About this file
This document is a Non-Competitive Procurement Justification Memo from the Naval Surface Warfare Center Carderock Division (NSWCCD), Code 665, seeking to award a sole-source contract to the University of Virginia Center for Applied Biomechanics (UVA CAB). The requirement is for performing predicted occupant kinematics modeling and analyses to support Personnel Injury Assessments for COLUMBIA (CLB) and VIRGINIA (VA) Block V Class submarines, with a performance period of one year from contract award.
The justification for sole-source selection is based on UVA CAB's unique expertise in impact biomechanics, their existing submarine-related models from previous NSWCCD projects, and their specialized knowledge in injury prevention. The memo notes that if another entity were to take the project, it would cost approximately $100,000 and take several months to rebuild the necessary models. The contractor will conduct reviews of Time Histories to assess occupant kinematics, evaluate the risk of blunt impact injury, and determine injury onset for submarine personnel.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025
MEMORANDUM FOR FILE
FROM:
CODE: 665
TO: Code 02 DATE: 23 Oct 2025 SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer
3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)
The NSWCCD, Code 665, requires a contract to perform predicted occupant kinematics modeling and analyses to support the completion of Personnel Injury Assessments for the COLUMBIA (CLB) and VIRGNIA (VA) Block V Class submarines The contractor shall conduct reviews of Time Histories to assess and define the Range of Occupant Kinematics from Prescribed Deck Motion, the Risk of Blunt Impact Injury from Predicted Occupant Kinematics, and to determine the onset of injury. The POP is one year from date of contract award.
Contracting Office for Performer: Rector and Visitors of the University of Virginia Address: 1001 Emmet St. N., Charlottesville, VA 22903 POC: Robert Salzar
Performer: University of Virginia Center for Applied Biomechanics Address: 4040 Lewis and Clark Drive, Charlottesville, VA 22911 Phone: 434-297-8035 POC: Robert Salzar
III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Federal Supply Schedule (FSS) IAW FAR 8.405-6(b).
4. Other Reasons.
B. SOLE SOURCE. (select all that apply)
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. Other Reasons.
-based
For this procurement, the UVA CAB will be utilizing the same models that were utilized on previous NSWCCD projects. If another entity takes this project, it will take several months (~100K) to rebuild the models and have an understanding of submarines.
The UVA CAB is the only lab/private business that specializes in impact biomechanics for injury prevention for automobiles. A number of personnel on both submarine platforms will be seated so the automobile knowledge that UVA CAB has will be directly applicable to what is necessary to complete the CLB and VA Blk V Personnel Injury Assessment.
will be on impact biomechanics and how to prevent it.
4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)
a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or
c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
IV. CERTIFICATIONS & APPROVALS
A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
