PERFORMANCE WORK STATEMENT (PWS)

Lahontan Basin Area Office (LBAO) Marble Bluff Hoist Maintenance and Inspection

January 2025

1. BACKGROUND

Marble Bluff Dam was constructed in 1975 and functions to halt erosion within the Pyramid Lake Paiute Tribe Reservation as well as control water used by the Pyramid Lake Fishway. The dam is located on the Truckee River, approximately 50 miles downstream of Reno, Nevada and approximately 3 miles upstream of Pyramid Lake (Figure 1). The dam is a zoned earthfill structure with a height of 22 feet, a crest length of 1,622 feet, and has a capacity of 22,000 cubic feet per second (cfs) through the spillway.

Marble Bluff Dam also includes a sluiceway that has a capacity of 7,500 cfs and includes an 8-foot-wide operating deck from which the 20-foot by 12-foot radial gate is operated.

The U.S. Fish and Wildlife Service (FWS) in conjunction with the Lahontan Basin Area Office (LBAO) staff operate and maintain the facility, respectively. Marble Bluff Dam includes a Fish Passage Facility feature that allows for the safe transport of endangered Cui-ui fish and the threatened Lahontan Cutthroat Trout (LCT) fish species, which are both native to the Truckee River and Pyramid Lake. The Fish Facility includes a fish lock system, consisting of the fish lock entrance channel, fish lock, and fish lock exit channel, all used to assist in mobilizing the Cui-ui and LCT fish species upstream of the dam. LBAO is required to complete annual maintenance on the dam and Fish Passage Facility to ensure reliable operations for the duration of the fish passage season.

2. SCOPE

This PWS describes the tasks (section 6), requirements (section 7), constraints and risks (section 8), and deliverables (section 9) needed to successfully fulfill the hoist maintenance and inspection purchase order.

There are three hoists located at Marble Bluff Dam Fish Passage Facility, as follows:

• One 15-ton Black Bear BEW1900293, PUIH-1500, 60Hz, 460VAC hoist

11. PERFORMANCE ASSESSMENT AND DISINCENTIVES

(a) Monitoring Performance. During the course of the evaluation period, the COR will track Contractor performance. Interim (mid-term) evaluations may be provided to identify strengths and weaknesses in the Contractor's performance during the period being evaluated. At the end of the period, the COR will assess the Contractor's performance in accordance with the Quality Assurance Surveillance Plan (QASP) and report to the Contracting Officer.

(b) Contractor Self-Assessment. Following each evaluation period, the Contractor may provide a written self-assessment of its performance to the COR to be considered in its report to the Contracting Officer.

The self-assessment shall be submitted not later than 5 working days after the end of each evaluation period. The self-evaluation shall not exceed 1 page per PRS element. The self-assessment shall address both the strengths and weaknesses of the Contractor's performance during the evaluation period. Where deficiencies in performance are noted, the Contractor shall describe the actions planned or taken to correct such deficiencies and avoid their recurrence. The self-assessment itself will NOT be the basis for the Disincentives determination.

(c) COR Recommendation. The COR will consider all evaluations and any other pertinent information, including Contractor self-assessment, and will prepare a report to the Contracting Officer with findings and recommendations. The Contractor will be provided a copy of the draft findings and recommendations of the COR and will be afforded the opportunity to identify factual errors. The COR's draft recommendation is not subject to negotiation and the COR will not engage in discussions with the Contractor. Any errors identified by the Contractor will be addressed by the COR in its final report. The Contractor will be provided a copy of the final COR report at the same time the report is submitted to the Contracting Officer.

(d) Invoicing. The Contractor shall submit one copy of all payment invoices, with the appropriate backup documents to the COR. The COR will determine if the invoice is complete and proper as submitted. The COR also will determine if billed services have been satisfactorily performed and if expenses billed are correct. If it is determined that the amount billed is incorrect, the COR will, within seven days, request the Contractor to submit a revised invoice. The Contractor shall specifically identify his invoice “Final Invoice.” The Final invoice shall include the remaining payment claimed to be due under the basic contract and all modifications issued, if any.

(e) The Quality Assurance Surveillance Plan is one evaluation method the government uses to surveillance performance to determine whether the Contractor meets the standards of performance as defined in the PWS. The absence of a QASP for any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the government under any other provision of the contract in determining the quality of the Contractor performance.
