B.1 PRICE SCHEDULE

The Contractor shall furnish all labor, equipment, materials, and incidentals necessary to satisfy the requirements of this solicitation. A single award is anticipated for a Firm Fixed Price contract.

Offerors are required to fill out the attached Pricing Sheet, as referenced in Section J, pg. 18. The Pricing Sheet will be used to determine fair and reasonable pricing against current market rates, independent government estimates, and competitive pricing from other Offerors. The Pricing Sheet alone does not take the place of the Offeror’s quote and breakdown of pricing, however must be in accordance with pricing pertaining to the offer.

SECTION C – Description and Specifications

C.1 SCOPE OF WORK

The Contractor shall furnish the necessary personnel, materials, equipment, and services as necessary to successfully complete the Scope of Work as follows:

HAZARDOUS TREE AND VEGETATION REMOVAL

Yosemite National Park

SCOPE

National Park Service (NPS), Yosemite National Park Facilities Maintenance Division, is seeking quotes for hazardous tree and vegetation removal along 3/4 miles of distribution power lines. This contract will help provide crucial assistance in maintaining vegetation clearance around overhead power lines, increase the reliability of crucial park infrastructure, and help reduce fire hazards.

This work shall take place within Yosemite National Park. The 3/4 miles of 12KV (Kilovolts) distribution line runs overhead from the south side of the Wawona Tunnel on Highway 41 down to the Yosemite powerhouse alongside Highway 140 across the river. Elevations in this area range from 2,000 feet to 5,000 feet. This location is considered an “extreme” fire danger area.

This distribution circuit supplies power to the Wawona Tunnel (lights, signage, air circulation, etc.) as well as the critical infrastructure located at Turtleback. The terrain under this line is steep and roadless.

The circuit consists of approximately 3/4-mile of three-strand conductor supported by structures.

Significant vegetation efforts have not been performed in many years along this circuit. Trees, both hazard and green, fall within standard clearance zones around the lines and structures. Brush and ground cover extend below the distribution circuit.

Work should be anticipated to begin late fall 2021 (date to be determined due to fire season) and be completed no later than March 1, 2021. Location is subject to snow and winter mountain driving conditions and may have restrictions during seasonal times due to wildlife impacts. These areas can be very remote from local services including supplies, materials, hotels, and limited cellular service. The terrain is steep, overgrown, and rocky. Vegetation includes, but is not limited to, trees such as fir, pine, oak Manzanita, Poison Oak, Scrub Oak and Chaparral.

WORK REQUIREMENTS

The contractor shall work in and around energized distribution lines. Qualified Line Clearance Arborist (QLCA) certification is required. The contractor is required to adhere to all standards, codes and regulations applicable to the Federal Energy Regulatory Commission (FERC), California Public Utilities Commission (CPUC), Occupational Safety and Health Administration (OSHA), or any other required standards applicable to working in and around energized electrical distribution lines.

It is anticipated that work will be completed without the removal of the distribution electrical power lines.

TASKS

Contractor shall provide all required personnel, tools, equipment, fuel, (PPE) personal protective equipment, safety plans, traffic plans, or any and all required needs, material or otherwise to complete any and all tasks in this contract. This may include 2-way radios for communication to crew members;

cellular service is limited to non-existent in this location.

1. Vegetation removal marked with pink flagging with a 24-foot zone clearance.

(a) Remove all vegetation 12 foot out from center pole that is 12 feet or less from under the electrical distribution lines.

(b) Total line is 3/4 of a mile

(c) 24-foot zone (12 feet from center pole in each direction); see Attachment 3, Clearance.

(d) Vegetation includes anything with a Diameter at Breast Height (DBH) of 4 feet or under.

2. Remove or trim dead, dying, and defective trees marked with white paint. See attachment 2, Tree

Identification, for identified trees for trimming or removal.

(a) 57 identified trees for removal are labeled in the field with white paint

(b) 3 identified trees for trimming are labeled in the field with white paint; reference Attachment 2, trees #24, #44, and #53 marked as “TRIM.”

3. Contractor shall identify any tree, not currently identified on Attachment 2, that may pose a threat of failure to the electrical distribution line. This shall include, species, specific location (towers/spans), identify if live/dead/leaning/encroaching limbs, and identify DBH and R Factor (tree height). Once identified, this shall be submitted to the Contracting Officer’s Representative (COR) for review and approval prior to any work being done.

Tree/Vegetation/Brushing, Cutting, Trimming, and Felling

The project will remove all trees with trunks falling in a 24-foot zone centered on the circuit alignment. Trees with trunks falling outside this zone, but with branches inside the clearance area shall be for trimmed. Trees that cannot be successfully trimmed will be removed.

Hazard trees with the potential to impact the circuit will be removed regardless of distance from the circuit. Non-hazard trees outside the clearance zone will remain.

Downed trees will be lopped and scattered with all limbs removed. Felled trees shall be left in a manner which prevents them from rolling downhill.

Brush under the power lines extending into a 12-foot clearance zone from the conductors will be trimmed. Brush further than 12-feet from the conductors will remain in place. The 12-foot clearance zone is the current PG&E standard for distribution circuits conveying between 2.4kV and 72kV.

Ground cover will remain in place. Ground cover removal to the dirt is not required.

No helicopter efforts are anticipated. All efforts will be ground based with crews hiking in each day.

Contractor provided traffic control shall be required if the possibility of lose debris or other hazards impacting the adjacent highway are possible. Contractor shall evaluate risk and provide assessment and recommendations to NPS. Contractor shall submit a traffic control plan to COR for NPS approval prior to any traffic control operations.

Tree/Vegetation Removal and Disposal

All brushing/slash may be left on the ground and is not be required to be chipped in place or removed from the job location.

Brush/slash shall not be stacked in a “fire wall” manner or left directly below any power line.

Intermittent piles no larger than 4 ft x 4 ft on the downhill side of the distribution lines are acceptable.

Brush/slash plies shall not be left in or around electrical towers.

No burning of these piles will be permitted.

Downed trees shall be left in a safe (felled) manner and shall be perpendicular to any slopes.

All trees felled shall be left delimbed with all tree limbs stacked in piles no bigger than

4ft X 4ft

LOCATION

Location of work is within Yosemite National Park on the south side of the Wawona Tunnel on Highway 41, down to the Yosemite powerhouse alongside Highway 140, across the river. Location is steep and roadless. There are approximately eight (8) electrical distribution structures within the 3/4-mile work location.

SITE VISIT

A one day only site visit will be held on Wednesday, June 16, 2021 at 0900 Pacific Time. Further information regarding the site visit is located in Section L (pg. 37).

PARK REGULATIONS AND SPECIAL RESTRICTIONS

Yosemite National Park rules and regulations are to be observed at all times. Failure to do so may be subject to applicable fines. In addition, the following shall be observed:

Use of aircraft or aerial equipment, including but not limited to, helicopters, drones, etc., must be requested in advance to the Contracting Officer’s Representative (COR) and/or Contracting Officer (CO). Only by written approval from the NPS will use be allowed.

This is a Peregrine Falcon nesting area. No work shall be performed in this area from the periods of March 1st through July 15th, unless notified in writing by the COR or CO.

This area contains protected and/or rare plant species that will be identified and marked by NPS botanists prior to work issuance; these plants shall be avoided by the contractor and left undisturbed.

A 45-foot length restriction and one-way controlled traffic for all vehicles 20 miles east of Mariposa on Hwy 140 exists; see Caltrans website http://www.dot.ca.gov/ for further details.

Alternate routes are available.

GOVERNMENT FURNISHED PROPERTY

None

STAGING AREA

An area located in a turnout on Highway 41 at the south end of the Wawona Tunnel may be coned off by contractor to staging vehicles and equipment. Contractor must leave access at all times for NPS vehicles to service the generator at this location.

SECURITY

It is the responsibility of the Contractor to secure equipment and property. A secured location will not be provided by the Government.

PERIOD OF PERFORMANCE

Period of performance is from time of award to March 1, 2022. Field work is anticipated to begin late fall 2021, dependent upon fire season or conditions. Actual work shall be scheduled and coordinated between the NPS and Contractor.

SECTION G – Contract Administration Data

G.1 1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph

(e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph

(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

G.3 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE

PROCESSING PLATFORM (IPP) (APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: Contractor’s invoice with description of goods or services billing for, to include date and/or period of performance, and invoice number.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. (d) Comptroller General Examination of Record. I.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

I.4 52.236-4 PHYSICAL DATA (APR 1984)

Data and information furnished or referred to below is for the Contractor’s information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) Transportation facilities: Ongoing road work within Yosemite National Park has and will continue to cause delays while traveling within and near the park. Visit www.nps.gov/yose to obtain the latest status and locations for road construction activities, estimated dates of construction, and estimated delays.

Additionally there exists a 45-foot length restriction and one-way controlled traffic for all vehicles 20 miles east of Mariposa on Hwy 140; see Caltrans website http://www.dot.ca.gov/ for further details.

These delays must be considered part of the existing conditions within the park, and will not be cause for any additional compensation as a result of this or related work.

ITEMS (FEB 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships.

SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C.

101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
