1. This request for quotation (RFQ) is to support the Bureau of Land Management (BLM) Arizona Stare Office’s (AZSO) requirement for Sonoran Desert National Monument Estrella-Wayside Recreation Area Phase One.
The specifics are as follows:

2. Offerors are requested to submit a written technical and price proposal in response to the attached Project Specifications and Construction Plans. Further information on submission of technical and price proposals is provided throughout this document.
3. This procurement is being conducted under the requirements of Federal Acquisition Regulation (FAR) 13. This acquisition is a Small Business Set-Aside under the North American Industry Classification System (NAICS) Code 237990 with a small business size standard of $39.5 in millions of dollars. An offeror determined to be other than a Small Business will be deemed ineligible for award.
4. Evaluation Factors and Basis for Award Determination:
a. Award will be made to the offeror whose proposal is determined to represent the overall best value to the Government using an LPTA evaluation process with acceptable past performance. The evaluation factors and subfactors identified in paragraph 4c (1) and paragraph 4c (2) below will be used in the determination of technical acceptability.
b. After receipt of quotations, the Government will first evaluate the lowest price quotation. If the lowest price proposal is determined to be technically acceptable and otherwise properly awardable, no further evaluations will be conducted, and award will be made. If, however, the lowest price proposal is determined to be technically unacceptable and/or otherwise not properly awardable, further evaluations will be conducted.
c. The standards for determining technical acceptability are below, as well as information concerning price proposals.
(1) Technical/Management Approach Factor: The Technical/Management Subfactors will be evaluated and rated either Acceptable or Unacceptable. In order for a proposal to be rated overall Technically Acceptable, each of the following subfactors must be rated Acceptable. Technical/ management proposals should not exceed 15 pages.
(a) Subfactor 1: Construction Plan. Quotation provided an acceptable construction plan, in the format required, indicating a thorough understanding of the work required as well as a sound and reasonable approach to complete all project elements as described in each technical division of the project specifications.
(b) Subfactor 2: Construction Schedule. The construction schedule was provided in a Gantt or similar format and is within the Government’s specified period of performance. Schedule indicates an understanding of the project requirements and utilizes a logical approach to sequencing.
(2) Past Performance Factor:
(b) Offerors will be evaluated on performance under existing and prior contracts for similar products or services with the past performance being rated as "Acceptable" or "Unacceptable." In order to be rated Acceptable, the Government must determine that based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or that the offeror’s performance record is unknown. This factor will be rated Unacceptable if, based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
(c) Past performance efforts cited must be for similar services as outlined in the Specifications, with satisfactory performance, and must have occurred within the last 3 years. No more than 3 past performance efforts may be submitted, and each past performance effort submitted shall not exceed 2 pages. The Government reserves the right to obtain information relative to present and past performance on its own, in addition to that provided by the offeror. Past performance information may be obtained through the Past Performance Information Retrieval System, through interviews with program managers on past efforts, or any other sources known to the Government.
(3) Price Factor:
(a) The price proposal will be evaluated using one or more of the techniques defined in FAR Part 15.404 in order to determine if they are reasonable and complete. The Government will determine completeness of the offeror’s proposal by verifying that all solicitation requirements have been priced, figures are correctly calculated, and costs are presented in a clear and useful format.
(b) Offerors should ensure price proposals include detailed information regarding the resources required to accomplish the task. Again, the price proposal spreadsheet shall be a separate document from the technical/management proposal. The offeror shall submit their price proposal utilizing the Government provided Pricing Worksheet (Attachment 3). The spreadsheet shall include all formulas.
5. The Government intends to evaluate quotations and award a contract without exchanges with contractors. However, the Government reserves the right to conduct exchanges or seek clarifications if the Contracting Officer (KO) determines they are necessary. The Government further reserves the right to reduce the number of quotations being competitively considered to the greatest number that will permit efficient competition among the most highly rated quotations. If a contractor’s quotation is removed from further consideration for award, written notice of the removal will be provided to the contractor. In the event issues pertaining to a proposed task cannot be resolved to the CO's satisfaction, the Government reserves the right to withdraw and cancel the proposed order. In such event, contractors will be notified in writing.
6. The solicitation contains provisions that apply to this solicitation and clauses that will be applicable to the resulting award.
Some of the provisions and additional BLM instructions require a response from the contractor and must be submitted along with your quotation.
7. In response to this RFQ, no terms, conditions, or assumptions will be entertained. If terms, conditions, or assumptions are included in a quotation, the quotation may be excluded because it failed to comply with the RFQ instructions.
8. An offeror agrees that if its offer is accepted within 60 calendar days from the date of receipt of quotations (unless a different period is stated in the quotation), it will furnish the items and/or services identified in its quotation at the cost offered to the designated point(s) within the time specified in the contract. You also agree that if the Government awards you the contract, the award document sent by the Government to the contractor is a binding and enforceable contract. The contractor has a legal obligation to perform in compliance with all aspects of the Specifications and Contract Plans if awarded the contract.
9. Portions of the offeror’s quotation may be incorporated into the contract.

The offeror shall not complete the representation at paragraph (d)(1) of this provision if the offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, covered telecommunications equipment or services—representation, or in paragraph (v) of the provision at 52.212-3, offeror representations and certifications-commercial items.
(a) Definitions. as used in this provision— Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, prohibition on contracting for certain telecommunications and video surveillance services or equipment.
(b) Prohibition.
(1) Section 889(a)(1)(a) of the John S. McCain national defense authorization act for fiscal year 2019 (pub. l. 115-232) prohibits the head of an executive agency on or after august 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(b) of the John S. McCain national defense authorization act for fiscal year 2019 (pub. l. 115-232) prohibits the head of an executive agency on or after august 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. this prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a federal contract. nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. the offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. the offeror represents that—
(1) It □ will, □ will not provide covered telecommunications equipment or services to the government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. the offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the offeror responds “will” in paragraph (d)(1) of this section;
and
(2) After conducting a reasonable inquiry, for purposes of this representation, the offeror represents that— it □ does, □ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. the offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the offeror responds “does” in paragraph (d)(2) of this section.
(e) Disclosures.

(ii) For covered services—
(a) If the service is related to item maintenance: a description of all covered telecommunications services offered (include on the item being maintained: brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(b) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. if the offeror has responded “does” in the representation in paragraph (d)(2) of this provision, the offeror shall provide the following information as part of the offer:

52.222-5 Construction Wage Rate Requirements – Secondary Site of The Work (May 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror’s request for a wage determination for a secondary site of the work.

52.222-23 Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity for Construction (Feb 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all of the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4.
Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the -
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor; (3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.
(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is Sonoran Desert National Monument in Maricopa County, Arizona.

52.225-10 Notice of Buy American Requirement – Construction Materials (May 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American—Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers.
The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.

SURVEILLANCE SERVICES OR EQUIPEMENT (AUGUST 2020)
(a) Definitions. As used in this clause— Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network). Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
