Tubman National Historical Park (HART), City of Auburn, Cayuga County, New York

Subject: Request for Quotation (RFQ) 140P4523Q0080

Your firm, along with others who have been identified as capable companies, is requested to provide a quote for the requirement noted in the attached Scope of Services. The National Park Service (NPS), Harriet Tubman National Historical Park (HART), City of Auburn, Cayuga County, New York anticipates selecting a single firm. The National Park Service contemplates award of a firm fixed price purchase order as a result of this solicitation to the vendor.

(i) The solicitation Number is 140P4523Q0080 and is issued as a Request for Quote (RFQ) under Federal

Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures.

(ii) The solicitation document and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular (FAC) 2023-04, dated June 2, 2023. The FAC and FAR are available at https://www.acquisition.gov/FAR.

(iii) The solicitation is being issued as a Total Small Business Set-Aside for Small Business Concerns under NAICS 541370; Surveying and Mapping (except Geophysical) Services with a U.S. Small Business Administration size standard of $19 million. The U. S. Department of Labor Service Contract Act is applicable to this solicitation: DOL Wage Determination 2015-4177 (Rev.-24) dated 106/30/2023. A current Contractor registration is required on the System for Award Management (SAM) website, https://www.sam.gov/portal/public/SAM.

QUOTE CONTENTS AND EVALUATIONS

The Contractor shall supply all supervision, labor, equipment, materials, and supplies (field and office effort) necessary to complete the survey work, in accordance with the Statement of Services (SOS).

(iv) This solicitation is for purchase of the following commercial services:

The National Park Service (NPS), Harriet Tubman National Historical Park (HART), City of Auburn, Cayuga County, New York has a requirement to hire a consulting firm for Surveying/Mapping for the Parker Street Tract 01-101 is identified as the Thompson Memorial AME Zion Church

(xii) The Government intends to award a firm-fixed price purchase order resulting from this solicitation.

(xiii) Quotes are required to be received in the Contracting Officer no later than 2:00 PM, ET on September 12, 2023. All quotes must be email to the attention of Linda Richardson. The email address is linda_richardson@nps.gov.

EVALUATIONS

Award Selection Process:

(a) The Government intends to award a single, firm-fixed price purchase order resulting from this solicitation to the responsible offeror whose quote conforms to the solicitation and will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (Note: This solicitation is not stating nor required to state the relative importance assigned to each evaluation factor and/or sub factor (FAR 13.106-1(a)(2).

Evaluation Factor:

(1) Technical Capability:

a. The offeror shall provide project narrative that demonstrates how the company will successfully meet the needs of the statement of services (limit to two pages).

b. Key Personnel – (Project Staff) Resumes/Certifications/Licenses

(2) Past Performance

a) An evaluation of offeror’s past performance information will be conducted subsequent to the technical evaluation. The offeror must have demonstrated successful completion of projects mailto:linda_richardson@nps.gov mailto:jessica_bowes@nps.gov

b) similar in quality, technique, and complexity. Preference will be given to quotes that demonstrate past performance of similar projects related to the work outlined in the SOW.

c) The evaluation will be based on information obtained from the written quote, photographs, other relevant past performance information obtained from sources known to the Government, and any other information supplied by the offeror, to include problems encountered on the identified contracts and corrective action taken.

d) The Government will assess the relative risks associated with each offeror. Performance risks are those associated with an offeror’s likelihood of success in performing the acquisition requirements as indicated by that offeror’s record of past performance.

e) The assessment of performance risk is not intended to be the product of a mechanical or mathematical analysis of an offeror’s performance on a list of contracts, but rather the product of subjective judgement by the Government after it considers all available and relevant information.

f) When assessing performance risks, the Government will focus on the past performance of the offeror as it relates to all acquisition requirements, such as: 1) the offeror’s record of performing according to specifications, including standards of good workmanship; 2) the offeror’s record of controlling and forecasting costs; 3) the offeror’s adherence to contract schedules including the administrative aspects of performance; 4) the offeror’s reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and 5) the offeror’s business-like concern for the interest of the customer.

g) The Government will consider the currency and relevance of the information, sources of the information, context of the data and general trends in the offeror’s performance. The lack of a relevant performance record may result in an unknown performance risk assessment, which will neither be used to the advantage nor disadvantage of the offeror.

Note: Contractors submitting offers without past performance will receive a neutral rating.

h) Offerors shall provide three (3) projects completed in the past three (3) years with a similar scope. Describe any previous experience in providing these services, including the scope and complexity of the project.

Note: Listing completed projects does not address this criterion. A narrative that articulates past experience and description of successful completion of services should be discussed.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(3) Price

a. Offeror’s price quote will not be point scored or adjectively scored but will be evaluated on price reasonableness. The price quote will also be used as an aid to determine that the Offeror understands the requirements of the solicitation, price reasonableness and to assess the validity of the offeror’s approach to managing and performing the work.

b. The offeror shall submit a price quote separate from all other volumes; any pricing information found in the technical or past performance volumes will be removed prior to evaluation.

c. The Government will evaluate the price quote for reasonableness. The Government will also evaluate price with regards to the ability of the offeror to meet requirements in terms of skills required, complexity of disciplines and job difficulty, if the Government deems such analysis necessary.

Final submitted prices shall be valid for a minimum of 60 calendar days from the date submitted.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (Apr 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Before, Contractor submits an invoice through IPP the Contractor must complete the following:

An invoice will be prepared by the Contractor and submitted to the COR. The COR will confirm work completed. The invoice will include the location, date services rendered, number of stalls serviced.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

a. An approved (COR certified) copy of each invoice must be attached in IPP.

b. Each invoice must include the Contract award number, Period of Performance and/ or delivery date, Contractor name and address, Invoice Number, Dollar value, Unit of issue (as applicable), description of services completed and/or items received, and other documents required per the contract.

c. If an IPP invoice is submitted without the attached invoice, the IPP submission will be rejected, and the contractor will be required to re-submit said invoice.

d. Submit a courtesy copy of the invoice and attachments to the Purchasing Agent, Linda

Richardson at linda_richardson@nps.gov.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

1452.228-70, DOI Liability Insurance

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

• Workman’s Compensation and Employer Liability Insurance: Compliance with applicable Federal and State Worker’s Compensation and Occupational Disease Statues shall be required. Employer liability coverage in the minimum amount of $100,000.

• General/Professional Liability Insurance: Bodily injury liability insurance minimum amount of $1,000,000 per occurrence.

• Automobile Liability Insurance: This insurance shall be required on the comprehensive form of the policy and shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. The minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage shall be required.

(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy copy of an acceptable insurance certificate prior to beginning the work.

SPECIAL CONTRACT REQUIREMENTS

1452.201-70 Authorities and Delegations (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph

(e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Restriction on Endorsements—Department of the interior (JUL 1996)

The Contractor shall not refer to contracts awarded by the Department of the Interior in commercial advertising, as defined in FAR 31.205–1, in a manner which states or implies that the product or service provided is approved or endorsed by the Government or is considered by the Government to be superior to other products or services. This restriction is intended to avoid the appearance of preference by the Government toward any product or service. The Contractor may request the Contracting Officer to make a determination as to the propriety of promotional material.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
