This is a 100% Total Small Business Set-Aside and will result in a firm fixed price contract to a single vendor/contractor determined to be responsive and responsible. The Government will consider past performance in determining responsibility. The North American Industry Classification System (NAICS) code is 237130. Power & Communication Lines & Related Structures Construction with an associated small business size standard of $45M. This solicitation is a 100% total small business set-aside and will result in a firm fixed price contract to a single contractor/vendor.
Prospective quoters must ensure that they are self-certified under NAICS Code 237130 in the Representations and Certifications portion of SAM.gov. and must visit SAM.gov periodically to check for amendments and other changes to the solicitation/contract documents; no other notifications will be sent, nor will hard copies of the solicitation be mailed or issued. All eligible responsible sources may submit a quote which shall be considered by the National Park Service, however, quoters who have not established and/or maintained an active registration a www.sam.gov prior to the quote due date and time will be considered either ineligible or non-responsive and will not be considered for award.
The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels the solicitation, the Government has no obligation to reimburse a quoter for any costs. Quoters submitting quote shall guarantee their pricing for a period of 60 days from solicitation closing date.
BACKGROUND
John Day Fossil Beds National Monument (JODA) is comprised of more than 14,000 acres across three separate units located in rural areas in eastern Oregon. There is almost no cell phone or internet service throughout the monument. Therefore, it is extremely important for staff and visitor safety that JODA maintain a functional Land Mobile Radio (LMR) system. The LMR system allows staff to directly communicate with Grant County 911 Dispatch (dispatch) in the event of an emergency. Dispatch recently updated their radio consoles, shelter, and tower. A new antenna and components are needed for the JODA LMR system at the new tower location, Eagle Peak (approximately 44.376823, -118.961419). The base radio needs an antenna mounted on the tower instead of the temporary arrangement that is in use today.
SCOPE OF WORK
The National Park Service, John Day Fossil Beds National Monument (JODA), has a requirement for the purchase of and installation of an antenna. The contractor shall provide all labor, certified tower climbers, supervision, equipment, tools, travel, parts, and materials necessary to fulfill the contract:
Needs:
• Two certified tower climbers to remove temporary antenna/parts and install a new antenna and associated supplies and labor
• Omnidirectional Antenna that will cover a distance of 35 miles for receive/transmit frequency of
164-170 MHz, tower location, Eagle Peak (approximately 44.376823, -118.961419)
• Bracket and hardware to mount antenna to tower
• Approximately 60 feet of half inch, high quality, weatherproof rated coaxial cable
• Grounding kits for antenna bracket
• Lighting surge protection for antenna
• Associated high quality N connectors for antenna to surge protection to base radio
PRICE SCHEDULE:Quoter shall fill in prices on the price schedule. Failure to do so may render the quote ineligible for further consideration. Quoter shall factor pricing to include all labor, tools, equipment, materials, drive time, overhead and profit necessary for completing all work. All work shall be performed in accordance with these terms, provisions, and clauses, the Scope of Work, Attachment 1 Dept. of Labor wage rates for Grant County, Attachment 2 Forms to Submit with Quote. The Government intends to make a firm fixed price. Simplified Acquisition Procedures (FAR Part 13), best value award to the responsible quoter whose quote conforms to the solicitation and is found to be the most advantageous to the Government, price and other factors considered.

PERIOD OF PERFORMANCE
The awarded contractor will have from date of award to complete the requirement no later than September 13, 2024. Contractor will coordinate with the Point of Contact (POC) after award regarding the work schedule. POC name and contact information will be given after award.
INSPECTION and ACCEPTANCE The Contracting Officer will delegate inspection and acceptance to the POC who will also be responsible to review and recommend payment for the Contractor’s invoice.
CONTRACT CLAUSES.
ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS - Internet Payment Platform (IPP) (April 2013) Payment requests must be submitted electronically through the U.S. Department of the Treasury's Internet Payment Platform System (IPP; https://www.ipp.gov ) "Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions- Commercial Items included in commercial item contracts. The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. 52.212-2 EVALUATION-COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(b) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Technical and past performance, when combined, are not equal when compared to price. The following factors shall be used to evaluate offers:
(i) RELEVANT PAST EXPERIENCE. Experience is differentiated from past performance in that it is factual, documented information about specific work the quoter has performed, which demonstrates the quoter’s technical ability to accomplish the work, including the relevant experience of Quoter’s key personnel. Quoter shall have at minimum of 1 years’ experience in installing, and replacing antennas, radio antennas, cable, cable hangers and hardware. “Contracted climbers must be certified to perform tower climbing and their certification must be less than 3 years old.” See attachment 2.
(ii) PAST PERFORMANCE. Past performance is the measure of the degree to which a contractor has satisfied its customers in the past. Past performance includes projects of comparable size and scope.
Quoter shall provide at least three references for contracts in the past 5 years for removing, installing, and replacing antennas, radio antennas, cable, cable hangers and hardware.
Reference information shall include business name/customer name, job name, brief description of job performed, start and dates, and point of contact name with phone number and email address. The Government will evaluate past performance as a measure of the degree to which the quoter satisfied its customers in the past and complied with Federal, State, and Local laws and regulations. In the case of a quoter who states they have no record of relevant past performance or for whom information on past performance is not available, the quoter will not be evaluated favorable or unfavorably on past performance. Quoter are permitted to provide information on any problems encountered on the identified contracts and the Quoter’s corrective actions. The Government may contact sources listed by the quoter and/or other sources of information including, but not limited to, Federal, State and Local governments, better business bureaus, published media, and electronic databases to determine if they believe that the Quoter: See attachment 2
a. Demonstrated the ability to maintain cost control, stay on schedule, and successfully meet project deadlines, including timely submittals and complete pay requests;
b. Has an excellent safety record;
c. Was capable, reasonable, and cooperative during the performance period;
d. Demonstrated high quality workmanship and performance conforming to the terms and conditions of the contract.
(iii) PRICE. NPS will perform a price evaluation to determine the reasonableness of the quoted price.
Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate (IGE) or to any other information the Contracting Officer deems useful in their discretion. The Government will look at whether a quoted price is too high, possibly indicative of capabilities that exceed those needed for successful performance of the work; and may also consider whether a quoted price is too low, since this may indicate a lack of technical understanding on the quoter's part or a performance risk associated with the quote that the agency may not be willing to accept.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERCIAL

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision— Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
Forced or indentured child labor means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110- 174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

Service-disabled veteran-owned small business (SDVOSB) concern means a small business concern—

(1) Effective January 1, 2024, is designated in the System for Award Management (SAM) as certified by the Small Business Administration (SBA) in accordance with 13 CFR 128.300; or
(2) Has represented that it is an SDVOSB concern in SAM and submitted a complete application for certification to SBA on or before December 31, 2023.
Service-disabled veteran-owned small business (SDVOSB) Program means a program that authorizes contracting officers to limit competition, including award on a sole-source basis, to SDVOSB concerns eligible under the SDVOSB Program.
Small business concern—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships.
SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
Small disadvantaged business concern, consistent with 13 CFR 124.1001, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding the threshold at 13 CFR 124.104(c)(2) after taking into account the applicable exclusions set forth at 13 CFR124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term "successor" does not include new offices/divisions of the same company or a company that only changes its name. Veteran-owned small business concern means a small business concern—
(1) Not less than 51 percent of which is owned and controlled by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
Women-owned business concern means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women
