(a) The solicitation, or amended solicitation, provides a different definition;
(b) The contracting parties agree to a different definition;
(c) The part, subpart, or section of the FAR where the provision or clause is prescribed provides a different meaning;
(d) The word or term is defined in FAR part 31, for use in the cost principles and procedures; or

(End of clause)
52.212-2, Evaluation — Commercial Products and Commercial Services (Nov 2021
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers: SEE AWARD SELECTION PROCESS section
i. Price;
ii. Technical;
iii. Prior Experience
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
AWARD SELECTION PROCESS
Award will be made in accordance with FAR Part 13 to the offeror that provides the best value to the government based on price, technical, prior experience, and past performance. Per FAR Part 13.106-2(b) evaluation will be conducted by comparative evaluation of offerors and all factors are of equal importance.
1. Price: The total price for all options will be added to the total price for the basic requirement. This combined total price will then be evaluated for fairness and reasonableness
2. Technical: Technical: The Technical Narrative provided will be evaluated to determine if the offeror’s technical capability meets the Government’s stated requirements. Complete the project narrative – please see “TO SUBMIT AN OFFER” section for details on which to submit for this requirement.
3. Prior Experience: Evaluated to determine acceptable relative prior experience based on submitted prior projects similar in scope and complexity. Consistent with FAR 13.106-2(b)(3), the Contracting Officer may but is not required to also use their own knowledge of an offeror’s previous experience, may consult the information from CPARS to verify actual relevance.
https://www.acquisition.gov/far/part-2#FAR_2_101 https://www.acquisition.gov/far/part-31#FAR_Part_31 https://www.acquisition.gov/far/part-1#FAR_1_109 https://www.acquisition.gov/far/part-1#FAR_1_109
Evaluation Factors: The following are the Factors the government will use to evaluate proposals:
Factor 1: Technical Approach
The technical proposal should clearly describe the offeror's proposed approach to performing the requirement as detailed in the solicitation, scope of work, and its included attachments. It should clearly indicate which work is self-performed and which work is to be subcontracted. Please note that IAW FAR clause 52.219-14, contractors are advised that there is a 50% limitation on subcontracting percentage that will apply to this acquisition.
The technical proposal should also identify which equipment will be used in performance of this project and include a draft project schedule. The technical approach also includes offeror's proposed approach to managing the offeror’s employees, as well as any subcontractors and subcontractor employees, to promote timely performance, quality of performance, and customer satisfaction throughout contract performance. This section should also include the offerors company Construction Safety Program and a narrative discussion of its assessment of the safety risks associated with the work, including any changes it would make to its company to address its assessment of the project risk on the base contract. Finally, the proposals should identify key personnel who will serve in management positions throughout the project. Offerors may submit résumés for key personnel.
Factor 2: Prior Experience
The offeror shall submit a minimum of three (3), but no more than five (5) relevant examples of prior experience that are no more than five (5) years old. Please include contact information for each example.
Factor 3: PRICE: The Government will evaluate each offeror's Total Evaluated Price submitted in Volume IV
(‘Attachment #4 - Pricing Spreadsheet’) for reasonableness and balance as discussed in the following paragraphs
(i), (ii) and (iii). Offerors are advised to review all data items to ensure that they are proposing to the specific data requirements and level of effort involved. Reasonableness: The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis techniques may be used to further validate price reasonableness.
Unbalanced Pricing: Unbalanced pricing exists when the price of one or more Contract Line Items is Significantly
Overstated or Understated due to an illogical progression of unit prices from program year to program year, unit prices that do not consider quantity variations, or front-loading CLINs that do not represent the true cost of that
CLIN. The definition of "Front- Loading" is to concentrate costs in an early period. Front-Loading will be viewed as materially unbalanced since acceptance of the proposal would result in an advance payment. The Government will analyze the proposed prices to determine whether there are unbalanced separately priced line items or sub-line items. Prices submitted will be compared and evaluated to assure that a logical progression exists as related to price and quantity changes within each offeror's response to the pricing structure in the Schedule. Offerors are cautioned against submitting an offer that contains unbalanced pricing; offers that are determined to be unbalanced may be rejected if it is determined the lack of balance poses an unacceptable risk to the Government.
Total Evaluated Price (TEP): Prices shall be proposed on Attachment #6 ('Attachment #6 – Pricing Spreadsheet') per instructions in Section L. All unit prices should be rounded to the nearest whole dollar. The TEP will be calculated based by combining the total price for each CLIN proposed for the basic requirements (basic award) and all (if any) options.
BASIS FOR AWARD
The combined synopsis / solicitation and resulting award will be conducted under FAR Part 12 – Commercial
Items, procurement using FAR 13.5 Simplified Procedures for Certain Commercial Products and Commercial
Services and evaluate the proposals using Per FAR Part 13.106-2(b) to conduct a comparative evaluation of
Vendors. The award factors used in this combined synopsis / solicitation are of equal value IAW (FAR 13.106-
1(a)(2)).
The Government intends to award one firm fixed price because of this combined synopsis / solicitation. Offerors are advised that IAW FAR 52.219-14 the Contracting Officer shall review each offerors proposal for compliance with the Limitation Percentage for this service. If an offeror’s proposal indicates self-performance and subcontracting to similarly situated subcontractors that are below the minimum, then the Contracting Officer will reject the proposal as non-compliant and ineligible for an award.
