About this file
This document is a Sole Source Determination and Justification Request from the Oregon State Marine Board (OSMB) for the procurement of survey equipment and related training. The OSMB's existing survey equipment, purchased in 2015, is nearly 10 years old and is experiencing issues with the GPS component, requiring replacement. The total cost for the new GPS equipment, RTS servicing, and customized training for 5 students over 5 days is $44,212.50. The OSMB has determined that Topcon Solutions, Inc., the sole Oregon supplier for this equipment, is the only viable option due to the need for compatibility with the existing Robotic Total Station (RTS) and data collector. Utilizing the Topcon equipment will ensure efficient utilization of the agency's existing survey assets and avoid the substantial cost of replacing the RTS.

Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275
Part A
1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)
2. Estimated Total Value of Contract: $44,212.50
3. Subject of Contract: Survey Equipment and Related Training
4. Background:
OSMB’s existing survey equipment was purchased in 2015 and is nearly 10-years old. The GPS portion of the system has become problematic often having difficulty connecting in the field requiring additional time and cannot be upgraded to improve functionality. The cost to replace this portion is $35,955.50 from Topcon Solutions, Inc..
We have also asked for some customized training on the new GPS equipment and some additional AutoCAD Training. This costs $7,675 for 5 students over 5 days. We are also going to have the RTS serviced for $582.
The total cost of everything is $44,212.50.
5. Findings:
A. Market Research Overall Finding.
There is only one Oregon supplier for the equipment, Topcon Solutions Inc., with the next closest being in Tacoma, Washington.

B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:
1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
This equipment is compatible with all of OSMB’s other survey equipment. The new GPS equipment will used with our Robotic Total Station (RTS) and recently replaced data collector.
If we were going to replace the RTS it would cost an additional $25,000-$40,000. However, the RTS is working well and does not need to be replaced for a few years. The GPS survey equipment must be compatible with our existing RTS equipment, which is why we believe this is a sole source procurement.
2. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
NOT APPLICABLE
3. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
NOT APPLICABLE
4. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of: unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
Working directly with the Oregon supplier makes equipment maintenance and servicing convenient to drop off and pick up and will not require out of state travel or very expensive shipping and package insurance.
