GENERAL INFORMATION:

This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subparts 12.6, 12.207(b), 13.303 and supplemented with additional information included in this notice. The National Park Service contemplates award of up to three firm-fixed price, Blanket Purchase Agreements (BPA) resulting from this combined synopsis/solicitation to the to the offeror providing the best value to the Government. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P1423Q0011. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2022-08 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

The acquisition is in support of Yellowstone National Park for radon mitigation throughout the park.

This requirement is set-aside for small business concerns.

The North American Industry Classification System (NAICS) code 562910 and the Size Standard is 750 employess.

DESCRIPTION OF AGREEMENT:

A. The National Park Service (NPS) contemplates award of one or more pre-priced Blanket Purchase Agreements (BPAs) resulting from this combined synopsis/solicitation for Radon Mitigation throughout Yellowstone.

B. In accordance with FAR 13.303-2(c)(1), the Government may establish BPAs with more than one (1) supplier to provide maximum practicable competition. Multiple offerors may be awarded. Purchases against the awarded BPAs may be competed and/or rotated among the awardees for mitigation requirements. The services to be ordered are stated below, treating the same as an open charge account.

C. No services shall be furnished without prior approval of the Contracting Officer or authorized representatives

D. The contractor shall furnish services called for by this agreement when requested by the Contracting Officer or his/her authorized representative during a three (3) year period of performance.

E. Purchases will be paid with government credit card and through IPP.gov when written Calls are issued.

BPA POOL:

The Government reserves the right to award additional agreements during the 3-year period if more qualified contractors are found or enter the market.

EXTENT OF OBLIGATION:

The Federal Government is obligated only to the extent of authorized purchases made by authorized personnel against the BPA. This BPA can be discontinued upon thirty (30) days written notice by either party.

AUTHORIZED ORDERING ACTIVITIES:

In addition to the Contracting Officer for the parent BPA, authorized officials specified herein may issue Calls under this contract:

Any warranted Contracting Officer assigned to the Interior Regions 6, 7, & 8, within the limits of their authority.

COR, Randy Froelich with a purchase card only.

Additional authorized users may be added by the Contracting Officer via written authorization.

COVERED ITEMS:

The covered items are listed within this RFQ. Calls may also be placed against other items listed within the awarded Schedule/Category.

PURCHASE LIMITATION:

No individual purchase/CALL under this agreement shall exceed the micro-purchase limit of $2,500.00 unless a BPA Call is provided by the Contracting Officer or designated representative from the Contracting Office and in accordance with FAR 13.105. The rules for use of government purchase cards and micro-purchases apply to this BPA and this BPA shall incorporate any threshold increases, if applicable.

Services subject to Service Contract Labor Standards are currently $2,500.00 and over. A written Call will be issued for any action over the micro-purchase threshold. The maximum authorized limit of this BPA shall not exceed $360,000.00 over a three-year period.

FUNDS:

The BPA does not obligate any funds.

CALLS ARE FIRM FIXED PRICED:

All Calls made under this BPA will be firm fixed price orders. Individual Calls will not be modified to reflect any increases in rates that may occur after award of a Call.

DURATION OF BPA:

The BPA period of performance shall be three (3) years from date of award.

ORDER OF PRECEDENCE:

The terms and conditions included in this BPA apply to all purchases made pursuant to it. In the event of an inconsistency between the provisions of this BPA and the Contractor’s invoices, the provisions of this BPA will take precedence.

ORDERING PROCEDURE FOR CALLS/ORDERS:

Upon receipt of any Call/Order issued hereunder by the Contracting Officer (CO) or authorized park personnel, the contractor, pursuant to such Call, shall furnish to the Government services or product of the type and at the prices set forth in the BPA Call. Calls may be issued at the discretion of the Government during the period set forth elsewhere in this contract.

The Contractor shall, within the time specified, provide a price quote estimate as set forth in the price schedule.

Upon receipt of the contractor’s quote, the CO and the COR or Park Representative shall review the quotes to ensure acceptability to the Government.

The Contactor shall notify the Park Representative or COR if there are any significant difficulties in performance in accordance with the terms of the BPA and BPA Call are anticipated.

FREQUENCY OF ORDERING:

Calls/Orders shall be placed as needs arise.

SERVICE TICKETS:

All services under this agreement shall be accompanied by a service ticket or sales slip that shall contain the following minimum information:

A. Name of supplier/contractor B. BPA number C. Date of purchase/call and name of Government Representative that placed the order D. Itemized list of supplies and services furnished, showing quantity, unit price, and extended total of each item less applicable discounts.

E. Date of service

The billing period shall be per installation of a radon mitigation system.

PRICING FOR MATERIALS:

Prices to the Government for services furnished hereunder shall be as low as those charged to the contractor’s most favored customer for comparable quantities/services under similar terms and conditions, in addition to any discounts for prompt payment.

RENEWAL OF BPA:

Within fifteen (15) days of the anniversary date of the BPA, the parties hereto shall review the BPA to determine whether changing market conditions, availability and quality of services, new suppliers of the same class of items and other pertinent circumstances require a modification or termination of the BPA. Upon satisfactory review, the BPA may be renewed in increments of one year, provided the Contractor’s performance is determined to be satisfactory, pricing remains fair and reasonable and the NPS continues to require the services ordered. Any such renewal will be subject to prior review and approval of the Contracting Officer. In no event shall this BPA exceed three years.

SCOPE OF WORK:

a) Perform a radon test to evaluate type of system requirements by location;

b) Provide data collected during testing to the Park Service Contracting Officer Representative

(COR);

c) Provide mechanical drawings of complete radon system for NPS approval before installation;

d) Install a system as per the National Park Service approved drawing.

Based upon the results of the test and building evaluation, the final mitigation system design shall include the following:

The radon system shall use 4-inch schedule 40 PVC vent piping which shall exit from suction point’s below-grade if required, to be linked together into a single run.

A permanent radon fan (Fan unit shall be easily replaceable clamp type) unit will be installed on the side of the building (gable end) inline of pipe above grade against exterior of building, with vent pipe to exhaust radon above roof level.

Above-grade pipe shall be secured to exterior of building with metal straps.

Basement area if finished space and may require concrete coring for the radon systems (coring shall be done wet to reduce construction dust) Offerors shall not disturb heating duct work or heated lines currently used within the building) Crawl space encapsulation shall incorporate perforated pipe, 20 ml vapor barrier and seam tape.

The vapor barriers shall extend up the foundation stem walls and be secured with seam tape.

Perforated pipe shall be 4-inch round PVC or J-Drain 12-inch flat PVC type.

1. General System Features:

This system shall include labeling, electrical work, a manometer for monitoring proper system function, screened vent end, and the removal of system related construction debris.

All penetrations shall be sealed with hydraulic cement and trenches filled back in with native soil.

The National Park Service is not responsible for any damage to private utilities or irrigation lines while digging required trenching for system.

The awarded contractor shall provide locate service to avoid any potential damage.

System shall be vented on the gable ends of the building.

2. Mitigation System Plan:

The mitigation system shall maintain average long-term radon levels below 4.0 pCi/L for a Lifetime*, based upon long term radon testing (91 days to 1 year) and subject to the Terms and Conditions of this agreement. If average radon concentrations exceed 4.0 pCi/L, the awarded company will make system modifications to reduce radon levels to below the EPA action level, and at no additional cost to the Government.

Contractor shall replace defective mechanical or electrical components of the system up to 1 year after system installation and beginning at the time of system activation.

Radon fans covered under manufacturer’s warranty. AMG® Radon Fans hold a full manufacturers replacement warranty of 5 years. AMG® fans are MADE IN THE U.S.A. (Recommended brand or equal)

3. Mitigation Plan:

The mitigation plan will include two residential units. The mitigation system type specified is an active soil depressurization system utilizing an exterior-mounted blower powered by the nearest residential

P a g e 7 | 32 unit power source. (Dedicated circuit). The system shall be installed under the direct supervision of a radon mitigation professional credentialed by the NRPP working in accordance with the ANSI document Radon Mitigation Standards for commercial buildings (ANSI/AARST RMS-MF 2014).

This scope is for one mitigation system plan. Based on the results of the radon test, building evaluation and mitigation design phase of the project through achieving collateral mitigation within the same building foundation envelope.

4. Electrical requirements:

Includes all materials, labor, and necessary permits. All electrical work shall be conducted by a licensed electrical contractor and is the contractor’s responsibility to perform all electrical work requirements.

All components shall be hard-wired, plug-in style is unacceptable

5. Mitigation Clearance Test The post-mitigation clearance test shall be conducted under the direct supervision of a radon measurement professional credentialed by the NRPP working in accordance with the ANSI document Protocol for Conducting Radon and Radon Decay Product Measurements in single family housing (ANSI/AARST MAMF-2017), subject to the following: Compile and analyze laboratory data, prepare findings, and issue final clearance report to Government.

6. Additional Information:

All work shall be conducted during normal business hours. Normal business hours are defined as Monday through Friday, 8:00 a.m. to 5:00 p.m.

A final project schedule shall be submitted for approval prior to launch of the project.

AWARD SELECTION PROCESS:

Award will be made in accordance with FAR Part 13 to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered (reference ‘Evaluation Factors for Award’, FAR 52.212-2 – Evaluation-Commercial Items’, as outlined below).

52.212-2 Evaluation – Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical capability of the item offered to meet the Government requirement. Provide a project narrative that demonstrates how the company will successfully meet the needs of the Scope of Work.

(ii) Prior Experience: Provide a factual documentation or narrative of a firm’s experience, qualifications, and capability, to meet the acceptability standard provide three examples of if similar size, scope and complexity.

(iii) Past Performance: Submit Past Performance information for the same projects submitted under Project Experience. Past performance will be evaluated to assess the relative risks associated with the offeror’s likelihood of success in performing the solicitation’s requirements as indicated by the offeror’s record of past performance. Evaluation of past performance will be based on consideration of all available relevant facts and circumstances. It will include an assessment of the offeror’s overall commitment to customer satisfaction and will include conclusions of informed judgment.

(iv) Price.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Quotes shall be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.

Service Contract Act Wage Rates apply to this project. Current prevailing Wage Determinations at the time of issuance of this solicitation are included as attachments. In the event the current prevailing Wage Determination is changed by the Department of Labor prior to the closing date of this solicitation, it is the offeror’s responsibility to insure the most recent determination is used in preparing the proposal. An amendment will not be issued prior to closing to change Wage Determination dates and/or numbers. Should the wage rate change after closing, but prior to award, the updated Wage Determination will be incorporated by amendment. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.

If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
