This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation Number 140P2124R0089 is issued as a Request for Proposal (RFP) which constitutes the entire solicitation. Proposals with detailed breakdown are being requested. This acquisition will be conducted pursuant to FAR Part 13. This solicitation document incorporates all mandatory commercial item provisions and clauses in effect through Federal Acquisition Circular 2024-04, effective May 1st, 2024. This is a 100% small business set-aside. The North American Industry Classification System (NAICS) code is 334310, Audio and Video Equipment Manufacturing, and the related small business size standard is 750 Employees.

The government anticipates award of one (1), firm-fixed price contract.

REQUIREMENT: The contractor shall provide the government with all labor, materials, and services necessary to provide a complete, working, and accessibility-compliant audio-visual presentation systems, microphone systems, and the 3-zone Public Address (PA) system at Manzanar National Historic Site.

Manzanar National Historic Site Audiovisual Systems Upgrade

Independence, California

BACKGROUND & PURPOSE

In 1942, the United States government ordered more than 110,000 men, women, and children to leave their homes and detained them in remote, military-style camps. Manzanar War Relocation Center was one of ten camps where the US government incarcerated Japanese immigrants ineligible for citizenship and Japanese American citizens during World War II. The Manzanar Visitor Center (VC) includes 8000 square feet of exhibits and two theaters which show the site’s award winning 22-minute film “Remembering Manzanar”.

The purpose of this contract is to rehabilitate the audio, video, microphone, and paging systems at Manzanar National Historic Site (MANZ). The Contractor shall remove most if not all of the existing equipment and materials and install new equipment and materials combined with various existing components and materials to restore and improve the performance of the systems. The Contractor shall not be responsible for the performance and viability of any existing components, apparatus, or materials.

The site is located between Independence and Lone Pine California in the Owens Valley on the west side of U.S. Highway 395, ten miles north of Lone Pine, California and six miles south of Independence, California.

SCOPE & OBJECTIVES

The contractor shall provide the government with all labor, materials, and services necessary to provide a complete, working, and accessibility-compliant audio-visual presentation systems, microphone systems, and the 3-zone Public Address (PA) system at Manzanar National Historic Site. The VC has two back-to-back theaters.

The park hosts the annual Manzanar Pilgrimage on the last Saturday in April. Due to this event and the extensive preparation required, the installation shall be complete no later than Friday 11 April, 2025.

The contractor shall perform all work in accordance with this document and Attachment A - Standard Specs for AV May 2024.

The last major upgrades to the AV systems were in late 2010. No major components have been replaced in the interim. Shop drawings from that project are provided as Attachment B - MANZ Drawings. Photos of the theaters and equipment are provided as Attachment C - MANZ Photo Guide.

The contractor shall replace all AV equipment and analog video cabling in both theaters including the computer ports located at the front of the theaters. New systems shall be UHD video with 5.1 audio, each theater currently has left, right, and center speakers.

The contractor shall replace the Microphone and Public Address (PA) systems. PA shall cover 3-zones; the exhibits, theaters, and offices. Any or all zones shall be selected individually or in any combination from the office or the information desk.

Existing equipment racks shall be reused. Contractor may, at their discretion, pre-build new equipment racks at their facility and replace them with the existing equipment racks. All unused equipment shall be removed from the equipment racks and returned to the government for disposal.

The contractor shall plan, design, develop, provide, and install complete and working UHD connections for presenters to connect a laptop in the two theaters. Current ports are VGA.

In the two theaters are existing Williams Sound FM transmitters used for Assistive Listening (AL) and Audio Description (AD). The transmitters shall remain and shall be incorporated into the new system.

Digital media for installation in the theaters will be provided at the post award site visit. The media will be in .mp4 video and .mp3 audio (AD) file formats. Video and audio files shall run concurrently. Audio from the movie shall be mono-mixed and routed to the AL transmitter, audio from the AD file shall be routed to the AD transmitter.

To the greatest extent possible, equipment with similar functions shall be the same manufacturer and model in both systems. This is to enable controlled substitution of a unit were it to impact a venue of greater importance to the park's interpretive goals.

Equipment for both theaters are installed in the same equipment rack. In the rack, the equipment shall to the greatest extent possible, be separated by system. The systems shall not share equipment.

The two theaters shall power and operate independently.

Theater Microphone equipment is installed in a separate rack in the theater booth. PA equipment is rack installed in a separate location.

NOTE: ALL equipment items may be quoted as “or equal” items.

Theater East & Theater West: The park movie, "Remembering Manzanar" is UHD, 3.1 and is shown automatically or manually.

The contractor shall design, provide, install, and meet the following requirements for each theater:

1. VIDEO & AUDIO PROCESSING - Current media players are Brightsign.

a. Replace existing media player. Replacement unit shall play 4K, UHD media and possess the capability to simultaneously play a video and an audio file. Brightsign or equal.

b. Memory cards for media players shall be Class 10 and sized to allow 30% free space.

c. Provide video and audio distribution and source selection via a UHD receiver. Sources shall be renamed in consultation with park staff. Denon or equal.

d. Provide a UHD Blu-ray player. Denon or equal.

e. Replace the VGA computer port at the front of the theater with an HDMI port.

f. Add an HDMI port to the rack.

2. VIDEO - Projectors shall be replaced. The projectors shall be interchangeable between the two theaters with no control code change, lens change is acceptable. Projectors shall have a minimum of 6,000 lumens and sized to an aspect ratio of 16x9 and scalable to UHD. Panasonic PT-FRQ50BU7 or equal.

a. Throw distance in Theater East is approximately 28 feet.

b. Throw distance in Theater West is approximately 30 feet.

c. Due to the close proximity of the projectors, a wired remote or other method, separate from the control system, to turn an individual projector on/off shall be provided.

3. AUDIO - Current audio is 3.1.

a. In order to significantly reduce the carbon footprint of the system, the contractor shall remove the existing amplifiers and equalizers and use the provided receiver as the amplification source.

b. Replace and augment current speakers for 5.1 surround. Surround speakers shall include two left and two right. Renkus Heinz or equal.

c. Subwoofer shall be passive and ceiling mounted. Ceiling is 2x2 black tile. Speaker shall be black or painted to match. KSI or equal.

4. CONTROL - Current control system is a KPC-2. Manual operations buttons are located in the rack, information desk, and at the front of the theaters. The contractor shall utilize the media player programming capabilities to provide the following:

a. Physical automatic or manual play switch.

b. Automatic mode shall play the movie on a scheduled basis. Start time, intervals, and last show times shall be determined in consultation with park staff.

c. Replace the existing rack button panels and provide a switch to toggle between automatic and manual modes, and buttons to start or stop movie playback.

d. Replace the information desk audio monitor and include start and stop movie options.

e. Replace the start and stop buttons located at the front of the theaters.

f. Provide two 6-button key fobs for each theater. Functions determined during design.

Applied Wireless or equal.

5. PRESENTATION MICROPHONES - Current microphone system shall be replaced.

Microphone system shall be a shared asset of the two theaters.

a. Provide microphone mixer. Biamp Tesira or equal.

b. Provide one wireless handheld microphone. Shure or equal.

c. Provide one over-the-ear microphone.

d. Provide one Lavalier microphone.

e. Provide charging stations for microphones.

6. PUBLIC ADDRESS - Current PA system is rack mounted in a room separate from AV.

Microphone at the information desk is capable of addressing the exhibit space, the theaters, and the back offices separately or in combination.

a. New system shall be installed in the same rack as the current equipment. Biamp or equal.

b. There is no space at the information desk for anything other that a three-button gooseneck microphone. Electro-Voice MP785 or equal.

7. ACCESSIBILITY - Current equipment for AL and AD are FM transmitters. Transmitters shall remain and be incorporated into the system.

8. RACK & HARDWARE - Currently all equipment is rack installed. Rack power is conditioned and surge protected.

a. The contractor at their option may build and populate racks at their facility and remove the current rack for their use. Equipment from existing racks shall be removed and returned to the government. Removed cables shall be disposed of by the contractor.

b. All equipment not required to turn-on the system shall be turned off. Provide UPS power conditioners as required. Power conditioners shall have a minimum of four switched and four unswitched outlets. Tripp-Lite SM1500RMXL2UTAA or equal.

c. All equipment not required to turn on the system shall be connected to switched outlets.

Theaters shall be identical in their capabilities and functions.

Options: Options apply to both theaters and shall be priced separately. In no particular order, and dependent upon availability of funds, one or more options may be executed at the time of award.

1. PROJECTION SCREENS - Projection screens in both theaters shall be replaced. Screens are approximately 142 inches wide and 82 inches tall.

a. Screens shall be seamless, fixed frame, UHD rated with a gain of .06 or better. Da-Lite Cinema Contour or equal.

2. CONTROL SYSTEM - In addition to Theater requirement 4. Control, a Crestron or similar control system shall be provided and installed. System shall include the following:

a. Provide two iPad controllers. One rack mounted, one on a desk mount at the information desk

b. The capability to operate the media player in automatic or manual mode.

c. Automatic mode shall include a scheduler capable of setting and changing movie start times, turn the system on and off, and exclude specific days or recurring days for system power.

d. User control of video source, show control, Blu-ray player, microphones, and lighting scenes.

e. To allow for tuning the audio system, main volume control and individual control of each speaker and/or channel shall be available.

f. Password protection for designated administrative tasks, i.e., password change, volume defaults, etc. shall be provided.

3. STREAMING AL & AD AUDIO in lieu of Theater requirement 7. Accessibility.

a. The contractor shall replace the current AL & AD transmitters with a new FM and

Wi-fi audio streaming server combo. Listen Technologies LCS-120-01 or equal.

b. The contractor shall provide and install Audio Description (AD) Wi-Fi audio streaming equipment for use by visitors who are blind or have low vision. Wi-Fi servers channels, and router shall be named to reflect the associated venue and for ease of selection by the user.

c. The contractor shall provide four FM receivers, one neckloop, and 20 disposable earbuds.

d. The contractor shall provide one Wi-Fi receiver for testing purposes.

4. EVENT SUPPORT

a. The contractors lead installation technician shall return to the park the day prior to the start and remain available over the Manzanar Pilgrimage weekend to provide support and assistance.

5. SYSTEM SPARES

a. Media player (2).

b. Power conditioner (2).

PERIOD OF PERFORMANCE

The NPS anticipates a period of performance period starting in November 2024 and ending June 2025, including final review and approval.

REVIEW AND APPROVAL

The COR shall notify the contractor, in writing, of acceptance for review or rejection of each deliverable within 5 calendar days. Any additions or corrections shall be completed and returned to the government within 5 calendar days.

Review period for accepted deliverables is 10 calendar days.

In the event the government delays comments beyond the period specified, the contractor shall be entitled to a day-for-day extension in the final completion.

TRAVEL

In accordance with Public Law 99-234, "Federal Civilian Employee and Contractor Travel Expense Act of 1985", travel-related expenditures for Contractor's personnel are restricted to the limits established for federal employees. This includes mileage for company-owned vehicles.

The Contractor shall travel as required to support program tasks. All travel arrangements are to be made by the Contractor. Payment for transportation, per diem, mileage, parking, and other fair and reasonable travel expenses will be paid in accordance with the effective Federal Travel Regulations as amended and supplemented by the Department of the Interior travel regulations where applicable. No Federal travel authorizations are to be issued. The Contractor shall make every effort to keep travel costs to a minimum. No reimbursement will be made for parking at a Contractor's normal place of work. No overhead, profit or G&A shall be allowed on travel costs.

Travel costs shall be reimbursed in accordance with the Federal Travel Regulations. Travel is only funded to the extent specified within the travel CLIN. The contractor shall not incur any travel costs in excess of the amount funded within the travel CLIN. The Government shall not be liable for any travel related costs incurred by the contractor which are in excess of the total amount funded within the travel CLIN.

If the contractor has reason to believe they may exceed the amount funded on the travel CLIN, they shall notify the Government Contracting Office immediately. Additional funding may only be added to the travel CLIN through a formal signed modification issued by a Government Contracting Officer. Profit, fee, G&A or overhead may not be incurred on travel costs.

DELIVERABLES AND DESTINATION POINT

All deliverables shall be shipped Free On Board (FOB) Destination, within Consignee’s premises, with all shipping and transportation costs prepaid. Deliverables shall be shipped by either registered or certified mail to ensure that shipments can be traced, if lost.

The contractor shall perform all work in accordance with Attachment A - Standard Specs for AV and furnish the following deliverables:

A. COR Deliverables:

1. Post award trip report.

2. Drawings.

3. Audiovisual equipment submittals.

4. Photographs of installation.

5. Operations manuals.

6. Equipment manuals.

7. Closeout package and return of government-furnished reference materials.

Any additional work not detailed in this contract shall be approved, in writing, by the Contracting Officer via a bilateral modification.

LOSS OR DAMAGE

The contractor shall be liable for any loss or damage to any government property caused by negligence, theft, or willful misconduct of the contractor, his agents, servants, and employees, and shall indemnify and save the government harmless against all actions, proceedings, claims, demands, costs, damages, and expenses, including attorney’s fees, by reason of any suit or action brought for any actual or alleged injury to or resulting from the performance of this contract. The contractor shall submit a full written report to the Contracting Officer within 24 hours following the occurrence of such damage, loss, or injury.

If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the contractor shall be responsible for same. The government, at its option, may in lieu of repayment, require the contractor to replace at his own expense, all such property as directed by the Contracting Officer. Until the equipment is repaired or replaced, the contractor shall furnish similar, adequate replacement property and/or equipment at no charge to the government, within two working days of the date the equipment has been lost, stolen, or damaged.

CONTRACT ADMINISTRATION

The National Park Service, Contract Specialist / Contracting Officer address is: National Park Service, Harpers Ferry Center, Office of Acquisition Management, P.O. Box 50, 67 Mather Place, Harpers Ferry, West Virginia 25425-0050.

A. The contractor shall use the Contracting Officer as a point of contact on all business and administrative matters concerning this contract. All correspondence, other than that of a technical nature, shall be addressed to the Contracting Officer, with information copies of the basic correspondence to the COR.

B. The National Park Service, COR address is: National Park Service, Harpers Ferry Center, Attention: COR, P.O. Box 50, Harpers Ferry, West Virginia 25425-0050.

The contractor shall use the COR as the point of contact for all technical matters under the contract. Technical correspondence shall be addressed to the NPS COR, with an information copy of the basic correspondence to the Contracting Officer.

FACILITY SECURITY POLICY

Contractors attending meetings or accomplishing work within the buildings or real property of the National Park Service shall adhere to the security policy of each office. It shall be the responsibility of the contractor to contact the office before work begins for a briefing on security policies.

WARRANTY

The contractor shall guarantee the workmanship against defects in work and material that might appear under extremely high visitor use and variable weather and climate conditions for a minimum of one year. The warranty period shall commence with final acceptance of work. This shall include all labor and parts at no additional cost to the government.

If during this warranty period, defective workmanship, materials, or equipment are identified by the government, the contractor will be notified, in writing, as to liability and responsibility for corrective action at no cost to the government.

Action may include but is not limited to:

A. Placing all work into satisfactory condition.

B. Making good all damages to equipment, the site, the building, or contents thereof, that have resulted from such unsatisfactory work; and

C. Making good any work, materials, or equipment that are disturbed in fulfilling the guarantee including any work, materials, or equipment that may have been guaranteed under another contract.

Should the contractor fail to proceed with work in accordance with the guarantee within seven calendar days from the notice of corrective action(s), the government will have such work performed at the expense of the contractor.

In no event will the government be responsible for any extension or delays in the scheduled deliverables or periods of performance under this contract as a result of the contractor’s obligations to correct defects, nor shall there be any adjustment of the delivery schedule or period of performance as a result of the correction of defects unless provided by a supplemental agreement with adequate consideration.

If the government returns any work to the contractor for correction or replacement under this contract, the contractor shall be liable for transportation charges up to an amount equal to the cost of transportation by the usual commercial method of shipment from the place of delivery specified in the contract (irrespective of the F.O.B. point or the point of acceptance) to the contractor’s plant and return to the place of delivery specified in the contract. The contractor shall also bear the responsibility for the work while in transit.

The contractor shall be liable for the reasonable costs, including travel of personnel, and disassembly and reassembly of larger items when it is necessary to remove the work to be inspected and returned for correction or replacement.

52.204-30 Federal Acquisition Supply Chain Security Act Orders—Prohibition (Dec 2023)

(a) Definitions. As used in this clause—

Covered article, as defined in 41 U.S.C. 4713(k), means— https://www.ipp.gov/ mailto:IPPCustomerSupport@fiscal.treasury.gov

(1) Information technology, as defined in 40 U.S.C. 11101, including cloud computing services of all types;

(2) Telecommunications equipment or telecommunications service, as those terms are defined in section 3 of the Communications Act of 1934 (47 U.S.C. 153);

(3) The processing of information on a Federal or non-Federal information system, subject to the requirements of the Controlled Unclassified Information program (see 32 CFR part 2002); or

(4) Hardware, systems, devices, software, or services that include embedded or incidental information technology.

FASCSA order means any of the following orders issued under the Federal Acquisition Supply Chain Security Act (FASCSA) requiring the removal of covered articles from executive agency information systems or the exclusion of one or more named sources or named covered articles from executive agency procurement actions, as described in 41 CFR 201–1.303(d) and (e):

(1) The Secretary of Homeland Security may issue FASCSA orders applicable to civilian agencies, to the extent not covered by paragraph (2) or (3) of this definition. This type of FASCSA order may be referred to as a Department of Homeland Security (DHS) FASCSA order.

(2) The Secretary of Defense may issue FASCSA orders applicable to the Department of Defense (DoD) and national security systems other than sensitive compartmented information systems.

This type of FASCSA order may be referred to as a DoD FASCSA order.

(3) The Director of National Intelligence (DNI) may issue FASCSA orders applicable to the intelligence community and sensitive compartmented information systems, to the extent not covered by paragraph (2) of this definition. This type of FASCSA order may be referred to as a DNI FASCSA order.

Intelligence community, as defined by 50 U.S.C. 3003(4), means the following—

(1) The Office of the Director of National Intelligence;

(2) The Central Intelligence Agency;

(3) The National Security Agency;

(4) The Defense Intelligence Agency;

(5) The National Geospatial-Intelligence Agency;

(6) The National Reconnaissance Office;

(7) Other offices within the Department of Defense for the collection of specialized national intelligence through reconnaissance programs;

(8) The intelligence elements of the Army, the Navy, the Air Force, the Marine Corps, the Coast Guard, the Federal Bureau of Investigation, the Drug Enforcement Administration, and the Department of Energy;

(9) The Bureau of Intelligence and Research of the Department of State;

(10) The Office of Intelligence and Analysis of the Department of the Treasury;

(11) The Office of Intelligence and Analysis of the Department of Homeland Security; or

(12) Such other elements of any department or agency as may be designated by the President, or designated jointly by the Director of National Intelligence and the head of the department or agency concerned, as an element of the intelligence community.

National security system, as defined in 44 U.S.C. 3552, means any information system (including any telecommunications system) used or operated by an agency or by a contractor of an agency, or other organization on behalf of an agency—

(1) The function, operation, or use of which involves intelligence activities; involves cryptologic activities related to national security; involves command and control of military forces; involves equipment that is an integral part of a weapon or weapons system; or is critical to the direct fulfillment of military or intelligence missions, but does not include a system that is to be used for routine administrative and business applications (including payroll, finance, logistics, and personnel management applications); or

(2) Is protected at all times by procedures established for information that have been specifically authorized under criteria established by an Executive order or an Act of Congress to be kept classified in the interest of national defense or foreign policy.

Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of any covered articles, or any products or services produced or provided by a source. This applies when the covered article or the source is subject to an applicable FASCSA order. A reasonable inquiry excludes the need to include an internal or third-party audit.

Sensitive compartmented information means classified information concerning or derived from intelligence sources, methods, or analytical processes, which is required to be handled within formal access control systems established by the Director of National Intelligence.

Sensitive compartmented information system means a national security system authorized to process or store sensitive compartmented information.

Source means a non-Federal supplier, or potential supplier, of products or services, at any tier.

(b) Prohibition.

(1) Unless an applicable waiver has been issued by the issuing official, Contractors shall not provide or use as part of the performance of the contract any covered article, or any products or services produced or provided by a source, if the covered article or the source is prohibited by an applicable FASCSA orders as follows:

(i) For solicitations and contracts awarded by a Department of Defense contracting office, DoD FASCSA orders apply.

(ii) For all other solicitations and contracts DHS FASCSA orders apply.

(2) The Contractor shall search for the phrase “FASCSA order” in the System for Award Management (SAM) at https://www.sam.gov to locate applicable FASCSA orders identified in paragraph (b)(1).

(3) The Government may identify in the solicitation additional FASCSA orders that are not in SAM, which are effective and apply to the solicitation and resultant contract.

(4) A FASCSA order issued after the date of solicitation applies to this contract only if added by an amendment to the solicitation or modification to the contract (see FAR 4.2304(c)). However, see paragraph (c) of this clause.

(5)

(i) If the contractor wishes to ask for a waiver of the requirements of a new FASCSA order being applied through modification, then the Contractor shall disclose the following:

(A) Name of the product or service provided to the Government;

(B) Name of the covered article or source subject to a FASCSA order;

(C) If applicable, name of the vendor, including the Commercial and Government Entity code and unique entity identifier (if known), that supplied or supplies the covered article or the product or service to the Offeror;

(D) Brand;

(E) Model number (original equipment manufacturer number, manufacturer part number, or wholesaler number);

(F) Item description;

(G) Reason why the applicable covered article or the product or service is being provided or used;

(ii) Executive agency review of disclosures. The contracting officer will review disclosures provided in paragraph (b)(5)(i) to determine if any waiver is warranted. A contracting officer may choose not to pursue a waiver for covered articles or sources otherwise covered by a FASCSA order and to instead pursue other appropriate action.

(c) Notice and reporting requirement.

(1) During contract performance, the Contractor shall review SAM.gov at least once every three months, or as advised by the Contracting Officer, to check for covered articles subject to FASCSA order(s), or for products or services produced by a source subject to FASCSA order(s) not currently identified under paragraph (b) of this clause.

(2) If the Contractor identifies a new FASCSA order(s) that could impact their supply chain, then the Contractor shall conduct a reasonable inquiry to identify whether a covered article or product or service produced or provided by a source subject to the FASCSA order(s) was provided to the Government or used during contract performance.

(3)

(i) The Contractor shall submit a report to the contracting office as identified in paragraph (c)(3)(ii) of this clause, if the Contractor identifies, including through any notification by a subcontractor at any tier, that a covered article or product or service produced or provided by a source was provided to the Government or used during contract performance and is subject to a FASCSA order(s) identified in paragraph (b) of this clause, or a new FASCSA order identified in paragraph (c)(2) of this clause. For indefinite delivery contracts, the Contractor shall report to both the contracting office for the indefinite delivery contract and the contracting office for any affected order.

(ii) If a report is required to be submitted to a contracting office under (c)(3)(i) of this clause, the Contractor shall submit the report as follows:

(A) If a Department of Defense contracting office, the Contractor shall report to the website at https://dibnet.dod.mil.

(B) For all other contracting offices, the Contractor shall report to the Contracting Officer.

(4) The Contractor shall report the following information for each covered article or each product or service produced or provided by a source, where the covered article or source is subject to a FASCSA order, pursuant to paragraph (c)(3)(i) of this clause:

(i) Within 3 business days from the date of such identification or notification:

(A) Contract number;

(B) Order number(s), if applicable;

(C) Name of the product or service provided to the Government or used during performance of the contract;

(D) Name of the covered article or source subject to a FASCSA order;

(E) If applicable, name of the vendor, including the Commercial and Government Entity code and unique entity identifier (if known), that supplied the covered article or the product or service to the Contractor;

(F) Brand;

(G) Model number (original equipment manufacturer number, manufacturer part number, or wholesaler number);

(H) Item description; and

(I) Any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (c)(4)(i) of this clause:

(A) Any further available information about mitigation actions undertaken or recommended.

(B) In addition, the Contractor shall describe the efforts it undertook to prevent submission or use of the covered article or the product or service produced or provided by a source subject to an applicable FASCSA order, and any additional efforts that will be incorporated to prevent future submission or use of the covered article or the product or service produced or provided by a source that is subject to an applicable FASCSA order.

(d) Removal. For Federal Supply Schedules, Governmentwide acquisition contracts, multi-agency contracts or any other procurement instrument intended for use by multiple agencies, upon notification from the Contracting Officer, during the performance of the contract, the Contractor shall promptly make any necessary changes or modifications to remove any product or service produced or provided by a source that is subject to an applicable FASCSA order.

(e) Subcontracts.

(1) The Contractor shall insert the substance of this clause, including this paragraph (e) and excluding paragraph (c)(1) of this clause, in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial products and commercial services.

(2) The Government may identify in the solicitation additional FASCSA orders that are not in SAM, which are effective and apply to the contract and any subcontracts and other contractual instruments under the contract. The Contractor or higher-tier subcontractor shall notify their subcontractors, and suppliers under other contractual instruments, that the FASCSA orders in the solicitation that are not in SAM apply to the contract and all subcontracts.
