14. EVALUATION PROCESS

GENERAL

1. Government technical and contracting personnel will evaluate the quotes. The technical evaluation and rating of quotes will be conducted in strict confidence. The number and identities of quoters will not be revealed to anyone not involved in the evaluation and award process or to other quoters.

2. The Government will use a tradeoff process to determine which quote represents the best value to the Government on the basis of technical capability, the Government’s level of confidence in the company based on past performance records, and price, as described below.

PRELIMINARY REVIEW: The Contracting Officer (CO) will do a preliminary review of each quote to determine whether it is suitable for further review based on whether:

a) The quoter’s SAM registration is active. Quotes from contractors whose registration status is anything other than “active” on the solicitation due date will not be considered compliant with the solicitation requirements.

b) The quoter has any active exclusions shown in SAM on the solicitation due date.

c) The offeror is a small business as evidenced in the representations and certifications in the offeror’s SAM record and at SBA’s Small Business Search.

d) The Contractor Performance Assessment Report System (CPARS) for relevant evaluations.

If the quote is >$350,000, the CO will also review:

e) CPARS for adverse integrity information reports.

f) Whether the quoter has demonstrated that they intend to comply with applicable limitations on subcontracting requirements.

NON-PRICE EVALUATION: The technical evaluators will review, evaluate, and assess performance risk for all quotes that passed the preliminary review against the technical factors listed below. The technical evaluators will consider each project’s relevancy and assign greater weight to projects that are more relevant.

The technical evaluators will evaluate quoters’ past performance to determine the government’s confidence level for each quoter to successfully perform contract requirements. The Government may limit the number of references it ultimately contacts and to contact references or use sources other than those provided by the quoter to obtain information related to past performance. The Government may consult Federal, State, and local governments, better business bureaus, published media, and electronic databases to verify the information provided in the quote.

PRICE EVALUATION: The technical evaluators and CO will perform price analysis and compare each quote’s technical merits to its proposed pricing. The technical evaluators will make an award recommendation to the CO.

TRADEOFF ANALYSIS: The CO will review the technical evaluators’ award recommendation and independently perform a tradeoff analysis between each quote’s (1) demonstrated technical (including past performance) advantages, disadvantages, strengths, weaknesses, and (2) proposed pricing. The CO will consider all technical and price factors, including assessing the degree of performance risk associated with each quote, to determine the quote that provides the overall best value to the Government. The CO's source selection decision will be based on a comparative assessment of quotes against all evaluation factors in the solicitation.

RESPONSIBILITY: The CO will check SAM regularly during the evaluation process and just prior to award, and if a quoter becomes a listed entity, their quote will be excluded from further evaluation and be ineligible for award per RFO 9.405(e)(3).

15. EVALUATION FACTORS and BASIS FOR AWARD

1. The technical capability of the prime contractor (quoter) and their subcontractors (if applicable) will be evaluated using the following non-price factors:

A. Relevant Prior Experience (corporate). Experience is an opportunity to learn about performance methods, problems, and solutions by having done the same or similar work in the recent past, including current contracts if >80% complete. The Government will evaluate the firm’s direct participation in comparable contracts or orders. “Direct participation” means as a prime contractor self-performing, as a prime contractor overseeing subcontractors’ work, or as a subcontractor self-performing. Relevant experience of subcontractors performing key tasks will be evaluated only if a Teaming Agreement or letter of commitment is included with the quote. “Comparable contracts or orders” means it was similar in one or more of these ways:

• Hazardous and/or petroleum waste collection, consolidation, transportation, and disposal services.

• Required preparation of planning documents similar to this contract.

• Performed in challenging environments with limited services, such as electricity, cell phone coverage, grocery or hardware store, etc.; or similarly remote location.

• For a federal government customer.

Quotes demonstrating that the firm has successfully completed work of similar scope and magnitude to this solicitation, which indicates they have the technical knowledge and skills required for this work and have successfully implemented effective management procedures in prior relevant projects, represent lower levels of risk and will be more favorably rated; in general, more instances and/or more relevant experience will translate to a higher rating. Quoters with fewer instances and/or less relevant experience present higher levels of risk and will be less favorably rated.

B. Past Performance (corporate). Past performance is a measure of the degree to which the Quoter satisfied its customers in the past and complied with Federal, State, and local laws and regulations.

The past performance of the quoter on projects similar in scope and complexity (i.e., relevant to the current project) will be evaluated in the areas of quality, timeliness, business relations, and cost control. Quoters demonstrating a higher level of successful past performance for recent, relevant projects will be more favorably rated. In the case of an quoter without a record of relevant past performance or for whom information on past performance is not available or too sparse to be meaningful, the quoter will be evaluated neither favorably nor unfavorably.

The general approach for evaluating past performance will be written or telephonic customer surveys based on past contracts identified. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor’s performance shall be considered by the evaluators. Quoters are encouraged to provide information on problems encountered on the identified contracts and the quoter’s corrective actions. The Government may contact sources listed by the Quoter and/or other sources of information including, but not limited to, Federal, State and Local governments, better business bureaus, published media, and electronic databases to verify the information provided in the quote. The Contracting Officer will pull evaluation reports for comparable contracts from the Contractor Performance Assessment Report System (CPARS).

Once sufficient information is gathered on the past performance for each quoter, the technical evaluators will assign a confidence rating to their assessment of how well that quoter’s team would perform on the current project. Quoters with fewer than three (3) past performance evaluations (counting CPARS reports for PSC F108, PSC F999 if project description is relevant, and submitted PPQs) will receive a Neutral Confidence rating due to the sparse record.

2. Price: A price evaluation will be performed to determine the reasonableness of the proposed price.

Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate (IGE) or to any other information the Contracting Officer deems useful in their discretion. The Government will look at whether a proposed price is too high, possibly indicative of capabilities that exceed those needed for successful performance of the work; and may also consider whether a proposed price is too low, since this may indicate a lack of technical understanding on the quoter's part or a performance risk associated with the quote that the agency may not be willing to accept.

If multiple contract line items are included in the price schedule, prices will also be evaluated to determine whether any line items are unbalanced. Quoters are cautioned to distribute costs appropriately.

RELATIVE IMPORTANCE OF EVALUATION FACTORS

Award will be made to the company whose quote represents the best overall value to the Government.

This will be determined by comparing differences in the value of technical and past performance factors with differences in cost to the Government. In making this comparison, the Government is more concerned with obtaining superior technical or management features than with making an award at the lowest overall cost to the Government. However, the Government will not make an award at a significantly higher overall cost to the Government to achieve slightly superior technical or management features. The relative impacts of quality and price will depend on the marginal differences among the competing quoters. The Government will evaluate the reasonableness of the price of each compliant quote in relation to the quoter’s relative quality.
