a 3-year warranty extension for a previously purchased fast response sector, respiratory mass spectrometer with a high-altitude valving (MGA 1100 and SAM modification). The warranty covers all parts, service calls, and labor for the performance period. The government intends on awarding a multi-year option, firm fixed price contract. The proposed source is MA Tech Services, 1920 South Broadway, Saint Louis, Missouri 63104.

NAMRU-D has a requirement for a 3-year warranty extension for a previously purchased respiratory mass spectrometer (MGA 1100) for the project entitled "Efficacy of Physiologic, Gas, and Chemical Sensors in the cockpit for PE Identification." The warranty provided maintenance coverage of travel, parts, 6 hours of labor per call, updates, full preventative maintenance including software updates, alignments, complete system tests, calibrations of all gases used in the MGA 1100 (oxygen, carbon dioxide, nitrogen, and argon), and oil changes, and two site calls per year. Additional site called will be billed at an additional discount.

NAMRU-D funds, estimated in the amount of $63,000 will be used to procure the 3-year warranty extension.

MA Tech Services owns the sole rights to build and service the MGA 1100. The 3-year warranty extension for the MGA 1100 will be only procurable through MA Tech Services because it directly services their product.

JUSTIFICATION AND APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity.

This justification is executed by the Naval Medical Research Command (NMRC), Silver Spring, MD, on behalf of the Navy to meet Navy Expeditionary Medical Research requirements.

2. Nature and/or description of the action.

3. Description of Supplies or Services.

4. Identification of the statutory exceptions permitting other than full and open competition.

The statutory exception permitting other than full and open competition for this acquisition is 10

U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions or FAR

13.106-1(b)(1) soliciting from a single source.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was performed, the results of which are in paragraph 8. This requirement will be posted to the government point of entry in accordance with FAR 5.202.

The contracting officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor's commercial price list and will be determined fair and reasonable.

Market research was not conducted because MA Tech is the only warranty, maintenance, and service provider for the MGA 1100. NAMRU-D previously purchased the MGA 1100 from MA Tech Services and MA Tech Services hold the rights to the MGA 1100.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

9. Other facts supporting the use of other than full and open competition.

The requirement for the MGA 1100 mass spectrometer was determined to be and justified as non-competed, sole-source contract in November 2018. The contract was awarded to MA Tech services through contract N32398-19-P-207, totaling in $136,000. The purchase included the

MGA 1100 mass spectrometer and a two-year warranty for the product. A follow on warranty contract was awarded in FY-2020 for $89,000 with a period of performance of August 2020 to

August 2025. There is a need for a continued warranty through a new contract with MA Tech

Services.

10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

No other sources are being considered as providers. Other sources were rejected because the warranty extension being procured is for the MGA 1100 previously purchased from MA Tech

Services. MA Tech Services holds the rights to the MGA 1100 exclusively.

11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

For the reasons set forth in paragraph 5, no competition for contracts will take place.
