About this file

This is a Justification for Other than Full and Open Competition (APPENDIX A) issued by the Consumer Product Safety Commission's Office of Procurement Services, revised February 19, 2026.

The CPSC is procuring All-Terrain/Recreational Off-highway/Off-highway Vehicle (ATV/ROV/OHV) testing and training locations with outdoor applicability. The contract is for five years, consisting of a one-year base period (April 1, 2026 – March 31, 2027) and four optional twelve-month periods (April 1, 2027 – March 31, 2031). The justification supports procurement through other than full and open competition, citing "only one responsible source and no other supplies or services will satisfy agency requirements." CPSC staff researched multiple locations within a 15-mile radius of the National Product Testing and Evaluation laboratory in Rockville, Maryland, but determined that only BBG Aerosystems (formerly Laytonsville/Davis W-50 Airport) meets all specifications. The facility must provide a private test area within 15 miles of the evaluation center, emergency response access from local first responders (Fire/EMS) within 3.0 miles, and a training area of at least 4 acres containing multiple terrain types, a 220' x 220' flat dirt or grass area for closed course training, and classroom space accommodating up to 16 people. BBG Aerosystems, located 14.2 miles from the center with Laytonsville District Volunteer Fire Department providing 3.0-mile response distance, is the sole facility meeting all requirements and maintains valid SAM.gov registration.
