TITLE: Removal and Disposal of Vessel Wrecks, Gateway National Recreation Area (GATE), Great Kills Park, Staten Island, NY 10306

DESCRIPTION: The intent of this contract is to hire a professional company with experience in the removal and disposal of a thirty-five-foot fiberglass vessel hull and a thirty-foot catamaran from ecologically sensitive and shallow shoreline. This is a one-time contract and work shall be fully executed and completed within 60 days after issuance of Award. The contractor shall provide this service at GATE, Great Kills Harbor, located at Great Kills Park is located off Buffalo Road on Staten Island, NY. A Statement of work and wage determination are attached to the solicitation.

INSTRUCTIONS TO QUOTERS:

A firm fixed price award will be made from this combined synopsis/solicitation to the company that submits a quote that conforms to the technical specifications, and who, based on the decision of the government, offers the best value to include technical experience, technical approach, past performance, and price. The Government reserves the right to award a contract to any other than the lowest priced offer if, in its judgment, the technical superiority outweighs the cost difference.

Vendors interested in submitting a quote are highly encouraged and expected to schedule and attend a pre-quote site visit where services are to be performed to satisfy themselves regarding all general

In no event shall failure to inspect the site constitute grounds for a claim after contract award. The government will not pay for any costs associated with attending a site visit. Submission of Quotes:

Quotes must be submitted in two separate volumes as outlined below. Technical quotes received that include pricing information will be considered non-responsive and will not be considered further for award.

Offeror Questions Regarding the Solicitation:

All questions shall be submitted to linda_richardson@nps.gov. Please be advised that the government reserves the right to transmit those questions and answers of common interest to all competing schedule contractors. Should any question or comments be received by the government after the prescribed timeframe, the Government reserves the right to respond per its discretion.

Price Quotes:

The government intends to issue a fixed -price contract as a result of this RFQ. Interested parties shall submit a price quote that includes the vendor UEI number and itemizes, at a minimum the cost per hour for each labor category needed to perform services, supply costs, equipment costs, and incidental expenses. In addition, provision 52.204-24/26 in the solicitation shall also be submitted with the quote. Offerors are advised to provide their best and final pricing, including any proposed discounts, upon initial submission. Email offers will be accepted and preferred over fax or USPS mail.

Technical Proposal:

The offeror shall provide one (1) copy of the technical proposal. The technical proposal should be prepared simply and economically providing straight forward, concise delineation of capabilities.

The information provided shall be factual and complete. Quotes that merely offer to provide services as described in the SOW will not receive further consideration for award. The following evaluation factors shall be addressed:

1. Technical experience, capacity, and expertise to perform the required tasks within the period of performance and to meet all goals and objectives on schedule.

2. Technical approach to performing the required tasks as described in the statement of work within the period of performance. The proposal shall include a narrative explaining how the work will be carried out in terms of the techniques, procedures, and cleaning schedule.

3. Past performance. The proposal shall include three examples of successful, timely completion of similar work. The examples may come from federal, state, or local government. The following information shall be included:

-Name of the job (to include address) -Project Prime’s name -Issuing agency or company -Contract/Identification number -Start and completion dates -Brief description of the scope of work -How the work is substantially similar to the proposed project -No less than two (2) valid references that includes:

-Agency name, Point of Contact, Phone Number, Email Address

The factors listed above will be evaluated equally and considered significantly more important than price during the evaluation phase. Award will be made on a firm-fixed price basis. Due to time constraints, the government anticipates awarding this order based on initial proposals. Contractors are strongly encouraged to propose their 'best and final' pricing with the initial proposal.

In order to be eligible for award, it is mandatory that the offeror complete registration in the System for Award Management (SAM) website (https://www.sam.gov) and that the offeror is listed in SAM as an active vendor. (Note: SAM is a FREE website and there is never a cost to complete registration.)

Note: Following receipt of an Award, payment requests for all new awards must be submitted electronically through the U.S. Department of the Treasury's Invoice Processing Platform System (IPP).

Following receipt of an award, the awardee must use the IPP website to register, access, and use IPP for submitting requests for payment. The IPP website address is: https://www.ipp.gov (Note: IPP is a FREE website and there is never a cost to complete registration.)

Final submitted prices shall be valid for a minimum of 60 calendar days from the date submitted.

By submitting a quote, contractors agree to comply with all terms and conditions as set forth in this RFQ including the attached SOW.

CONTRACT ADMINISTRATION DATA

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (Apr 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Before, Contractor submits an invoice through IPP the Contractor must complete the following:

An invoice will be prepared by the Contractor and submitted to the COR. The COR will confirm work completed. The invoice will include the location, date services rendered.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

a. An approved (COR certified) copy of each invoice must be attached in IPP.

b. Each invoice must include the Contract award number, Period of Performance and/ or delivery date, Contractor name and address, Invoice Number, Dollar value, Unit of issue (as applicable), description of services completed and/or items received, and other documents required per the contract.

c. If an IPP invoice is submitted without the attached invoice, the IPP submission will be rejected, and the contractor will be required to re-submit said invoice.

d. Submit a courtesy copy of the invoice and attachments to the Purchasing Agent, Linda

Richardson at linda_richardson@nps.gov.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

1452.228-70, DOI Liability Insurance

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

• Workman’s Compensation and Employer Liability Insurance: Compliance with applicable Federal and State Worker’s Compensation and Occupational Disease Statues shall be required. Employer liability coverage in the minimum amount of $100,000.

• General/Professional Liability Insurance: Bodily injury liability insurance minimum amount of $1,000,000 per occurrence.

• Automobile Liability Insurance: This insurance shall be required on the comprehensive form of the policy and shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. The minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage shall be required.

(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy copy of an acceptable insurance certificate prior to beginning the work.

SPECIAL CONTRACT REQUIREMENTS

1452.201-70 Authorities and Delegations (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.

The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph

(e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

Restriction on Endorsements—Department of the interior (JUL 1996)

The Contractor shall not refer to contracts awarded by the Department of the Interior in commercial advertising, as defined in FAR 31.205–1, in a manner which states or implies that the product or service provided is approved or endorsed by the Government or is considered by the Government to be superior to other products or services. This restriction is intended to avoid the appearance of preference by the Government toward any product or service. The Contractor may request the Contracting Officer to make a determination as to the propriety of promotional material.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services.
