GENERAL INFORMATION:

This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a firm fixed price contract as a result of this combined synopsis/solicitation to the vendor. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P4224Q0070. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2024-05 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

The acquisition is in support of Johnstown Flood National Memorial.

This is a 100% Total Small Business Set Aside. The North American Industry Classification System (NAICS) code is 321912 Lumber and Related Materials.

Award Selection Process:

Award will be made in accordance with FAR Part 13 to the offeror that provides the lowest price offer that meets the technical specifications and prior experience.

1. Prior experience: Prior experience is the factual documentation or narrative of a firm’s experience, qualifications, and capability, to meet the acceptability standard provide three examples of if similar size, scope and complexity.

2. Technical: Provide a project narrative that demonstrates how the company will successfully meet the needs of the statement of work.

3. Price.

FACTOR 1 - PAST PROJECT EXPERIENCE

Submit the attached "Project Experience" form (Attachment 3) addressing specific experience elements below for up to five (5) relevant projects completed in the last three (3) years that demonstrate successful prior experience on projects similar in scope, magnitude, and complexity to the work required for this project. This includes work within a national historic landmark. Submit separate forms for each project. Key subcontractors can also submit up to five

(5) relevant projects completed in the last three (3) years.

• Project Management – Describe construction coordination experience with the owner while minimizing impacts to client/owner on-going operations.

• Describe Organized management, coordination, and communication of efforts between the prime contractor, its subcontractors, and the owner. Include coordination with owner relative to ongoing owner operations and visitor activities.

• Demonstrated ability of the proposed combination of methods, equipment, and personnel to complete the required work in a quality manner.

• Demonstrated ability to minimize adverse impacts on the environment based on methods/equipment proposed in relation to protection measures proposed.

FACTOR 2: SCHEDULE AND TECHNICAL APPROACH:

An acceptable work plan will explain schedule logic, critical path activities, and key considerations and constraints.

An acceptable plan will demonstrate that appropriate personnel and equipment will be positioned efficiently to carry out the requirements.

• Logistics, Coordination, Process – Describe logistics for material delivery, staging, installation and disposal, including long lead items. Provide specific details relative to materials as identified in the contract documents. Indicate the types of equipment proposed to include sizes and quantities of equipment.

• Means/Methods – Describe your approach to accomplish the work within required schedule and budget for successful contract completion. Include specific trades needed to complete the work.

FACTOR 3 - PRICE

Price Assessment: The Price Factor will not have an adjectival rating assigned.

The Government shall evaluate the price of the services being acquired to determine that the total price is reasonable.

Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices.

Offerors are cautioned that a proposal may be rejected if unbalanced pricing exists, and the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.

EVALUATION

1. Non-price Factor The Government will evaluate the technical factors and sub-factors as ACCEPTABLE or UNACCEPTABLE.

The purpose of the technical factors is to assess the Offeror’s proposed approach, as detailed in its proposal, to satisfy the Government's requirements. The evaluation of risk is related to the technical assessment. Risk assesses the degree to which the Offeror’s proposed technical approach for the requirements of the solicitation may cause disruption of schedule, increased costs, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance.

Rating Definition Acceptable All of the minimum acceptable criteria as defined in the technical factors and sub-factors are clearly met by the proposal. The offeror’s proposal meets the performance and technical capability requirements defined in the SOW.

Unacceptable Not all of the minimum acceptable criteria are met by the proposal. An Unacceptable proposal contains one or more deficiencies. Proposal fails to meet specified minimum performance and technical capability requirements defined in the SOW.

INSTRUCTIONS TO OFFERORS:

Quotes must be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.

All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. (a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. (e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:

(b) Each policy shall have a certificate evidencing the insurance coverage.
