Text version
Single Source Justification (Simplified Acquisition)
Section A: General Contract Information
Contracting Activity:
374 CONS/ PKBB
Project/Program Name: OMAX 55100 final installation and training
Section B: Description of the Supplies/Services Required
To provide tech and installation services for the equipment mentioned below and the purchase of replacement/spare parts for 374 MXS.
OMAX 55100 machine from Phillips Corporation was procured under contract number FA520917F0170. The Contractor shall perform start-up connection and provide comprehensive training.
Section C: Justification for Soliciting from a Single Source
The equipment is from Phillips Corporation and due to their proprietary rights, installation can only be performed by them. To finalize installation, ensure OMAX waterjet system has been properly installed and tested IAW the agreed-upon specification.
Provide comprehensive training for designated personnel from the owning agency on the operation, maintenance, and safety protocols associated with the OMAX waterjet sytem.
Section D: Efforts to Obtain Competition
As stated Section B above, purchasing of OMAX 55100 was awarded to Phillips Corporation. Start-up connection to include Installation can only be provided by the manufacturer. Due to the nature of the current and future acquisition, consideration to any other vendor solution would result in substantial duplication of the cost to the Government that is not expected to be recovered through competition.
Section E: Steps to Preclude Future Single Source Awards
For future projects that do not require installation services, we can promote competition. However, as explained above, if installation services are required as long as we purchased equipment from the manufacturer, it will likely remain a sole source requirement.
Section F: Contracting Officer's Determination
I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
