This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in
Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
Solicitation Number 140P2123R0053 is issued as a Request for Proposal (RFP) constitutes the entire solicitation. Proposals and price quotations with detailed breakdown are being requested. This acquisition will be conducted pursuant to FAR Part 13. This solicitation document incorporates all mandatory commercial item provisions and clauses in effect through Federal Acquisition Circular 2023-04, effective June 2, 2023.
This is set aside for small business concerns under the North American Industry Classification System (NAICS)
541490, Other Specialized Design Services with a related small business size standard of $13.5 million dollars.
The government anticipates award of one (1) best value, firm-fixed price contract.
REQUIREMENT: The contractor shall provide all services including labor, materials, equipment, facilities, and travel necessary to design and fabricate Phase 2 wayside exhibits for the remaining 300-series trailhead panels including updated layouts with bilingual (Spanish and English) text for Joshua Tree National Park
(JOTR) in Twentynine Palms, California, in accordance with the specifications as detailed in this contract and its attachments.

WAYSIDE EXHIBIT DESIGN AND FABRICATION SERVICES
JOSHUA TREE NATIONAL PARK
1. PROJECT BACKGROUND
Two distinct desert ecosystems—the Mojave and the Colorado—come together in Joshua
Tree National Park (JOTR). A fascinating variety of plants and animals make their homes in a land sculpted by strong winds and occasional torrents of rain. Dark night skies, a rich cultural history, and surreal geologic features add to the wonder of this vast wilderness in southern California.
In 2021, a comprehensive wayside proposal was created for JOTR. At that time a select number of interpretive wayside exhibits were completed. This Phase 2 project will build off the existing wayside proposal (Attachment C, JOTR Revised Final Wayside Proposal) to complete the remaining 300-series trailhead panels including updated layouts with bilingual (Spanish and English) text. The updated designs are intended to meet the needs of a variety of language-speakers beyond English and Spanish due to the high level of international visitors to the park. Visual messaging regarding trail safety, park resources protection, and trail access should be a priority rather than a text-based approach. Spanish and English text should be co-created alongside each other to create a more cohesive and effective presentation.
2. SCOPE AND OBJECTIVES
The project shall be for the design and fabrication of wayside exhibits for Joshua Tree
National Park in Twentynine Palms, California. The project includes coordination with the
Contracting Officer (CO), Contracting Officer’s Representative (COR), and park staff.
The contractor shall provide all services including labor, materials, equipment, facilities, and travel necessary to perform the work in accordance with the specifications as detailed in this contract and its attachments.
2.1 General Requirements
2.1.1 Project Management
The Project Manager shall schedule, coordinate, oversee, and manage work produced under this contract.
The Project Manager shall be the single point of contact between the contractor and the COR. The Project Manager shall be in contact with the
COR on no less than a monthly basis.
In addition, the Project Manager shall perform the following work:
1. Quality Control
Provide quality control to ensure that all elements of project work meet the requirements of the contract specifications. Provide routine inspections of in-house and subcontracted work. Ensure that all work not acceptable or compliant with the specifications is corrected prior to inspection or review by the COR.
2. Schedule
The contractor shall prepare an overall project schedule including milestone dates for all submittals, fabrication, and submit to the
COR for approval. The contractor shall track all work progress to ensure that the project is completed according to the schedule. The contractor shall coordinate and confirm the dates for all work with the COR. The contractor shall notify the COR in advance, in writing when work shall not be completed by the dates in this contract and provide an updated schedule for completion.
3. Meetings
The project manager shall be present at all project meetings. The contractor shall coordinate with the COR to schedule the following meetings:

4. Submittals
At any point in the planning and design process the COR may require informal submittals of the contractor’s work-in-progress to document the current status and level of production of the project.
Coordinate all contractor and subcontractor submittals and review them for legibility, accuracy, completeness, and compliance with contract requirements prior to submitting to the COR for distribution.
Forward all submittals to the COR for distribution, review, and approval. Receive all reviewed submittals and take appropriate action according to the approval or rejection by the COR.
1) Approved Submittals
Ensure that all changes, revisions, or additions are noted, and shop drawings, and instructions are revised, updated, and forwarded to the COR.
2) Rejected Submittals
When submittals are rejected, the COR shall notify the
Project Manager, in writing, identifying the reasons for rejection. The Project Manager shall revise and/or correct and resubmit, identifying changes.
2.1.2 Accessibility
Wayside exhibits planned, designed, and fabricated for the National Park
Service (NPS) shall follow the latest published version of Attachment B, Programmatic Accessibility Guidelines. These guidelines are a combination of best practices, NPS and Department of the Interior directives, and federal laws. Federal laws include the Architectural Barriers Act, Sections 504 and
508 of the Rehabilitation Act as amended, and the 21st Century
Communications and Video Accessibility Act.
Accessibility requirements for visitors with specific disabilities shall be addressed within the designed exhibits. If design decisions pose challenges to accessibility (such as inaccessible location of outdoor exhibit), additional attention shall be paid to a full description of the accessibility solutions. See
Attachment B, Programmatic Accessibility Guidelines requirements addressed under specific disabilities.
3. PLANNING AND DESIGN SERVICES
Work shall include planning and designing wayside exhibits services. See Attachment A, Wayside Exhibit Specifications.
3.1 Exploration of updated bilingual text layout options
Create draft layouts of two (2) representative, 300-series trailhead exhibits. Provide three (3) options of revised layouts. Exhibits selected shall not duplicate those created in Phase 1 (Exhibits 304, 306A, 307A, 308A, 309A, 310, 316, 319, 320, 321, 324, 332). See Attachment C, JOTR Revised Final Wayside Proposal.
Proposed options shall include revisions to the proposed/existing trailhead layouts prepared in Phase 1 to include bilingual text. Options shall reflect attempts to communicate vital information in visual ways through icons/graphics to meet the needs of a wide variety of language speakers. Trail maps (including access data) and safety and resource protection messages should be a primary focus for each layout option presented. Smaller inset photos of trailside locations may be used in place of a single, large background image. Visual messaging should be prioritized over text-based solutions.
3.2 Draft Wayside Exhibit Plan
Create wayside plan for up to twenty-two (22) exhibits based the approved bilingual text layout option.
3.3 Revised Wayside Plan
Create wayside plan for up to twenty-two (22) exhibits based the approved Draft
Wayside Exhibit Plan option.
3.4 Final Wayside Plan
From approved final Revised Wayside Exhibit Plan, create production ready files for up to twenty-two (22) wayside exhibits.
3.5 Bilingual Text—Contractor shall create all text following NPS standards found in
Attachment J, Typographic Standards and Attachment K, Style Guide. Spanish text should reflect intent rather than direct, word-for-word translation. See Attachment
D, Spanish Style Guide for guidelines.
3.6 Graphics—Contractor shall research and obtain use rights (outside of stock photography or government furnished materials) for up to five (5) images that allows for an image or PDF of the wayside exhibit to be displayed by the government in other media to promote or display the wayside exhibit. Most contemporary images to be provided by the government upon request.
3.7 Maps—create the following maps according to Attachment G, Wayside Map
Standards. See Attachment F, Sample Maps and Access Data. Maps shall match existing style as seen in Attachment P, JOTR Final Wayside Plan-Phase 1.
3.7.1 Update up to seventeen (17) existing 2D area-specific trail maps including relief.
3.7.2 Create up to four (4) 3D, oblique view area-specific trail maps to illustrate complex landscapes
3.8 Interactive Tactile—Create one (1) interactive musical tactile element. See
Attachment N, Tactile References. Tactile shall be constructed of materials that withstand outdoor weather elements and constant touching and do not become too hot to the touch in direct sunlight and high desert temperatures.
Interactive tactile shall allow visitors to create musical sounds. Tactile shall be mounted directly to Exhibit 335 vertically at an accessible height.
3.9 Audio Description
Create audio description text for up to twenty-two (22) wayside exhibits. Audio description content shall describe each wayside element, images/items within the wayside element, tactile elements, all text within the wayside element, and what the sighted visitor sees in the surrounding vistas related to subject being interpreted.
Audio description should be developed as described in Attachment Q, Audio
Description.
4. FABRICATION
Work shall include fabrication of panels, bases, and tactile elements.
4.1 Fabricate the following high-pressure laminate (HPL) panels for outdoor use. All panels shall have a 10-year warrantee against fading, warping, and delaminating.
• Ten (10) – 36” x 48”
• Nine (9) – 24” x 36”
• Three (3) – 72” x 48”
4.2 Fabricate the following painted aluminum bases with cane strike bars in accordance with Attachment E, VIS Manual. Paint color shall be NPS Brown. All painted aluminum bases shall have a spatter coat finish. Powder coating is not acceptable.
All bases shall have a 10-year warrantee against structural failure. Two existing bases will be reused.
• Eight (8) – 36” x 48” upright, in-ground
• Eight (8) – 24” x 36” upright, in-ground
• One (1) – 24” x 36” upright, baseplate
• Three (3) – 72” x 48” upright, in ground
4.3 Fabricate the following interactive tactile with raised letters, Braille, and mounting hardware. All tactile elements shall have a 10-year warrantee against structural failure. See Attachment N, Tactile references for reference information.
• Interactive musical tactile
5. PACKAGING AND DELIVERY
All deliverables shall be shipped Free On Board (FOB) destination, within consignee’s premises, with all shipping and transportation costs prepaid, unless otherwise specified below. Deliverables shall be shipped by either registered or certified mail to ensure that shipments can be traced, if lost. No loading dock is available at park—ensure lift gate is included with delivery vehicle for unloading. Park must be notified no less than three (3) days prior to final delivery of panels, bases, and tactile element. Delivery will only be accepted Monday through Thursday.

5.1.7 Production-Ready Files
- Two sets of full-size color prints of each wayside exhibit. One set mailed to the COR and one set mailed to the park.
- Two sets of sample materials. Each set shall contain one (1) painted aluminum with splatter coat finish, one (1) HPL panel. All samples shall be larger than 2”x2” but not larger than 10”x10”. One set mailed to the
COR and one set mailed to the park. Samples shall be representative of final product to be delivered.
-PDF of final fabrication drawings for hardware and interactive tactile element.
-PDF of updated schedule, emailed to COR.
-Word Document of revised audio description text.
5.1.8 Prototype of interactive tactile mailed to the park.
- One (1) 50% to scale 3D printed model of interactive tactile.
5.1.9 Fabricated wayside exhibit elements including panels, bases, interactive tactile, and two (2) 1/2 pints of NPS Brown touch up paint for the bases mailed to the park. No loading dock is available at park—ensure lift gate is included with delivery vehicle for unloading.

Review and approval of the deliverables shall be completed within 45 calendar days.
The COR shall notify the Contractor, in writing, of approval or rejection of the work.
In the event the government delays comments beyond the period specified, the contractor shall be entitled to a day-to-day extension in the completion date.

10. TRAVEL
In accordance with Public Law 99-234, "Federal Civilian Employee and Contractor Travel
Expense Act of 1985", travel-related expenditures for contractor's personnel are restricted to the limits established for federal employees. This includes mileage for company-owned vehicles.
The contractor shall travel as required to support program tasks. All travel arrangements are to be made by the contractor. Payment for transportation, per diem, mileage, parking, and other fair and reasonable travel expenses will be paid in accordance with the effective
Federal Travel Regulations as amended and supplemented by the Department of the
Interior travel regulations where applicable. No Federal travel authorizations are to be issued. The contractor shall make every effort to keep travel costs to a minimum. No reimbursement will be made for parking at a contractor's normal place of work. No overhead, profit or G&A shall be allowed on travel costs.
Travel costs shall be reimbursed in accordance with the Federal Travel Regulations. Travel is only funded to the extent specified within the travel CLIN. The contractor shall not incur any travel costs in excess of the amount funded within the travel CLIN. The government shall not be liable for any travel related costs incurred by the contractor which are in excess of the total amount funded within the travel CLIN.
If the contractor has reason to believe they may exceed the amount funded on the travel
CLIN, they shall notify the government Contracting Office immediately. Additional funding may only be added to the travel CLIN through a formal signed modification issued by a government Contracting Officer. Profit, fee, G&A or overhead may not be incurred on travel costs.
11. INVOICING
Electronic Invoicing and Payment Requirements - Invoice Processing Platform
(IPP)
(April 2013)
Payment requests must be submitted electronically through the U. S. Department of the
Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions -
Commercial Items included in commercial item contracts. The IPP website address is:

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
Invoice to be on company letterhead with stated contract number.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the
Contracting Officer with its proposal or quotation. (End of Local Clause)
12. ADDITIONAL WORK
Any additional work not detailed in this contract shall be approved, in writing, by the
Contracting Officer via a bilateral modification.

13. LOSS OR DAMAGE
The contractor shall be liable for any loss or damage to any government property caused by negligence, theft, or willful misconduct of the contractor, his agents, servants, and employees, and shall indemnify and save the government harmless against all actions, proceedings, claims, demands, costs, damages, and expenses, including attorney’s fees, by reason of any suit or action brought for any actual or alleged injury to or resulting from the performance of this contract. The contractor shall submit a full written report to the
Contracting Officer within 24 hours following the occurrence of such damage, loss, or injury.
If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the contractor shall be responsible for same. The government, at its option, may in lieu of repayment, require the contractor to replace at his own expense, all such property as directed by the Contracting Officer. Until the equipment is repaired or replaced, the contractor shall furnish similar, adequate replacement property and/or equipment at no charge to the government, within two business days of the date the equipment has been lost, stolen, or damaged.
14. CONTRACT ADMINISTRATION
A. The National Park Service, Contract Specialist / Contracting Officer address is:
National Park Service, Harpers Ferry Center, Office of Acquisition Management, P.O. Box 50, 67 Mather Place, Harpers Ferry, West Virginia 25425-0050.
The contractor shall use the Contracting Officer as a point of contact on all business and administrative matters concerning this contract. All correspondence, other than that of a technical nature, shall be addressed to the Contracting Officer, with information copies of the basic correspondence to the COR.

Center, Attention: COR, P.O. Box 50, Harpers Ferry, West Virginia 25425-0050.
The contractor shall use the COR as the point of contact for all technical matters under the contract. Technical correspondence shall be addressed to the NPS COR, with an information copy of the basic correspondence to the Contracting Officer.
15. DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (SEPT 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative
(COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes
Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting
Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.
The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting
Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk. (End of clause)
16. CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM
NOTICE TO CONTRACTORS
Contractor Performance Assessment Reporting System (December 2015)
A. FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor
Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.
B. The past performance evaluation process is a totally paperless process using
CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the
Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
C. We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO).
Information in the report must be protected as source selection sensitive information not releasable to the public.
D. When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.
E. Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.
a. Contractor Representatives may then provide comments in response to the evaluation or return the evaluation without comment.
b. Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.
c. All information provided should be reviewed for accuracy prior to submission.
d. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.
e. Your response is due within 60 calendar days after receipt of the CPAR. On day
15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

f. If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."
F. The following guidelines apply concerning your use of the past performance evaluation:
a. Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.
b. Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
c. Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.
G. If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.
H. A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized. (End of Local Clause)
17. KEY PERSONNEL

B. During the first 90 days of performance, the Contractor shall make no substitution of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer as least 15 days prior to making a permanent substitution.
C. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitution, complete resumes for the proposed substitute, and any additional information requested by the Contracting Officer. The proposed substitute should have comparable qualifications to those of the person being replaced. The
Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitution. This clause will be modified to reflect any approved changes of key personnel.
18. FACILITY SECURITY POLICY
Contractors attending meetings or accomplishing work within the buildings or real property of the National Park Service shall adhere to the security policy of each office. It shall be the responsibility of the contractor to contact the office before work begins for a briefing on security policies.
