About this file
This is a Sole-Source Determination and Justification document prepared by the Oregon Department of Fish and Wildlife (ODFW) for a procurement under Oregon Revised Statute 279B.075 and Oregon Administrative Rule 125-247-0275. The project involves investigating the survival of salmon smolts released from Rock Creek Hatchery on the North Umpqua River during the 2025-2027 biennium using acoustic telemetry technology. ODFW has determined that Advanced Telemetry Systems, Inc. is the sole source provider capable of supplying the required JSATS (Juvenile Salmon Acoustic Telemetry System) tags and receivers. The JSATS tags are essential for this project due to their small injectable format, suitable battery life, and high detection probability in large river systems. Market research conducted in spring 2026 evaluated alternative acoustic and radio-frequency telemetry systems from vendors including Innovasea and Biomark; however, only the JSATS tags from Advanced Telemetry Systems met the biological constraints of fish size, tag burden, and tagging methodology requirements necessary to produce healthy, tagged smolts that effectively replicate the behavior of untagged populations.
The estimated total value of this sole-source procurement is $116,000 for a single purchase. ODFW determined that JSATS tags are the only viable tagging technology for the Umpqua Basin study because alternative methods such as PIT tags and coded wire tags lack adequate detection frameworks in the basin and insufficient detectability in the river system. Advanced Telemetry Systems holds exclusive manufacturing rights to the SS400, SS300, and Eel Lamprey Acoustic Tag products under a licensing agreement with the Pacific Northwest National Laboratory. The injectable format of JSATS tags is mandatory given the in-hatchery tagging time requirements and the legislative funding mandate to complete this project within the specified timeframe. The Sole-Source Determination was dated August 6, 2026, and was approved by April Brenden-Locke, ODFW's Designated Procurement Officer, on August 11, 2026.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION FOR

RE: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275
CSR: CSR Umpqua Basin Salmon Smolt Survival
Part A
1. Authority to enter into a Sole-Source Contract: ORS 279B.075 and OAR 125-246- 0170(2)(c)(H)
2. Estimated Total Value of the Procurement: $116,000
3.Single or Multiple Purchases: Single
4. Background:
ODFW has been tasked by Legislative funding for only the 25-27 Biennium to investigate survival of salmon smolts released from Rock Creek Hatchery on the North Umpqua River.
Project partners have determined that use of acoustic telemetry tags is the only feasible way to measure juvenile salmon survival post-release in this river system in the allotted timeframe.
5. Findings:
We identified that Advanced Telemetry Systems, Inc. is the sole-source provider of the SS400, SS300, and Eel Lamprey Acoustic Tag (ELAT) Acoustic Juvenile Salmon Acoustic Telemetry System (JSATS) tags. ATS holds exclusive rights to manufacture these products under a licensing agreement with the Pacific Northwest National Laboratory (PNNL). Only JSATS tags meet required size, power output, and detection sensitivity for this river system.
There is no passive integrated transponder (PIT) tag or coded wire tag (CWT) detection and
Sole-Source Determination_rev01-31-24 Page 2 of 3 recovery framework in place in the Umpqua Basin, so neither of those commonly used tags can meet our project needs. JSATS tags and receivers are available on a suitable timescale to successfully accomplish this project, and the in-hatchery tagging time requirements necessitate the injectable format JSATS tags; which only ATS can provide.
A. Market Research Overall Finding.
We evaluated various vendor sources for acoustic telemetry tags, and identified that the Advanced Telemetry Systems JSATS tags and associated receivers gave us the highest probability of success in meeting legislative funding deliverables. ODFW conducted market research during spring 2026 to identify all manufacturers, distributors, and research institutions capable of supplying acoustic telemetry tags suitable for the Umpqua Basin Salmon Smolt Survival study . The research included online review of available acoustic telemetry technologies, and analysis of alternative tagging systems. ODFW evaluated commercially available acoustic and radio-frequency telemetry systems from multiple known vendors in fisheries research, including but not limited to: Innovasea, Biomark, Advanced Telemetry Systems. The size and injectable design of the JSATS tags from Advanced Telemetry Systems were the only technology compatible with our study needs.

B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:
1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
Not applicable.
2. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
Not applicable.
3. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
Not applicable.
4. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of: unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
Sole-Source Determination_rev01-31-24 Page 3 of 3
Concurrent with the attached sole-source attestation from Advanced Telemetry Systems, we identified that only the JSATS tagging system, which is only available from ATS, was the only reasonable tagging technology application for this project. The small size, battery life and injectable design of the JSATS tags make them different from other acoustic technologies.
These tags are specifically designed for tagging small juvenile salmon and are the only ones that will meet our biological constraints of fish size, tag burden, rapid and suture-less tagging techniques to produce healthy, tagged smolts that effectively mimic the un-tagged population and have acoustic tags with high detection probability in a large river system. PIT tags would not be sufficiently detectable in the Umpqua River basin.
Part B - Conditions of Approval will be inserted by ODFW-DPO.
