About this file
This justification and approval document outlines a sole source procurement of education services to support an apprenticeship program. The Naval Facilities Engineering Command Mid-Atlantic seeks to award a contract to Collegiate Consortium for Workforce and Economic Development, as it is the only education resource in the Philadelphia region that can support apprenticeships across various trades requiring educational credits. The services include registering, instructing, billing, and providing materials for apprentices in positions such as mechanics, carpenters, electricians, and plumbers. The period of performance is from August 2023 to August 2024 with options to extend annually for four additional years. The justification cites 10 U.S.C. 2304(c)(1) and FAR 6.302-1 as the authority for this non-competitive procurement, noting Collegiate Consortium is the only source that can provide the flexibility and credits needed to avoid delays in filling critical personnel shortages through this apprenticeship program.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-23-85 July 19, 2023
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. The contracting activity and contracting officer is Naval Facilities Engineering Systems Command, Mid-Atlantic, Norfolk, Virginia (NAVFACSYSCOM).
2. Description of the Action being Approved: Procurement of education services to meet the educational needs of Philadelphia, PA Apprenticeship participants.
3. Description of Supplies/Services. The Contractor shall provide educational services that include registering, delivering, billing, and providing necessary textbooks and equipment for various trade positions at Naval Facilities Engineering Mid-Atlantic Public Works Department in Philadelphia, PA for a base period of 12 months and four 12-month option periods. The education services may be required for air conditioning mechanics, carpenters, electricians, high voltage electricians, automobile mechanics, heavy mobile mechanics, industrial equipment mechanics, pipefitters, and plumbers.
Period of Performance: Requirement shall be awarded by August 11, 2023 for a period of performance to begin August 28, 2023 through August 27, 2024.
4. Statutory Authority Permitting Other than Full and Open Competition. 10 U.S.C. 2304(c)(1);
FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. Contracting without providing for full and open competition under this acquisition may be accomplished pursuant to the authority of 10 U.S.C. 2304(c)(1) of the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. The authority is implemented by FAR Subpart 13.5, Simplified Procedures for Certain Commercial Products and Commercial Services.
5. Rationale Justifying use of Cited Authority. The use of authority cited in Section 4 is deemed appropriate due to the NAVFAC Apprentice Program being an essential tool to fill critical personnel shortages and provide education to NAVFAC personnel. The Command currently meets its educational needs with an augmented education and training program provided by Collegiate Consortium for Work Force and Economic Development. Collegiate Consortium for Work Force and Economic Development is the only education resource in the Philadelphia, Pennsylvania region that has partnerships with several educational institutions to support the Command’s various trades that require educational credits for Apprentice Program participants to obtain certificates and/or Associate Degrees. Collegiate Consortium for Work Force and Economic Development has the capability to provide flexibility required for apprentice
J&A No. ML-23-85 participants to receive classroom instruction and on the job training, while not impeding the immediate needs of the Command. Utilizing Collegiate Consortium for Work Force and Economic Development is required to also maintain the current credits provided to current apprentice participants without compromising current certificate and degree programs. Another educational source would be time and cost prohibitive, resulting in several months to years of delays for the Command to educate and fill critical trade positions required to meet personnel shortages.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. The Justification and Approval will be publicized, pursuant to FAR Subpart 5.2. All responsible sources may submit a quotation, which shall be considered by the agency.
7. Determination of Fair and Reasonable Cost. The Contracting Officer will determine the anticipated cost to the Government for the services covered by this J&A to be fair and reasonable.
8. Actions to Remove Barriers to Future Competition. There are no other requirements for these services at this time. If another potential source emerges, the Government will assess whether competition of future requirements is feasible in accordance with FAR Subpart 5.2 and FAR Part 10.
