Description:

This is a combined synopsis/solicitation for a commercial item prepared in accordance with the format outlined in FAR Subpart 12.6. Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested, and a written solicitation document will not be issued.

The National Park Service, Interior Region 2 South Atlanta Gulf has a requirement to provide removal of hazardous and potentially hazardous trees to the Civil War Earthworks at the Kennesaw Mountain National Battlefield Park Kennesaw, Georgia. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2023-02 dated 16 March 2023.

The associated North American Industrial Classification System (NAICS) code for this procurement is 115310; Support Activities for Forestry, with a small business size standard of $11,500,000.00. The Product Service Code (PSC) is F014; Natural Resources/conservation-Tree Thinning Services.

In accordance with FAR Subpart 28, a certificate of insurance is required, and coverage must be at a minimum of: $50,000 per person; $100,000 per occurrence; and $100,000 per property. The insurance certificate must be submitted within 10 calendar days of receipt of the award.

The contractor must have current Representation and Certifications in SAM.gov, (see Section K below), submitted with quote.

The Government contemplates the award of a single Firm-Fixed Price Contract using the best value – Lowest Priced Technically Acceptable (LPTA) source selection procedures. All eligible and responsible sources may submit a quote, which if timely received, shall be considered by the Agency. Companies must have valid Unique Entity Identifier and be registered with System for Award Management (www.sam.gov). SAM.gov offers free services. An offeror must ensure that they are self-certified under NAICS Code 115310 in the Representations and Certifications portion of SAM.gov. The basis of award is the responsible offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered. Award will be made to the responsible respondent pursuant to FAR subpart 9.1.

Site Visit: The Site Visit for this project is scheduled for 15 May 2023 at 11:00 am Eastern Daylight Time (EDT) at Kennesaw Mountain National Battlefield Park 905 Kennesaw Mountain Dr. NW Kennesaw GA 30152.

The APPROXIMATE performance period is anticipated to be 02 June 2023 through October 02, 2023.

Statement of Work Preserve and Stabilize Historic Civil War Earthworks

(Removal of hazardous Trees on and near Earthworks)

1. Background:

Kennesaw Mountain National Battlefield Park preserves a Civil War battlefield of the Atlanta Campaign. The battle was fought here from June 18, 1864 until July 2, 1864. There are 4 battlefield areas at the park: The Kolb farm area, Visitor Center including the top of Kennesaw Mountain, off Burnt Hickory Road and the main site is located at Cheatham Hill. The Visitor Center provides introductory information about the park and the battle. While walking some of the 18+ miles of interpretive walking trails you will see historic earthworks, cannon emplacements and various interpretive signs. There are 3 monuments representing states that fought here.

Kennesaw Mountain is 1808 feet above sea level. It is approximately a 700 foot incline from the Visitor Center to the mountain's summit. The hike up is approximately 1.4 miles on the road and 1.2 mile up the trail. Kennesaw Mountain National Battlefield Park was authorized for protection by the War Department in 1917 and was transferred to the Department of the Interior as a unit of the National Park System in 1933. The 2992+- acre park includes the site of some of the heaviest fighting of the Atlanta Campaign. The park was set aside as an important cultural property dedicated to public inspiration and interpretation of the significant historic events that occurred here.

2.0 General Statement of Work:

The purpose of this Statement of Work is to establish a contract for the removal of hazardous and potentially hazardous trees to the Civil War Earthworks at the Kennesaw Mountain National mailto:ladrick_downie@nps.gov

Battlefield Park. approximately 2.5-mile radius. The work will be completed in one continuous cycle.

Trees will range from 10 inches to 37+ inches in diameter and up to 100+ feet high. The contractor will remove trees, dismantle, and rig down, manual climb, use chainsaw, and flush cut to maximum 6” above grade. Debris and stumps will remain in place. Of concern in these cutting operations is the protection of the historic earthworks. These earthen fortifications date back to the battle here and are a major resource to be protected within the park boundaries. These earthworks are particularly vulnerable to damage by the operation of both the tracked and wheeled vehicles which are often used in timbering operations. It is essential and mandatory that the contractor meet with the COTR and representatives of the park’s staff before operations begin in any new area, so they can be shown what these earthworks look like and discuss how best to protect them. All of this contract will occur around the earthworks.

Park employees have marked over 140 hazardous trees to be felled. The trees felled have been deemed and marked imminent resource threats by the NPS prior to the execution of the scope of work.

Trees will be removed 20 to 30 trees per month until completion of project.

3.0 Work Descriptions:

Tree Removal: Removed trees and debris shall be fallen safely to prevent injury of workers and/or visitors using the adjacent areas. Trees will be felled away from all earthworks to prevent damage to the earthworks. When ordered by the NPS, tree debris and limbs will be chipped and hauled to a NPS approved area for disposal. When chipping is not ordered by the NPS, the contractor will spread tree debris and limbs evenly across the area of disposal. The contractor may harvest large trees and limbs that they actively remove. Salvaged wood, should the contractor choose to re-utilize the material, will be removed immediately after felling, chipping and bucking of individual trees. Removed/harvested trees are the property of the contractor.

Desired Results: With the completion of the tree and limb removal project at Kennesaw Mountain National Battlefield Park, trees, and limbs order by the NPS shall be removed and/or chipped and spread in the area of disturbance and the worksites will show little indication of that removal. Stumps ultimately shall be cut at ground level and no grinding. Park boundaries, roads, parking lots and trails will be free of hazardous trees that may interfere with safe use of those areas.

3.1 Certified Arborist:

Contractor must be a Certified Arborist ISA (International Society of Arboriculture) or equivalent

Contractor must submit International Society of Arboriculture (ISA) certificate or equivalent certificate. List two similar projects successfully completed be included with the quote by the contractor.

3.2 Certified Arborist Bidding:

Due to the complexity of the project, it is recommended for bidders to attend the scheduled site visit. Site visit meeting date/time – see Site Visit Instruction.

3.3 Accident Prevention

The Contractor shall conduct operations to prevent accidents, injuries, and damages. Additionally, the Contractor shall comply with applicable state and local safety, health, and sanitation laws.

3.4 Accident Reporting

The Contractor shall immediately notify the Contracting Officer or his/her designated representative of any and all accidents to which the Contractor’s employees are a party or witness; and, of any and all accidents involving his/her employees or equipment working under this contract.

This is a major vehicle traffic area and contractor shall provide additional traffic flaggers and other traffic control measures and must be in place and functional at all times during the tree removal operations.

4.0 : HAULING RESTRICTIONS:

When hauling on National Park Service roads, do not exceed the following load restrictions:

Where the ground is saturated with water or during periods of freezing and thawing, the Contracting Officer may impose further load restrictions or suspend hauling.

4.1 Haul vehicles shall turn around only at intersections and parking areas, not on the Park Road.

4.2Operate loaded vehicles hauling material at speeds not exceeding the posted speed limit and spaced at 500-foot minimum intervals. On bridges, speeds shall not exceed 25 MPH and not more than one loaded hauling vehicle will be allowed on any bridge at one time. Hauling of materials, supplies, and equipment over the park road, other than within the limits of the project, will not be permitted without prior approval of the Contracting Officer. Load restrictions on park roads are identical to the state load restrictions with such additional regulations as may be imposed by the Contracting Officer.

5.0 : EQUIPMENT

Equipment that is leaking any type fluids shall be repaired immediately or removed from the park. Equipment deemed unsafe by the NPS will be repaired immediately or removed from the park.

6.0 : INSPECTION – CONTROL OF WORK

Contractor working hours shall take place Monday through Friday, not before 7:00 AM and no after 6:00 PM. The contractor may work other hours only with submission of a written request and subsequent permission of the Contracting Officer. Work on weekends or on Federal Holidays and at night may be performed only with submission of a written request and subsequent permission of the Contracting Officer. All work shall be scheduled by the NPS, five (5) workdays or more notice will be given by the NPS.

7.0 : PROTECTION AND RESTORATION OF PROPERTY

The contractor shall be responsible for the preservation from injury or damage, resulting directly or indirectly from the execution of the work, of all public and private property along and adjacent to the park. Contractor shall use every precaution necessary to prevent damage to historic earthworks, pipes, conduits, and other underground structures; also, all overhead structures such as wires, cables, etc.; and poles, trees, shrubbery, and crops, within or outside of the project area. Any damage by the contractor or his employee shall be repaired at once at the contractor expense. The contractor will stop work immediately as directed by the COR if there is a suspicion of potentially undocumented cultural and natural resources. In such cased the NPS would require review and documentation of such resources.

8.0 : SAFETY

The contractor must keep the entrance roads and parking lots open for public use at all times during removal activities. Contractor shall provide all traffic flaggers and other traffic control measures and must be in place and functional at all times during the tree removal and trimming in public areas, roads, trails, and parking lots. Special care must be taken to prevent impacting the surrounding areas and facilities. The contractor will post appropriate warning signs indicating periods of tree removal and trimming work. The successful contractor shall use best management practices for tree removal and trimming, following all NPS, State, County and OSHA regulations pertaining to tree removal and trimming. Employees utilizing chain saw equipment shall wear approved safety equipment to include chaps, hard hat, eyes, and hearing protection. All equipment shall be in good and safe working condition. Contractor shall inspect all equipment at the start of the workday. Contractor shall start each day with a safety briefing/meeting with all contractors and NPS staff on the work site.

The FOB point will be Destination. “FOB Destination” means that all costs for transportation or freight from the shipping point shall be paid by the contractor and included as a separate line item. The total price should include all shipping cost.

Simplified Acquisition evaluation procedures pursuant to FAR Part 13, will be applied in the evaluation of quotes received. Failure to submit the information called for in this solicitation may render the quote unacceptable. Only those quotes deemed responsive will be evaluated. The Government will award a single firm-fixed price services contract resulting from this solicitation to the responsible Quoter whose quote conforms to the solicitation requirements and is determined to be the “Best Value”; that is, the lowest priced, technically acceptable quote. Technical acceptability must meet or exceed the standards set for non-price factors. The government will evaluate information based on the following evaluation criteria:

Technical and Past Performance when combined, are approximately equal to cost or price

Technical Capability: Respondent shall describe a realistic plan, to include the means (labor, equipment, and materials) and methods (plan of work), logical sequencing of activities (including interdependencies of activities), and schedule, necessary to successfully complete the work within the required performance period. The plan shall list the specific equipment availability, crew(s) (size and composition) proposed to work concurrently, any other available resources, and daily production rate required in accordance with the attached Statement of Work (SOW). A rating of either “Acceptable” or “Unacceptable” will be assigned to this non-price factor. The standard for this factor is met and is acceptable when the responses provided by the Quoter can support a complete understanding of the work to be performed, potential obstacles and mitigation, and the specific requirements that are to be met to successfully complete the contract within the time required. Technical factor shall be evaluated on an acceptable/unacceptable basis (See table below).

TECHNICAL CAPABILITY RATINGS:

Past Performance: Respondent shall complete Past Performance Questionnaire(s) (Attachment 0004) that can confirm your company has successfully completed relevant services in the past three (3) years as outlined in the Statement of Work. Offeror shall submit past performance information on three (3) projects of similar scope and magnitude. Past Performance must reflect work that was completed within three (3) years of the solicitation closing date. Past performance information must consist of final performance evaluations of project(s) or project references who can provide performance assessments.

References shall consist of officials from the issuing contracting agency who oversaw the performance of the project. The Government reserves the right to obtain past performance information from other sources such as the references and the Contractor Performance Assessment Reporting System (CPARS) and other

Past performance will be evaluated on a pass/fail basis in accordance with FAR 15.305 (a)(2).

Price: A price evaluation will be performed as described in FAR 15-404-1to determine the reasonableness of the proposed price. Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate. If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. The Respondent shall remit a completed price schedule (Attachment 0003). The price shall include a breakdown of all necessary supervision, management, labor, transportation, equipment, materials, any other direct incidental costs, overhead and profit. Offerors are cautioned to distribute costs appropriately. The price submission will be evaluated but not rated.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
