JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Curtis Bay Depot Study
Contracting Activity: General Services Administration, Mid-Atlantic Region, Public Building Services, Acquisition Management Division
Estimated Contract Cost: $ 40,627.40
Authority: 1.) FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency Requirements
1. Identification of Agency an Contracting Authority: This document constitutes a justification and approval for the use of other than full and open competition for the acquisition described herein. It is executed on behalf of the General Services Administration, Mid-Atlantic Region, Public Buildings Service, Acquisition Management Division.
2. Nature and/or description of the action being approved: GSA is in need of an environmental engineering servicing firm to provide asbestos abatement studies, the surveying and reporting related to the future disposal, and the sale or transfer of the Curtis Bay Depot Study in Baltimore, Anne Arundel County, Maryland. This project calls for a stand-alone report which gives a description of the current condition of each building, structure or portion thereof remaining on GSA’s property. This report shall also include the site condition and recommendations related to handling of the known amounts of asbestos to prepare the property and its structures for sale or transfer.
3. A description of the acquisition required to meet the agency’s needs (including the estimated value): It is intended that the firm would provide environmental engineering services to support the future sell or transfer of the Curtis Bay Depot. The independent government estimated costs for these services is $40,627.40 and was prepared by Contracting Officer Representative Alex Hiddemen on June 6, 2024.
4. An identification of the statutory authority permitting other than full and open completion: Contracting without providing full and open competition under this acquisition may be accomplished pursuant to the authorities described below:]
(1) 41 USC 253 (c)(1) as implemented by FAR 6.302-1, only one responsible source and no other services will satisfy agency requirements. The A/E firm EA EST. Inc. (EA) successfully completed 4 studies related to abatement, surveying and reporting for the Curtis Bay Depot. Those reports included:

EA has a complete reporting history of the Depot, are extremely familiar with the governments reporting requirements related to the sensitive technical matters of environmental site findings and reporting and have the archive of support reporting documentation to complete a thorough analysis on the current state of the facility. No other surveys or reports have been performed on the site by any other firm since the last report issued by EA in 2018.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: As previously captured in section 4, EA has successfully executed all prior asbestos resurveys and final reports since 2011 for the Depot. EA also has extensive past expertise, knowledge, and experience with the Curtis Bay Depot and have managed several similar projects of size and scope for Region 3. Based on their long-standing reporting and service history related to the Curtis Bay Depot, EA has demonstrated that they are the governments trusted partner in identifying critical environmental matters related to the site and its future preparations for disposal, sale, or transfer. In addition, the selection of EA, to provide environmental engineering services for the Curtis Bay Depot would provide extensive cost savings to the Government and time and level of effort and potential project ramp up.
6. A description of efforts made to ensure that offers are solicited from as many sources as practicable:
Based on EA’s extensive reporting history related to Curtis Bay Depot, and the Federal Government’s environmental reporting requirements dating back to 2011, GSA strongly believes no other firm possesses the level of expertise and first-hand knowledge of Curtis Bay Depot site and no other firm would be inclined take ownership of the requested services in the same manner to consolidate all the findings into a robust analysis or final reporting document to support the future disposal, sale or transfer of the Curtis Bay Depot. GSA determined that having a single source of responsibility for the asbestos abatement surveying and reporting would establish continuity and help to minimize risk. Any other procurement method would result in the selection of an A/E firm with less historical knowledge of the site.
7. A determination by the Contracting Office that the anticipated costs to the Government will be fair and reasonable: Per FAR 36.605 the Government Project Engineer/COR has prepared and provided an Independent Government Estimate (IGE)to the Contracting Officer prior to the receipt of a proposal of any negotiations taking place in the amount of $40,627.40.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted: Market research was not performed because EA already provided four (4) successful reports of the Curtis Bay Depot from 2011 to 2018. The project team is confident that no other environmental engineering firm possesses the level of first-hand expertise or extensive knowledge of the Curtis Bay Depot. Other alternatives were discussed and the reduced knowledge, duplication of effort and costs, and increased risk would not justify pursuing a market survey. Selecting EA for the fifth round of asbestos reports maintains documentation and reporting continuity and saves the Government time and level of effort potentially related to ramp up with another firm.
9. Any order facts supporting the use of other than full and open competition: The Government would recognize savings associated with timing and level of effort because EA has a strong history of knowledge at the Curtis Bay Depot. This firm is the most familiar with the site, as well as the Government requirements associated with the reporting process of the site. Due to the technical requirements of environmental studies, they can immediately start this project since they possess knowledge and all past reporting documentation.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: No firms have been contacted nor have any expressed an interest in writing.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the services required: For future procurements of environmental engineering services GSA will attempt to procure multiple award schedules or available IDIQ contracts.
