About this file

This is a Sole Source (Including Brand Name) Justification for procurement of mold remediation services by the Naval Facilities Engineering Systems Command (NAVFAC) Pacific under simplified acquisition procedures.

The procurement action addresses mold remediation services at Building 258, floors 2 and 3, Makalapa Compound at Joint Base Pearl Harbor Hickam (JBPHH). The contract will be awarded as a firm, fixed price order with a 60-day period of performance from date of award. The government estimate and specific pricing are redacted in the document. The justification supports awarding to a single source contractor who previously performed related mold remediation work on Building 346 under Contract Number N62478-25-P-3600 in FY25. That contractor possesses building-specific knowledge of structural anomalies, ventilation ductwork configurations, moisture entry points, and localized environmental hazards, as well as pre-validated engineering controls, security clearances, and immediate logistical capability. The procurement is justified under 41 U.S.C. 1901 (Simplified Acquisition Procedures) based on unusual and compelling urgency—specifically an active health hazard and mandatory OSHA compliance deadline that would be missed if a new contractor required facility familiarization, diagnostic testing, and baseline assessments. The requirement was not publicized on SAM.gov pursuant to FAR 5.202(a)(2). The contracting officer determined the anticipated price will be fair and reasonable based on comparison with previous purchases. Upon approval, the justification will be made publicly available within 14 days after contract award as required by 10 U.S.C. 2304(1). The document indicates technical cognizance and contracting officer certification dates of June 12, 2026.

SOLE SOURCE (INCLUDING BRAND NAME) JUSTIFICATION

FOR CERTAIN COMMERCIAL PRODUCTS AND SERVICES

April 2025

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY: The Naval Facilities Engineering Systems Command (NAVFAC) Pacific (PAC), the contracting activity is ACQ21 Services, proposes to enter into a sole source contract under simplified procedures for certain commercial products and services.

2. NATURE/DESCRIPTION OF CONTRACT ACTION: This is a sole source justification action for conducted using the procedures of FAR subpart 13.5. The placement of a firm, fixed price order is anticipated.

3. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES: The proposed acquisition is to provide Mold Remediation Services at Building 258 floors 2 and 3, Makalapa Compound Joint Base Pearl Harbor Hickam (JBPHH). The Government Estimate for this contract is and the period of performance for this contract is 60 days from date of award.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION: This action is conducted pursuant to 41 U.S.C 1901 (Simplified Acquisition Procedures).

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACTION REQUIRES USE OF THE

AUTHORITY CITED: successfully performed mold remediation work for Building 346 under Contract Number N62478-25-P-3600 in FY25. Through this recent work, has acquired knowledge of Building 258’s specific structural anomalies, ventilation ductwork configurations, moisture entry points, and localized environmental hazards.

Mold remediation requires highly specialized containment zones, negative pressure air filtration setups, and hazardous material disposal protocols tailored to the facility. Because designed and executed these containment barriers of the same building in FY25, they possess pre-validated engineering controls. Bringing in a new contractor would require entirely new diagnostic testing, structural assessments, and containment planning, which would introduce significant technical risk and redundancy.

Due to the urgent and health hazard of this mold remediation and the past OSHA compliance deadline, it is crucial that the Government execute the remediation and ensure compliance with the mandatory OSHA safety deadline preventing further health risk exposure to NAVFAC PAC employees.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY FAR SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER FAR

5.202 APPLIES: In accordance with FAR 5.202(a)(2), this requirement was not publicized or synopsized on the Government Point of Entry (SAM.gov). The agency’s need is of an unusual and compelling urgency, and the Government would fail to meet a mandatory OSHA compliance deadline and exposing personnel to prolonged health hazards.

This acquisition is for emergency mold remediation services and does not involve the procurement of brand-name supplies or specifications. Therefore, the posting requirements of FAR 5.102(a)(6) are not applicable to this action.

While the Government typically seeks to solicit offers from as many potential sources as is practicable, the immediate health threat posed by active mold in Building 258 dictated a severely compressed timeline.

Because already possesses the requisite security clearances, building-specific safety protocols, and technical familiarity with Building 258, the Contracting Officer determined they were the only practicable source capable of executing the requirement without unacceptable delay. Consequently, solicitation was limited to .

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

IAW FAR 15.404-1, the Contracting Officer determines that the anticipated price will be fair and reasonable based on a comparison of the proposed price with prices found reasonable on recent previous purchases.

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT

CONDUCTED. The market research revealed that while other contractors are able to perform mold remediation, was the only responsible source identified that possessed both the necessary base access credentials and the immediate logistical bandwidth to mobilize by the OSHA deadline.

Awarding to any other source would require unacceptable delays for base access processing and equipment staging, which would result in prolonged exposure of employees to hazardous mold exposures. Therefore, based on the expedited market research, is the only contractor capable of fulfilling the agency's urgent requirement without causing unacceptable delays and increased risk to the Government.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION: Immediate mold remediation at Building 258 is critical to restoring a safe working environment and ensuring compliance with mandatory OSHA health and safety standards. Any delay or disruption in mitigating this biological hazard would result in severe impacts, including prolonged respiratory risks to personnel, potential regulatory penalties, and the disruption of daily operations within the facility. Therefore, a sole-source award to represents the most prudent and advantageous course of action.

immediate availability, coupled with their proven successful performance remediating building 346 of this exact facility in FY25, makes them uniquely positioned to ensure the swift removal of this hazard and safeguard the health and readiness of our personnel.

Furthermore, awarding this contract to any other entity would require complete facility familiarization, invasive structural baseline testing, and the development of entirely new negative-pressure containment plans, all of which would delay the start of remediation and guarantee missing the OSHA deadline. This extended process of site research and mobilization would also result in unacceptable, duplicative costs to the Government—costs that were already mitigated during ’s previous work in the building under N62742-25-P-3600.

Upon approval of this Single Source Determination, the Government will proceed with award to

. This justification shall be made publicly available within 14 days after contract award to satisfy 10 U.S.C. 2304(1).

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION:

N/A

11. A STATEMENT OF ANY ACTIONS THE AGENCY WILL TAKE TO REMOVE OR

OVERCOME ANY FUTURE BARRIERS TO COMPETITION: This project will provide immediate mitigation of the active mold contamination in Building 258 to ensure employee safety and meet the strict OSHA compliance deadline. Once this urgent remediation is complete and the facility is stabilized, the requiring activity will make a determination regarding the long-term structural and HVAC needs of the building. If a follow-on project is required to implement permanent moisture controls, repair structural leaks, or upgrade the HVAC system to prevent future mold growth, a comprehensive specification package will be developed. This subsequent long-term repair project would be competitively procured.
