About this file
This document is a compilation of contract terms and conditions clauses for commercial products and commercial services solicitations under Federal Acquisition Regulation (FAR) Part 12. The document consists primarily of standard FAR clauses incorporated by reference that govern contractor compliance with federal laws, regulations, and executive orders, along with evaluation criteria and administrative requirements.
The solicitation establishes evaluation criteria prioritizing price as best value, acceptable specification/proposal compliance, past performance from CPARS/FAPIIS, and the Contracting Officer's personal knowledge of contractor history. Key mandatory compliance requirements include prohibitions on Kaspersky Lab products, certain telecommunications equipment, ByteDance applications, and contracting with inverted domestic corporations. The contractor must comply with numerous labor and employment standards including Service Contract Labor Standards (52.222-41), equal opportunity provisions, whistleblower protections, combating trafficking in persons, employment eligibility verification, minimum wage requirements under Executive Order 14026, and paid sick leave provisions. Additional requirements address small business utilization, Buy American provisions for supplies, ethics and conduct standards, and data rights. Payment must be submitted electronically through the Department of Treasury's Invoice Processing Platform (IPP) with copies sent to chantal_bashizi@fws.gov. The contract incorporates option clauses for extending service performance up to six months and extending contract terms, with termination for convenience and default provisions included. This is a template of standard commercial contract terms rather than a specific solicitation with defined deliverables, response deadlines, or pricing information.
