About this file
This document is a Sole-Source Determination & Justification form submitted by the Oregon Department of Fish and Wildlife (ODFW) to justify a non-competitive procurement of temperature data logging equipment. ODFW is requesting authorization to purchase 200 HOBO MX TidbiT 400 data loggers manufactured exclusively by Onset Computer Corporation. The procurement is necessitated by ODFW's receipt of legislative resources during the 2022 short session to support drought resiliency initiatives, specifically the identification of coldwater refugia areas through field validation using data loggers installed at tributary junctions. The equipment is critical to the agency's research timeline and deliverables, which include the production of coldwater refugia maps. The determination was submitted on June 9, 2022, and approved by April Brenden-Locke, DPO, on June 29, 2022.
The estimated cost for this single purchase of 200 data loggers is $23,630.00. The sole-source justification is based on multiple factors, including compatibility with ODFW's existing infrastructure and software systems—all current data loggers owned by ODFW are HOBO brand, and analysis codes are developed specifically for HOBO data file formats, making conversion to alternative products cost-prohibitive and operationally inefficient. Research identified BlueMaestro as the closest alternative product; however, it lacks sufficient memory capacity and battery life for the agency's research requirements and is manufactured overseas. The manufacturer has provided written confirmation of exclusive manufacturing rights and warranty services. The procurement aligns with Oregon Revised Statute 279B.075 and Oregon Administrative Rule 125-247-0275 criteria for sole-source acquisitions.

SOLE-SOURCE DETERMINATION & JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Contract Services
From: Chandra Ferrari Date: 06/09/2022
Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:
Description of Goods or Services:
Request to purchase 200 HOBO MX TidbiT 400 manufactured by Onset Computer Corporation.
Reason for Need:
ODFW received resources in the 2022 legislative short session to further actions to improve drought resiliency. One action is the identification of coldwater refugia areas. Critical to this task, is the field validation of desktop analysis through installation of numerous data loggers at tributary junctions.
Given the relatively short time frame to collect data with short session resources, the importance of the final product (coldwater refugia maps) and the amount of resources that can be expended on this function, it is critical that we can secure temperature data loggers that are accurate, reliable and cost-effective. HOBO temperature data loggers are solely manufactured through Onset Computer Corporation.
Single of Multiple Purchases:
This is for a single purchase of 200 loggers.
Estimated Cost:
23,630.00
Research Leading to Determination:
Through an internet search and outreach to other governmental agencies, we have determined that there is not a comparable product and very few similar products. BlueMaestro is the closest alternative identified. However, the memory capacity and battery life of the BlueMaestro are insufficient for our research purposes. Additionally, it’s made overseas.
Additionally, to my knowledge, all existing data loggers owned by ODFW are also made by HOBO. Our analysis codes are all developed for HOBO data files and it would be an inconvenience to re-develop the code for new logger data formats.
Analysis of Research / Findings of Fact:
Pursuant to OAR 125-247-0275(2)(a): Compatibility.
All existing data loggers owned by ODFW are made by HOBO. Our analysis codes are all developed for HOBO data files and it would be an inconvenience to re-develop the code for new logger data formats.
Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.
Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.
Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
A letter is attached from the product manufacturer stating that they are sole manufacturer of the product and offer exclusive warranty services.
