Terms, Conditions, and Clauses

Supply and Deliver of Water Filters Mount Rainier NP (MORA)

Mount Rainier National Park (MORA) is seeking firm-fixed price offers listed in request for quote (RFQ 140P8325Q0013) for the supply and deliver of Strainrite Potable Water Filters as listed. This RFQ and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2025-03 effective 01/17/2025. This RFQ is a 100% Total Small Business Set-Aside the North American Industry Classification System (NAICS) code is 221310, “Water Supply and Irrigation Systems, “with a size standard of $41.0 million. Any resulting purchase order will include commercial provisions and clauses (FAR Part 12).

The Government intends to make a firm fixed price, Simplified Acquisition Procedures (FAR Part 13), best value award to the responsible quoter whose quote conforms to the solicitation and is found to be the most advantageous to the Government, price and specifications being considered.

Prospective quoters must ensure that they are self-certified under NAICS Code 221310 in the Representations and Certifications portion of SAM.gov. and must visit SAM.gov periodically to check for amendments and other changes to the solicitation/contract documents; no other notifications will be sent, nor will hard copies of the solicitation be mailed or issued. All eligible responsible sources may submit a quote which shall be considered by the National Park Service, however, quoters who have not established and/or maintained an active registration a www.sam.gov prior to the quote due date and time will be considered either ineligible or non-responsive and will not be considered for award.

The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels the solicitation, the Government has no obligation to reimburse a quoter for any costs. Quoters submitting quote shall guarantee their pricing for a period of 60 days from solicitation closing date.

Federal Tax Exemptions #53-0197094 applies to all taxes.

4. CONTRACT CLAUSES.

ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - Invoice Payment Platform (IPP) (April 2013) Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP; https://www.ipp.gov ) "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions- Commercial Items included in commercial item contracts. Vendor’s standard business invoice (upload your business invoice as an attachment to the IPP invoice before you click “submit” in IPP). The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

BASIS FOR AWARD DECISION.

NPS will select a quote that represents the best overall value to the government based on the price.

FAR 52.212-2 EVALUATION-COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV

2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers: Specifications, Experience, Past Performance and Price.

Specifications, Experience, Past Performance are approximately equal when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The quoter shall fill out the price schedule in Attachment 1, Forms to Submit with Quote. A price evaluation will be performed to determine reasonableness of the proposed price. In the event one quote is received, the quoter may need to provide further details of a price breakdown to determine price reasonableness.

If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision— Covered telecommunications equipment or services has the meaning provided in the clause 52.204-

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300.
