About this file
This document is a Sole Source Determination & Justification for the purchase of 5,000 Biomark Passive Integrated Transponder (PIT) APT12 tags for an ongoing fish monitoring project conducted by the Oregon Department of Fish and Wildlife. The tags will be used to track the migration patterns and localized movements of Spring Chinook Salmon and summer steelhead smolts released in the Upper Deschutes Basin. The tags must be compatible with the existing Biomark PIT tag antenna network used to monitor juvenile and adult salmon and steelhead at locations such as Opal Springs Dam, the Selective Water Withdrawal tower, and Pelton Fish Trap. The total estimated cost for the purchase is $13,000, and the tags must be received by December 31, 2021.
The justification cites the requirement for the PIT tags to be compatible with the existing Biomark PIT tag monitoring network, as well as the proprietary and unique nature of the tag coding and interrogation system. Biomark is the only supplier that can provide the specific PIT tags required to be detected by the existing PIT tag monitoring equipment operated and maintained by Portland General Electric and Deschutes Valley Water District.

SOLE-SOURCE DETERMINATION & JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Contract Services
From: Gerald George Date:11/19/21
Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:
Description of Goods or Services:
Biomark Passive Integrate Transponder (PIT) APT12 tags. Tags measuring 12.5 mm in length and
2.03 mm in diameter and designed specifically for subcutaneous or intramuscular implantation in animals, including fish. Tags must be ISO 11784/11785 FDX-B compliant and able to be detected by FDX Biomark handheld readers and interrogation antennas. Tags operate on a excitation frequency of
134.2 kHz ±1.5 kHz and emit a unique identification numbers detected by Biomark readers to identify induvial fish. The read speed must be 18 reads/second (ISO rate) / 32 reads/second (continuous) an error rate of less than 1 in 106 reads (within valid reading zone). Tags must come pre-loaded in sterile single use needles. Quantity 5,000 tags manufactured and received by December 31, 2021.
Reason for Need:
PIT tags will be used for an ongoing monitoring project to track the migration patterns and localized movements of individual Spring Chinook Salmon and summer steelhead smolts released in the Upper Deschutes Basin to determine fish movement patterns, the percent of fish from release groups reaching the Selective Water Withdrawal tower and other locations with FDX tag readers. PIT tags need to be compatible with existing the Biomark PIT tag antenna network being used to monitor of juvenile and adult salmon and steelhead at locations in the basin including but not limited to Opal Springs Dam, the SWW, and Pelton Fish Trap.
Single of Multiple Purchases:
Single purchase (made annually for ongoing monitoring) for PIT tag monitoring study to be conducted in spring 2022.
Estimated Cost:
$13,000
Research Leading to Determination:
It is mandatory that PIT tag transmissions are detected and properly coded by existing Biomark PIT tag handheld readers and antenna interrogation systems in the monitoring network. Other vendors cannot provide compatible, unique, coded PIT sterile, single-use needle tags, of the exact specifications needed to be detected by the existing FDX Biomark network. The tags code/frequency and interrogation system combination used by this vendor are proprietary and unique.
The equipment used for this study will utilize an existing PIT tag network operated and maintained by Portland General Electric and Deschutes Valley Water District. Equipment needs to operate on frequencies and read ranges that are compatible with existing readers, antennas, and receivers.
Studies must also use Biomark PIT tags to ensure sufficient detection range and be comparable/compatible with previous and ongoing studies associated with Pelton Round Butte smolt monitoring.
Analysis of Research / Findings of Fact:
Pursuant to OAR 125-247-0275(2)(a): Compatibility.
This purchase will add to an existing PIT tag monitoring study that utilizes Biomark PIT tags and Biomark readers and receivers. To be compatible with existing equipment, radio tags must be able to be detected by the existing radio telemetry receiver network and interrogation frequency of 134.2 kHz ±1.5.
Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.
Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.
Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
Biomark is the only supplier that sells PIT tags that meet the described specifications herein, and are able to be detected by the existing PIT tag monitoring network.
