About this file
This document is a Sole Source Determination & Justification for the Oregon Department of Fish and Wildlife's (ODFW) Marine Resources Program to purchase 40 acoustic telemetry tags, model V9-2x-A69-1602, manufactured by InnovaSea. The purpose is to conduct research on the migratory patterns and daily movements of Yelloweye Rockfish, a species that constrains the catch of other healthy shelf fish stocks. ODFW plans to use a chartered fishing boat to collect the fish, apply the tags, and monitor the data which will be transmitted back via satellite after the tags detach from the fish. This sole source determination is justified due to the need to maintain compatibility with ODFW's existing $200,000 investment in acoustic receiver moorings and the specialized functionality of the InnovaSea tags required for this research project.
The total estimated cost for the 40 InnovaSea tags is $15,500. This sole source determination will remain in effect for up to 5 years to cover the duration of the research project. The contract will be managed by ODFW and will impact the jurisdictions of Lincoln County and Newberg City in Oregon.

SOLE-SOURCE DETERMINATION & JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Contract Services
From: Jonathan Stratton / Leif Rasmuson Date: 2/24/2022
Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:
Description of Goods or Services:
Describe Goods or Services you wish to purchase. Give sufficient details: make, model, manufacturer, part number, quantity, etc.
We want to purchase 40 acoustic telemetry tags. Model V9-2x-A69-1602 tags manufactured by InnovaSea.
Reason for Need:
Describe the background or environment leading to need. Describe what it is that you need:
functionality, outcome, results, unique qualities, expertise, etc.
Yelloweye Rockfish, Sebastes ruberrimus, continue to constrain catch of catch of multiple healthy shelf stocks.
One tool that has been used to manage the take of Yelloweye Rockfish is spatial area management through the establishment of places like Yelloweye Rockfish Conservation Areas. A key aspect of effective spatial fisheries management is an understanding of population connectivity. Highly migratory species ultimately may not receive as much protection from spatial closures if they migrate out of closed areas into fished areas. While many rockfish species characteristically have small home ranges making them effective candidates for spatial fisheries management, more data are needed for Yelloweye Rockfish. To answer this question, the ODFW Marine Fisheries Research Project used standard acoustic telemetry techniques, tagged Yelloweye Rockfish in 2005, 2012 and 2013 to understand home range size (Rankin 2019). In all of these studies, the researchers found that some Yelloweye remained in the acoustic array at Stonewall Bank and had a small home range while others left only to return 6+ months later. They also found that some individuals moved up into the water column for a few hours each day before descending back to the bottom. The goal of the proposed project is to understand 1) where do these other Yelloweye Rockfish travel 2) to ascertain if only certain sexes or sizes of fish make these perceived large scale movements and 3) understand the daily movement dynamics of the species.
While standard acoustic telemetry methods often work well for species with small home ranges they are not effective for species that make large movements. Further, standard passive tags aren’t effective when a species is not actively targeted in fisheries. Pop-up satellite tags are an effective tool for this kind of study and have been proven to be effective at monitoring the movement of Rockfish (Rodgveller et al. 2017). We propose to use a chartered fishing boat (paid for with dedicated research funds) to collect Yelloweye Rockfish at Stonewall Bank using hook and line gear. A small fin clip will be collected from the fish to provide both population genetics and sex data. These fish will then be recompressed in barrels for 24 hours on the seafloor. Doing so minimizes the effects of barotrauma on the fish during subsequent tagging. After 24 hours the fish will be recovered, tagged with Desert Star SeaTag-Mod tags and released. Tags will be set to release after 3 months at which point they broadcast their data to a satellite and back to the office. When tags indicate they have popped off the fish we will also go out on a boat and attempt to recover the tag using a directional listening device in order to hopefully obtain the much higher resolution data only located on the tag. Regardless which data we use, these data we will provide, at minimum, location data where the tag popped off (ideally more) and extensive data on the daily movement dynamics of the fish. These data will provide insight into the inter-reef movement of this important constraining species as well as insight into the daily behavior of the species.
Although we argue standard telemetry aren’t ideal for this project satellite tag location error high.
Therefore we intend to use these tags to validate location observations from our satellite tags. We can then use these additional data to correct the geomagnetic data from the satellite tags using high resolution geomagnetic data from Oregon State University’s geology department.
Single of Multiple Purchases:
Specify if this justification is for a single purchase or multiple purchases.
This single purchase is expected to carry the program until the end of the project.
Estimated Cost:
Total estimated dollar value of the purchase or contract.
$15,500
Research Leading to Determination:
Describe the Market Research that was conducted that supports the sole source purchase of the requested product or service.
Market Research should include the following:
• Source of the information - Internet search, trade journals, other governmental agencies, professional organizations, catalogs/industrial periodicals, etc.
• Supporting Documentation - Attach documentation or include information obtained showing comparisons of similar products or services available. List mandatory need vs capabilities and functionality of products or services researched proving that the requested product or service provider is the only product or service provider that can meet your minimum requirements.
• Compatibility - Describe any compatibility issues or requirements to maintain efficient utilization with existing equipment or continuation of consistent services (ex:
research or studies that build on previous results - consistency in study and evaluation methods).
The need is a compatibility issue. We have already invested large amounts of money into existing receivers and moorings.
Standard acoustic telemetry data require acoustic receivers and moorings to operate. The ODFW Marine Fisheries Research Project has already invested ~$200,000 into these moorings and receivers.
Rather than invest in new moorings and receivers we hope to purchase tags that can already work with the equipment we have.
Analysis of Research / Findings of Fact:
Pursuant to OAR 125-247-0275(2)(a): Compatibility.
Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.
Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.
Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
Attach letter from the product manufacturer stating they are the manufacturer/seller of the product and have no resellers, or that they are the authorized reseller for the area in which the purchase will be made. (Note: if the product is available through multiple resellers, we can get competition between resellers.)
