About this file
This document is a Justification for Other Than Full and Open Competition for the United States Section of the International Boundary and Water Commission (USIBWC). The agency intends to award a sole source contract to Veolia for continued operation and maintenance (O&M) of the South Bay International Wastewater Treatment Plant (SBIWTP), including a planned expansion from 25 million gallons per day (MGD) to 35 MGD.
The contract requires Veolia to provide full-service O&M of the SBIWTP and associated infrastructure, covering day-to-day plant operations, equipment maintenance, sampling and testing, reporting, and regulatory compliance. The justification for sole source is based on Veolia's current role as the service provider, possessing institutional knowledge, technical expertise, and operational continuity necessary for the expansion. Market research indicates no other vendor can assume responsibility for the expanded capacity within the required timeframe. The procurement is conducted under FAR 6.302-1 authority, with the government determining that awarding the contract to Veolia ensures uninterrupted service and successful implementation of the 10 MGD expansion.

Justification for Other Than Full and Open Competition
1. Description of Action:
The United States Section of the International Boundary and Water Commission (USIBWC) intends to award a contract on a sole source basis to Veolia for the continued operation and maintenance (O&M) of the South Bay International Wastewater Treatment Plant (SBIWTP), including the planned expansion from 25 million gallons per day (MGD) to 35 MGD.
2. Description of Supplies/Services:
The contractor shall provide all labor, materials, supervision, and resources necessary to perform full-service O&M of the SBIWTP and associated infrastructure. This includes day-to-day plant operations, equipment maintenance, sampling and testing, reporting, and compliance with regulatory requirements.
3. Justification for Sole Source:
Veolia is the current service provider for the SBIWTP, which is presently operating at a design capacity of 25 MGD. The planned expansion to 35 MGD is a continuation of the existing scope and requires seamless integration with current operations. Veolia possesses the institutional knowledge, technical expertise, and operational continuity necessary to support the increased capacity without disruption. Transitioning to a new provider would pose significant risks to plant performance, regulatory compliance, and public health.
4. Authority Cited:
This procurement is conducted under the authority of FAR 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Market Research:
Market research indicates that no other vendor currently possesses the operational familiarity, regulatory alignment, and infrastructure access required to assume responsibility for the expanded capacity within the necessary timeframe.
6. Conclusion:
Awarding this contract to Veolia is in the best interest of the government to ensure uninterrupted service, regulatory compliance, and successful implementation of the 10 MGD expansion.
