(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.

(ii) The solicitation number for this requirement is 140P1524Q0101 and is issued as a request for quotation (RFQ) under the authority of FAR 13.

Responses are due Wednesday August 14, 2024 @ 10:00AM MST/ARIZONA TIME (1:00PM EDT).

Responses shall be emailed to Kim_Greist@nps.gov by the date/time specified above. No late offers will be accepted.

Questions & Clarifications: Interested offerors may submit questions concerning the solicitation by no later than Wednesday August 7, 2024 @ 10:00AM MST/ARIZONA TIME (1:00PM EDT). Phone calls will

NOT be accepted. No questions will be answered after this date unless determined to be in the best interest of the

Government.

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal

Acquisition Circular (FAC) 2024-05 – Effective May 22, 2024.

(iv) This acquisition is subject to a total small business set-aside. The associated NAICS code is 212321 -

Construction Sand and Gravel Mining, with a small business size standard for this NAICS code of 500 employees.

Any vendor that does not list the solicitation NAICS code 212321 in their SAM.gov profile must certify in their response that they comply with the size standard of NAICS 212321 (500 employees).

(v) The Government is requesting firm fixed priced quotes for Item 00010 for 5,000 TONS of ¾” MAG Spec

ABC Road Material. The pricing portion of this combined synopsis/solicitation must be filled out and submitted as part of any quote submitted in response to this RFQ.

(vi) Description of Requirements: The Contractor shall furnish all labor, materials, and equipment necessary to supply and deliver up to 5,000 TONS of Aggregate Base Course (ABC) MAG – Spec ¾” (inch) mix, via dump truck(s) to the designated GRCA locations in accordance with the attached Statement of Work.

(vii) Delivery location: To the staging area located inside the GRCA South Entrance on Vann Road; to be further coordinated with project manager after award.

(viii) Delivery date: No later than 31 October 2024. FOB Destination.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.232-40 Providing Accelerated Payments to Small Business Subcontractors (Mar 2023)

(a)

(1) In accordance with 31 U.S.C. 3903 and 10 U.S.C. 3801, within 15 days after receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.

(2) The Contractor agrees to make such payments to its small business subcontractors without any further consideration from or fees charged to the subcontractor.

(b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment

Act.

(c) Include the substance of this clause, including this paragraph (c), in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial products or commercial services.

Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (Feb 2021)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's

Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the

Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Products and Commercial

Services included in commercial item contracts. The IPP website address is:

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

1. Copy of vendor invoice document in PDF format, which shows pricing breakdown for all items being invoiced for and must include the contract number, date(s) of delivery/service (if applicable), date of invoice, and the vendor’s standard invoice letterhead.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 -

5 business days of the contract award date

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services— Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or

Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
