About this file

This is a Department of Treasury SF 1009 Sole Source Justification for acquisitions at or below the Simplified Acquisition Threshold. The Internal Revenue Service (IRS) Criminal Investigation (CI) Advanced Analytics and Innovation, Data Management and Governance (AAI:DMG:DPC) division, contracting through the IRS Office of Procurement, seeks to procure maintenance and technical support services for six OPEX Falcon high-speed scanners. The period of performance runs from March 3, 2026 through March 2, 2027, with requisition number 5000221545. The equipment processes seized financial documents used as evidence in financial crimes cases and projects.

The acquisition qualifies as a sole source procurement because OPEX Corporation is the only vendor reasonably available to provide the required services. OPEX maintains exclusive control over all warranty items and equipment support through its World Headquarters in Moorestown, New Jersey, and has not licensed its proprietary service diagnostic software to any third parties. No authorized resellers are permitted to perform maintenance on OPEX equipment. The justification notes that while the IRS considered purchasing alternative scanners, such a transition would require rigorous testing, several months for deployment, and a substantial financial commitment estimated at $500,000, which poses unacceptable risks of workflow disruption, missed project deadlines, and compromise of critical CI mission objectives. Market research conducted on GSA-related websites and NASA SEWP supported the determination to award on a sole source basis. The Program Office certification was signed by Sabrina Jones on November 20, 2025, and the Contracting Officer (Denise Alvarez) approved the determination on February 19, 2026.

.b Supporting information and facts (i.e. the details surrounding the requirement that supports the selection made in 4.a).

This acquisition is to renew the maintenance/technical support of six OPEX Falcon high speed scanners. The Falcon scanners process seized financial documents to use as evidence in suppo1t of financial crimes cases and projects. The annual maintenance is critical to protect the IRS' s investment and must be renewed to ensure that the scanners remain operational and reliable.

There are no re-sellers authorized to perfo1m maintenance on OPEX equipment. All wananty items, as well as all aspects of equipment suppo1t, are handled directly through the OPEX World Headquait ers in Moorestown, New Jersey. The equipment uses proprietaiy se1vice diagnostic software covered by vai·ious patents and copyrights. OPEX has not released or licensed this software to third parties. To effectively suppo1t OPEX equipment, these third pait ies would have to develop their own diagnostic softwai·e. This cost would likely be passed on to the Government.

To avoid limiting competition in the future , DPC has also considered purchasing alternative scanners. However, the implementation of a new brand of industrial scanners would require rigorous testing and a deployment process spanning several months. Such a transition, canies the risk of significant disrnptions in workflow, missed project deadlines, and the potential compromise of critical CI mission objectives. Fmihe1more, this adoption would require a substantial financial commitment, estimated at $SOOK. Given the IRS's constrained financial resources, it is necessaiy to avoid unnecessaiy expenditures and duplication of costs, pait iculai·ly considering the limited availability of funds during this period.
