This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested. Solicitation Number 140P2122R0037 is issued as a Request for Proposal (RFP) constitutes the entire solicitation. Proposals and price quotations with detailed breakdown are being requested. This acquisition will be conducted pursuant to FAR Part 13. This solicitation document incorporates all mandatory commercial item provisions and clauses in effect through Federal Acquisition Circular 2022-07, effective August 10, 2022. This is a small business set-aside. The North American Industry Classification System (NAICS) code is 339950, Sign Manufacturing, and the related small business size standard is 500 employees.

REQUIREMENT: The contractor shall provide all services including labor, materials, equipment, facilities, and travel necessary to complete planning and design services for Minute Man National Historical Park in Lexington, Massachusetts in accordance with the specifications as detailed in this solicitation and its attachments.

The government anticipates award of one best value, firm-fixed price contract resulting from this solicitation.

PLAN AND DESIGN SIGNAGE

MINUTE MAN NATIONAL HISTORICAL PARK

I. BACKGROUND AND PURPOSE

Minute Man National Historical Park is a seven-mile linear park with four distinct units, that spans three towns – Concord, Lincoln, and Lexington, Massachusetts – and attracts more than one million visitors a year. The park’s mission is to preserve the historic sites, structures, properties, and landscapes associated with the opening battles of the American Revolution. The Park also preserves resources related to America’s literary tradition, including the Wayside, home of three nineteenth century American authors. The Park maintains some 200 assets, including about 1,000 acres of maintained landscape and 12 witness structures that were present at the time of the Battles of Lexington and Concord on April 19, 1775. In 2025, the park will commemorate the 250th anniversary of those battles and anticipates numerous special events and increased visitation.

Minute Man National Historical Park has never had a comprehensive sign plan for the entirety of the park; a comprehensive sign plan will allow for signage at the park to work cohesively, make sign ordering easier, reduce sign clutter, and ultimately be more cost effective than piecemealing signs together over time.

II. SCOPE AND OBJECTIVES

The contractor shall provide the National Park Service with all with all labor, materials, equipment, facilities, and travel necessary to complete planning and design services for Minute Man National Historical Park.

Planning and Design shall include recommendations that consider, but are not limited to, Attachment A – Minute Man National Historical Park Map, Attachment B – Survey, and Attachment C – Survey Map.

The planning and design scope of work shall include all signage for areas within the park boundaries including three communities – Concord, Lincoln, and Lexington -- and is surrounded by public institutions and tourist destinations.

The 1,083-acre park includes 4 distinct units -- Barnett’s Farm Unit: 64 acres, North Bridge Unit:

114 acres, The Wayside: 13 acres, and the Battle Road Unit: 847 acres. It also includes 10 parking lots, 12 entrance roads, 10 miles of multi-use trails that consist of 7 distinct named trails, 43 National Register listed buildings including 12 American Revolution witness structures, 5 comfort station/public restroom facilities, 6 river/stream/wetland crossings, more than 10 road crossings, and several trail sections with steep grades and turns. All of these resources need associated signs for guidance and safety. The park is also part of a National Heritage Area, a Scenic Byway, and the Regional Bay Circuit Trail -- with shared access points and parking lots.

Collaboration and coordination for signs and parking is essential. The scope of work shall include signing vehicular routes that traverse the park and designs for motorist guide signs along major access routes to the park outside of park boundaries, signs for pedestrian and pedestrian/bike trails, and temporary/seasonal signage within the park.

This plan will consist of park owned and partner owned sites. Park partners also include Massachusetts Department of Transportation (MASSDOT), Battle Road Scenic Byway Committee, Freedom’s Way National Heritage Area, and the towns of Concord, Lexington, and Lincoln.

Visitors arrive to the park from the highway to a series of surface streets to the Minute Man Visitor Center and the Parking Area in Lexington. If arriving from the west, Visitors will arrive at the North Bridge Contact Station/Park Headquarters in Concord. Visitors will either leave their car at the parking area and walk or drive to the different sites within the park boundaries. The site is surrounded by business and residential areas which must be considered in the design and placement of identity, wayfinding and information signs for park visitors. The park also features one town-managed historic home (The Robbins House). Additional historic sites are adjacent to but not within the park boundary and are managed by non-profits including the Old Manse, managed by The Trustees of Reservations (within the authorized park boundary); the Concord Museum; Emerson House; and Alcott House.

The contractor shall prepare a final fabrication package detailing all sign layouts, structures, materials, colors, paints, footer and other structural components, and panel art. Final fabrication documents shall be supplied in the native design program such as Adobe Illustrator and via pdf.

The final sign plan and all supporting documents shall be organized in a way that makes it easy to understand the types of signs, their location, quantity and specification. The final plan shall include the Sign Panel Layouts and Structures with Fabrication Details, Sign Location Plan, and Sign Demolition Plan.

All sign designs shall be prepared in accordance with the NPS Sign Standards and the appropriate local area and park partner sign standards when indicated. NPS standards provide defined grids, sign types, layouts, colors, typography, and structures for all NPS signs. Sign structures may be modified as required to reflect the character of the park or local setting. Sign panel designs and structures may be modified from NPS standards to meet local sign ordinances, incorporate elements of partner sign design standards including logos, or as required to meet state and other local code considerations for highway vehicular signs and motorist signs within areas already covered by a system of cohesively designed vehicular wayfinding signs. Variations to NPS standards shall be proposed in the initial design phases and all variations shall be approved by the NPS Sign Program Office and the park.

Attachments D though T contains Sign Standards Manuals and other contractor resources for design and producing NPS signs.

Planning and design shall cover all park signage including the following component areas and sign types:

A. Component Areas:

1. Motorist Guidance Signs

Off-Site

This includes motorist guide signs on approaching highways, interstates, and neighboring surface streets leading to Minute Man National Historical Park.

Vehicular signs shall follow the NPS Sign Standards, Federal Highway Administration, and the Massachusetts Department of Transportation (MASSDOT) design Standards.

On-Site

This includes motorist guide signs on surface streets within the park site that provides direction to site specific areas. Signs in this component include site pathfinders, motorist advance guide signs for park sites traffic and parking regulatory signs within the park boundary. Motorist Guidance signs shall follow the NPS Sign Standards, Federal Highway Administration, and the Massachusetts Department of Transportation (MASSDOT) design Standards.

2. Visitor Information System (Pedestrian) Signs

This component shall include the design of a series of standard pedestrian signs utilizing standard NPS hardware that include maps, park information, mileage, rules and regulations, and park site information. These signs are to inform and guide pedestrians. The contractor shall include the design for all pedestrian signs providing directional information and distance. All pedestrian routes and mileages will require ground-truthing by the contractor. The sign system devised for trailheads shall also include options for trailhead brochure dispensers. Pedestrian signs to include but not limited to site orientation kiosks, fingerboard directionals, standard sign panel directions, warnings/ cautions, regulations, restrooms, things to do, hours, and ADA Signs. Pedestrian signs should follow the NPS Sign Standards for Visitor Information System. Some important pedestrian signs may require Spanish language which the contractor will be responsible for translating and proofreading. Google Translate is not an acceptable source. Spanish Translations will be needed for 10 or less signs if required.

3. Park and Facility Identity Signs

This component includes park and facility identity signs for park managed sites.

Identity signs must be based on NPS Identity Sign standards. Signs that reflect partnerships with the NPS must accurately show who manages the site.

Approximately between 35 and 45 identity signs will be drawn by a designer at

Harpers Ferry Center. These signs will include visitor center identity, small facility identity, historic building/house identifiers, and private residence signs.

These drawings will be given to the contractor after award to incorporate into their sign plan. The contractor shall use the design of these signs to base additional identity signs that are needed.

NPS sign types covered under this scope of work include Park and Facility

Identity Signs, Motorist Guide Signs, and Visitor Information Signs.

B. Tasks 1 through 4

This contract includes the components outlined above and is divided into the following tasks:

1. Task 1 - Project Overview and Existing Conditions Documentation

1.1. Kick-Off Meeting and Site Visit

Conduct a kick-off meeting with the Contracting Officer’s Representative (COR) and Minute Man National Historical Park staff to establish parameters of the project, project scope and sign components, review of NPS Sign Standards, establish the master schedule, major review meetings, project review process, approval strategy, and overall design approach and clarify other items that will lead to project success. This trip shall also include site visit including an orientation tour of the site and its major program areas. During the orientation tour the contractor along with the park and COR will also meet the partners that are located within the park boundaries.

During the site visit, if possible, a meeting will take place with the contractor, COR, park staff, representatives from the Towns of Concord, Lexington and Lincoln, Freedom’s Way National Heritage Area, and the Battle Road Scenic Byway Committee to present the project and highlight wayfinding needs.

Prepare written summary meeting notes including project parameters and other scope of work decisions.

a. Survey Site and Locate All Existing Signs

The contractor shall survey and locate all existing signs currently installed in the park and signs directing to MIMA sites on approaching highways, interstates, and neighboring surface streets. The purpose of this pre-design component is that it will identify any current signs in place, allow assessment of current site conditions, provide a strategy for understanding the site, determine limitations in locating new signs, provide information on footer requirements and other mounting techniques required for the site signs and provide the final demolition plan for sign removal in accordance with Attachment B: Survey.

b. Develop Existing Sign Survey

Prepare a sign survey document which contains photographic references for all current site conditions in a format that is easy to read and understand.

1.4 Develop Existing Sign Location Map

Prepare a map showing the locations of all existing signs with numerical identifier that corresponds to the numerical identifiers in 1.3.

1.5 Submit existing conditions documentation

2. Task 2 - Sign Planning and Locating

2.1 Develop a Visual Sign Type Menu

The contractor shall develop a Visual Sign Type Menu for all signs required based on site surveys, discussion with the park, review of NPS Sign Standards and examples, review of pertinent DOT sign standards, and visual identity elements (Attachments D-T) and understanding of project goals. The Sign Type Menu should display sample formats, colors, and fabrication concept drawings for every type of sign the contractor is proposing to include in the sign master plan.

2.2 Develop a Sign Message Programming

The contractor shall provide messaging by sign type for park review including key messaging strings for Identity Signs, off-site and on-site Motorist Guide Signs, and Visitor Information Signs.

2.3 Develop a New Sign Location Plan

The sign location plan shall include all sign types numerically keyed and located.

2.4 Develop a Sign Demolition Plan

This sign demolition plan shall include site with all existing signs that should be removed or kept.

2.5 Present design ideas, new sign locations, and sign messaging via virtual meeting.

2.6 Submit Visual Sign Type Menu, Sign Message Programming, Sign

Location Plan and Sign Demolition Plan.

3. Task 3 - Sign Drawings and Location Plan

Based on the approved Task 2 documents, the contractor shall develop sign plan documents including creating all sign type drawings with layouts and dimensions, color schemes, proposed mounting and structural design, specifications, and a developed sign location plan. Components of this task shall include:

4. Task 4 - Submit Final Documentation

The contractor shall submit all final and approved files from Task 1 through 3, Design-Intent Fabrication Drawings with Specifications and Location Plans, to include a pdf set of drawings, the drawings in the native design program, all design, production specification, location and demolition plans, map and art files required to fabricate the final signs. The production files shall include all necessary specifications, including hi-res production files, art, map art, and supporting files. Production files shall be delivered and prepared per the NPS submission guidelines. The final plan shall include the Final Sign Type Drawings with Layouts and Details, Sign Location Plan, and Sign Demolition Plan.

III. DELIVERABLES AND DESTINATION POINT

All sign designs shall be prepared in accordance with the National Park Service Sign Standards.

These standards provide defined grids, sign types, layouts, colors, typography, and structures for all NPS signs. Sign design and structures may be modified as required to reflect the character of the park and to conform to Sign Standards. Where applicable, sign designs may vary in material nature and where required to meet state and other local code considerations for highway and vehicular signs. Variations to NPS standards shall be proposed in the initial design phases and all variations shall be approved by the NPS Sign Program Office and the Park.

All designs shall be prepared in standard drawing programs including Adobe Illustrator with CAD Tools Dimensioning Plug-In. All designs shall be rendered in scale and shall be fully dimensioned, detailed, and specified. The contractor shall prepare design drawings in accordance with NPS requirements and document all details and specifications as necessary to fabricate all signs. All design documents shall be presented to the COR for review and approval. All deliverables in Task 1 – 3 shall submitted as pdf files and be uploaded through the NPS file sharing site or emailed directly to the COR for review and approval. Task 4 documents shall be supplied in the native design programs and pdf files and be uploaded through the NPS file sharing site or emailed directly to the COR for review and approval. Distribution of all design documents for all Tasks shall be handled by the COR.

IV. PERIOD OF PERFORMANCE

All work, including review and approval shall be completed on or before March 29, 2024.

V. REVIEW AND APPROVAL

Review and approval of the deliverables shall be completed within the number of days listed below. COR will notify the contractor, in writing, of approval or rejection of the work. In the event the government delays beyond the period specified the contractor shall be entitled to a day-to-day extension in the completion date.

Task 1: Project Overview and Existing Conditions Documentation

VI. TRAVEL

In accordance with Public Law 99-234, "Federal Civilian Employee and Contractor Travel Expense Act of 1985", travel-related expenditures for Contractor's personnel are restricted to the limits established for federal employees. This includes mileage for company-owned vehicles.

The Contractor shall travel as required to support program tasks. All travel arrangements are to be made by the Contractor. Payment for transportation, per diem, mileage, parking, and other fair and reasonable travel expenses will be paid in accordance with the effective Federal Travel Regulations as amended and supplemented by the Department of the Interior travel regulations where applicable. No Federal travel authorizations are to be issued. The Contractor shall make every effort to keep travel costs to a minimum. No reimbursement will be made for parking at a Contractor's normal place of work. No overhead, profit or G&A shall be allowed on travel costs.

Travel costs shall be reimbursed in accordance with the Federal Travel Regulations. Travel is only funded to the extent specified within the travel CLIN. The contractor shall not incur any travel costs in excess of the amount funded within the travel CLIN. The Government shall not be liable for any travel related costs incurred by the contractor which are in excess of the total amount funded within the travel CLIN.

If the contractor has reason to believe they may exceed the amount funded on the travel CLIN, they shall notify the Government Contracting Office immediately. Additional funding may only be added to the travel CLIN through a formal signed modification issued by a Government Contracting Officer. Profit, fee, G&A or overhead may not be incurred on travel costs.

VII. INSPECTION AND ACCEPTANCE

All service and work performed under this contract shall be subject to inspection and acceptance by the designated Contracting Officer's Representative (COR) at any time during performance. If the COR determined that services, work or materials being furnished do not meet the required standards, the government reserves the right to have the work performed elsewhere, charging the contractor with costs involved, subject to the provisions of FAR 52.249-8.

VIII. GOVERNMENT-FURNISHED PROPERTY

The contractor shall be responsible for security and protection of all government-furnished property or materials provided in connection with this contract. Following acceptance of all work by the government, the contractor shall return to the COR all government-furnished property not incorporated into the project.

The Production-ready graphic layouts files shall be furnished at the post award meeting.

IX. WARRANTY

The contractor shall guarantee the workmanship against defects in work and material that might appear under extremely high visitor use and variable weather and climate conditions for a minimum of two years. The warranty period shall commence with final acceptance of work. This shall include all labor and parts at no additional cost to the government.

If during this warranty period, defective workmanship, materials, or equipment are identified by the government, the contractor will be notified, in writing, as to liability and responsibility for corrective action at no cost to the government.

Action may include but is not limited to:

1. Placing all work into satisfactory condition;

2. Making good all damages to equipment, the site, the building, or contents thereof, that have resulted from such unsatisfactory work; and

3. Making good any work, materials, or equipment that are disturbed in fulfilling the guarantee including any work, materials, or equipment that may have been guaranteed under another contract.

Should the contractor fail to proceed with work in accordance with the guarantee within seven calendar days from the notice of corrective action(s), the government will have such work performed at the expense of the contractor.

In no event will the government be responsible for any extension or delays in the scheduled deliverables or periods of performance under this contract as a result of the contractor’s obligations to correct defects, nor shall there be any adjustment of the delivery schedule or period of performance as a result of the correction of defects unless provided by a supplemental agreement with adequate consideration.

If the government returns any work to the contractor for correction or replacement under this contract, the contractor shall be liable for transportation charges up to an amount equal to the cost of transportation by the usual commercial method of shipment from the place of delivery specified in the contract (irrespective of the F.O.B. point or the point of acceptance) to the contractor’s plant and return to the place of delivery specified in the contract. The contractor shall also bear the responsibility for the work while in transit.

The contractor shall be liable for the reasonable costs, including travel of personnel, and disassembly and reassembly of larger items when it is necessary to remove the work to be inspected and returned for correction or replacement.

X. SITE VISITS

The government may conduct site visits during the period of performance of this acquisition.

XI. TECHNICAL DATA CONFIDENTIALITY

The quote submitted in response to this Request for Quote may contain technical data that the offeror or his subcontractor (s) does not want used or disclosed for any purpose other than for evaluation of the quote. The use and disclosure of any such technical data may be restricted, provided that the offeror marks the cover sheet of the quote with the following legend:

“Technical data contained in pages _______ of this quote shall not be used or disclosed, except for evaluation purposes.”

If a contract is awarded as a result of or in connection with the submission of this quote, the government shall have the right to use or disclose this technical data to the extent provided in the contract. This restriction does not limit the government’s right to use or disclose technical data obtained from another source without restrictions. The government assumes no liability for disclosure or use of unmarked technical data and may use or disclose the data for any purpose and may consider that the quote was not submitted in confidence and therefore releasable under the Freedom of Information Act (5 USC 552).

XIV. GOVERNMENT FURNISHED PROPERTY

XV. INVOICING

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (May 2016)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: none

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 - 5 business days of the contract award date.

Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fiscal.treasury.gov or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

XVI. ADDITIONAL WORK

Any additional work not detailed in this contract shall be approved, in writing, by the Contracting Officer via a bilateral modification.

XVII. LOSS OR DAMAGE

The contractor shall be liable for any loss or damage to any government property caused by negligence, theft, or willful misconduct of the contractor, his agents, servants, and employees, and shall indemnify and save the government harmless against all actions, proceedings, claims, demands, costs, damages, and expenses, including attorney’s fees, by reason of any suit or action https://www.ipp.gov/ mailto:IPPCustomerSupport@fiscal.treasury.gov brought for any actual or alleged injury to or resulting from the performance of this contract. The contractor shall submit a full written report to the Contracting Officer within 24 hours following the occurrence of such damage, loss, or injury.

If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the contractor shall be responsible for same. The government, at its option, may in lieu of repayment, require the contractor to replace at his own expense, all such property as directed by the Contracting Officer.

Until the equipment is repaired or replaced, the contractor shall furnish similar, adequate replacement property and/or equipment at no charge to the government, within two business days of the date the equipment has been lost, stolen, or damaged.

XVIII. CONTRACT ADMINISTRATION

A. The National Park Service, Contract Specialist / Contracting Officer address is: National Park Service, Harpers Ferry Center, Office of Acquisition Management, P.O. Box 50, 67 Mather Place, Harpers Ferry, West Virginia 25425-0050.

The contractor shall use the Contracting Officer as a point of contact on all business and administrative matters concerning this contract. All correspondence, other than that of a technical nature, shall be addressed to the Contracting Officer, with information copies of the basic correspondence to the COR.

B. The National Park Service, COR address is: National Park Service, Harpers Ferry Center, Attention: COR, P.O. Box 50, Harpers Ferry, West Virginia 25425-0050.

The contractor shall use the COR as the point of contact for all technical matters under the contract. Technical correspondence shall be addressed to the NPS COR, with an information copy of the basic correspondence to the Contracting Officer.

XIX. FACILITY SECURITY POLICY

Contractors attending meetings or accomplishing work within the buildings or real property of the National Park Service shall adhere to the security policy of each office. It shall be the responsibility of the contractor to contact the office before work begins for a briefing on security policies.

XX. 1452.201-70 AUTHORITIES AND DELEGATIONS (SEPT 2011)

A. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

B. The Contracting Officer will designate a Contracting Officer’s Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor’s performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

C. The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the contractor’s right to proceed; and

(5) Obligate in any way, the payment of money by the government.

D. The contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The contractor need not proceed with direction that it considers to have been issued without proper authority.

The contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the contractor considers to exceed the COR’s appointment, within three days of the occurrence. Unless otherwise provided in this contract, the contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in Paragraph C prior to receipt of the Contracting Officer’s response issued under Paragraph E of this clause.

E. The Contracting Officer shall respond in writing within 30 days to any notice made under

Paragraph D of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

F. The contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

G. Any action(s) taken by the contractor, in response to any direction given by any person acting on behalf of the government or any government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the contractor’s risk.

XXI. CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM

NOTICE TO CONTRACTORS

Contractor Performance Assessment Reporting System (December 2015)

A. FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation.

One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 42.15.

B. The past performance evaluation process is a totally paperless process using CPARS.

CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.

C. We request that you furnish the Contracting Officer (CO) with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official (AO). Information in the report must be protected as source selection sensitive information not releasable to the public.

D. When your Contractor Representative(s) are registered in CPARS, they will receive an automatically generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at https://www.cpars.gov/.

E. Within 60 days after the end of a performance period, the AO will complete an interim or final past performance evaluation, and the report will be accessible at https://www.cpars.gov/.

1. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment.

2. Your comments should focus on objective facts in the AO's narrative and should provide your views on the causes and ramifications of the assessed performance.

3. All information provided should be reviewed for accuracy prior to submission.

4. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "No comment" in the space provided, and then selecting “Accept the Ratings and Close the Evaluation”.

5. Your response is due within 60 calendar days after receipt of the CPAR. On day

15, the evaluation will become available in PPIRS-RC marked as “Pending” with or without comments and whether or not it has been closed.

6. If you do not sign and submit the CPAR within 60 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment."

F. The following guidelines apply concerning your use of the past performance evaluation:

a. Protect the evaluation as source selection information. After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the CO for instructions.

b. Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

c. Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.

G. If you wish to discuss a past performance evaluation, you should request a meeting in writing to the CO no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 60-day review period.

H. A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT

(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).

Covered foreign country means The People’s Republic of China.

Covered telecommunications equipment or services means–

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means–

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;
